f The City Council of the City of Caