HomeMy WebLinkAbout1982-01-26city council minutesBook 23 REGULAR MEETING January 26, 1.982 12:00 Noon Page 27 The Meeting was called to order by Councilman Betts, who was designated as the Chairperson for this City Council Meeting due to the absence of Mayor McCluskey and the City Council President, Jack Raymond. Chairman Betts requested that everyone stand and give the Pledge of Allegiance to the Flag. The Roll of the City Council was called with the following members present: L. Carter, J. Carter, Mallea, Betts, and Cowles. Absent: Raymond. (AUDIENCE PARTICIPATION) Chairman Betts asked if there was anyone from the audience who cared to bring anything before the City Council that was not on the prepared Agenda. Since there was no one, the Chairman declared that the Meeting would continue as outlined on the Agenda. OLD BUSINESS (REPORT ON WARNER CLAIM FROM COMMITTEE;) Chairman Betts called on Councilman Cowles to report with regard to this claim submitted by Kenneth Warner. Councilman Cowles informed the City Council that there was a damage claim submitted by Kenneth Warner. He talked with Mr. Warner regarding an incident that: took place on January 9, 1982- Mr. Warner advised Councilman Cowles that his wife was operating a 1968 Impala on or about Third and Madison; the roads were estremely slick. There was a large amount of gravel in the middle of the road and the vehicle struck this causing damage to the tire and wheels in the amount of $143..48. Mr. Warner stated that it was the responsibility of the City and he did contact the Mayor. The Mayor then contacted the Superintendent of the Street Department who advised the Mayor that it was the City's mistake and had been corrected. Councilman Cowles further said that after talking with Mr. Warner, he felt that it was a legitimate claim. It was then MOVED by Cowles, SECONDED by J. Carter that the City Council accept this damage claim from Kenneth Warner and that payment be made in the amount of $143.48. NEW BUSINESS (CATERING PERMIT) MOTION CARRIED The City Clerk presented one Catering Permit for The Office to cater for a teacher's banquet to be held at Diane's Sandwich Shop on the 6th of February. The Chief of Police, submitted his approval and the fee was paid to the Office of the City Clerk. MOVED by L. Carter, SECONDED by Mallea that approval be given for the Catering Permit as presented by the City Clerk. MOTION CARRIED (APPOINTMENT OF OFFICE MANAGER) Chairman Betts stated that on behalf of the Mayor, he would request approval from the City Council for the appointment of Donna Talley as the Office Manager. MOVED by L. Carter, SECONDED by Cowles that the City Council accept the recommendation of the Mayor to appoint Donna Talley as Office Manager. MOTION CARRIED Book 23 Page 28 (RECOMMENDATION ON FINAL PAYMENT FOR VIPCO) Chairman Betts called on Mrs. Robison -to present this item on the Agenda. Mrs. Robison stated that the following memorandum was distributed to the City Council members stating the City Engineer's recommendation: Parametrix has submitted a final project estimate for the above referenced project. Valley Inland Pacific (contractor) has approved the final estimate with certain reservations ($1,950 in claims). Under our contract with VIPCO, we are required to make payment within 10 days of their signing the payment estimate request which was 1/14/82. The.project . is completed and VIPCO should be paid for the remainder of the project except for the following: 1. A final inspection on 1/21/82 by E.P.A. showed slight additional work was required by contractor (touch up painting, cleanup of electrical cabinets, replumbing of automatic oilers). 2. Additional bookkeeping is needed between contractor and City showing how work done by City forces was credited in the contract. 3. The City has received notification from.the State of Idaho that VIPCO owes them $16,836.00 in State Sales and Use Tax. In light of the above, I would recommend that the Council set up an escrow fund. Payment shall be made by the City to the escrow fund in.the amount due VIPCO. This money shall not be released to VIPCO until the items addressed earlier are completed. I believe this would cover all _bases _ with respect to contractor's payment, State taxes and our potential liability._, for non -- payment.. This shall also give VIPCO time to make necessary repairs. Payment. due VIPCO is in the amount of $20,716.00 MOVED by Mallea, SECONDED by J. Carter that the final payment to VIPCO in the amount of $20,716.00 be made by the City of Caldwell and placed in escrow fund until the State Tax Commission was satisfied. MOTION CARRIED (SET TIME FOR COUNCIL TO MAKE AN ESTIMATE OF NECESSARY FUNDS REQUIRED FOR MUNICIPAL IRRIGATION SYSTEM) Chairman Betts explained that pursuant to the Idaho State Code, the City Council was to meet the second Monday in February, which was February 8th, to make an .estimate of necessary funds required for the Municipal Irrigation System. He would ask _.that the City Council set the time on February 8th that.they would meet for this purpose. After discussion, it was determined that the City Council would meet at 10:00 a.m. on February 8th to make this estimate. (DETERMINATION ON WATER RATES) Chairman Betts informed the City Council that he would leave this item until the last as requested by the Mayor in hopes that he would return in time for the discussion. (COMMITTEE REPORTS) Councilwoman Mallea stated that she had no reports to make at this time. Councilman J. Carter informed the Council that he.attended the Planning and Zoning Commission Meeting and there was several.request=_ for Public Hearings; a couple of requests for special.use permits for game rooms. The discussion items to be brought up some time in February would be a manufactured housing ordinance and a committee Book 23 Page 29 was established to study the setback rules for the City. There was a Solar Access Workshop in February and several were appointed to go to this meeting. Councilman L. Carter informed the Council that he had no reports to make at this time. Councilman Cowles stated that he was invited the night before to attend the M.A.A.C. Meeting that was held at City Hall. They discussed their recent boxing tournament that was held and was a success. They also discussed some of the coming events they had planned and the fact that they were going to be involved with the Police Department and looking forward to more noticeable group function towards the summer when the migrant population starts to come into Caldwell. Councilman Cowles felt it was a very positive group and one that he felt he would be working with some. Chairman Betts stated that he had no reports to make other than his attendance at the Planning and Zoning Meeting which was already reported on by Councilman J. Carter. (MAYOR'S COMMENTS) (PLANNING AND ZONING RECOMMENDATION) Chairman Betts stated that this item under the Mayor's. Comments was with regard to the vacation of Halstead and a zone change. There was only three units involved and not the High density as discussed previously. The Commission recognized most of the problems that were confronted at the last request. There was only two variances involved in this request and the Commission established a Public Hearing on the 16th of February. (PERSONNEL POLICY) Councilwoman Mallea reported that: the Committee appointed to meet with the personnel persons involved in the revamping of the Policy did so. The City Council will he provided with a copy of the proposed Personnel Policy which was put together and Councilwoman Mallea further stated that she would hope that all members of the Council would look over this policy and the revisions suggested. It was hoped that the Policy would be brought before the City Council at the next Regular City Council Meeting for a vote and it would be Councilwoman Mallea's recommendation that it be passed. (TYPEWRITER MAINTENANCE AGREEMENT) Chairman Betts read the following letter from Jim Keesee of Quality Office Products: Thank you for allowing us to service the City's typewriters on our PREVENTATIVE MAINTENANCE PROGRAM this past year. I hope you have been completely satisfied with the quality of our service. The enclosed invoice is the renewal to cover service for the coming year. We are happy to be able to offer our service again this coming year for the same low price. If you have any questions, or if we may be of service in any way, as always please feel free to contact us. Chairman Betts explained that Mr. Keesee was submitting a bill for this year's Maintenance Agreement. He services twelve type - writers and the rate was $60.00 a year per machine. Mr. Keesee gives a $5.00 discount for each machine which makes the total $660.00 for one year. He was asking for approval of the renewal of this maintenance agreement for this year. MOVED by Mallea SECONDED by J. Carter that approval be given for the renewal of the maintenance contract with Quality Office Products for the typewriters. MOTION CARRIED Book 23 Page 30 (APPOINTMENT TO HOUSING AUTHORITY) Chairman Betts read the following letter written to the Mayor from Donald -E. Downen, Chairman of the Board of Commissioners of the Housing authority of Caldwell: it is my understanding that. the term of David L. Cornwell as Commissioner of the Housing Authority of the City of Caldwell expired on December 31, 1981. The Commissioners of the Housing Authority would like to recommend to you that Mr. Cornwell be reappointed as a - Commissioner of the Housing Authority of the -City of . Caldwell. Mr. Cornwell has been a faithful and valuable member of the Housing Authority during his term. Chairman Betts said that this was the Mayor's recommendation and he would ask for action on this appointment. It was then MOVED by,L. Carter, SECONDED by J. Carter that the City Council accept the recommendation of the Mayor that David L. Cornwell be reappointed as a Commissioner of the Housing Authority of the City of Caldwell. MOTION CARR (APPOINTMENT TO LIBRARY BOARD) Chairman Betts read the following letter addressed to the Mayor and written by Scott Bolton, President of the Library Board: At the January 6 meeting of the Caldwell Public Library Board, the Board voted to change their bylaws to add the Friends of the Library, Inc.., President as a voting member of the Library Board. The present President is Alta Williams. In addition, they voted to have Sylvia Hunt be renamed for a full term as a member of the Library Board. Attached are two excerpts from the Bylaws. The first states that the bylaws may be amended at any Regular Meeting of a Board with a quorum present.: The second states that the Board shall be by City Council from among the citizens of the City. These two actions are being sent to you for ratification. MOVED by Mallea, SECONDED by Cowles that the City Council accept the recommendation of Library to add the Fried -ds of_the Library, Inc. President as a voting member of the Library Board and that Sylvia Hunt be reappointed as a member of the Library Board. MOTION CARRIED (CERTIFICATE OF APPOINTMENT TO SUSAN GILROY) Chairman Betts informed the Council that Nis'. Gilroy was not present at the meeting so they would not be able to award her the Certificate of Appointment at this time. (MEETING RECESSED) Chairman Betts stated that due to the fact that the'Mayor was not back for the determination on water rates that he asked to be present for, he would recess the meeting for five minutes in hopes that he would arrive. Chairman Betts then reconvened the Meeting at 12:30 and stated that they would continue with the meeting as the Mayor had not returned. (CERTIFICATE OF TO SUSAN GILROY) Chairman Betts informed the Council that Ms. Gilroy was now present at the Council Meeting and he would ask her to come forward to receive her Certificate of Appointment to the Historical Commission. This was approved at the last City Council Meeting and therefore; Book 23 Page 31 (DETERMINATION ON WATER RATES) Chairman Betts stated that he would discuss the item on the Agenda regarding water rates at this time. The Mayor had instructed the Council to leave this item until last with the hope that he would be back in time for the discussion, but due to the fact that he had not returned they would continue. Chairman Betts further stated that all Council members had gone over the proposals that were submitted, and the budgets from the last couple of years. He felt that the Council had more questions they would like to have answered before making a determination. Chairman Betts then asked the Council what action they would like to take at. this time. Councilman L. Carter was recognized and stated that he felt the rest of the Council felt the same! as he did in that there was some questions still to be answered. It was an important decision to make at this time and it was his feeling that perhaps the Finance Committee, which was actually all. of the Council, meet and get more figures before making the determination. It was then MOVED by L. Carter, SECONDED by J. Carter that the water rate determination be turned over to the Finance Committee for further investigation. Councilwoman Mallea stated that the Council has received input from Mr. Leahy, the City Engineer and have received input from the Mayor's Committee that came to the Council to advise them. She now felt that. it would behoove all of them to meet and work out the problems that each one of them has. She would concur with Councilman Carter's suggestion. Chairman Betts then asked for a vote on the motion. MOTION CARRIED Chairman Betts then asked the City Council to set a meeting date for this discussion as he felt it should be done as soon as possible. Councilman J. Carter said that he felt this date would also depend on how soon the Council could get the information needed from Mr. Leahy. Chairman Betts agreed that Mr. Leahy would need some time to put together answers and get the figures needed. Mr. Leahy informed the City Council that he would be available all next week and would prefer sitting down with them to discuss their concerns and questions. After discussion, it was determined that they would meet on Monday, February lst, at 4:00 in the afternoon.
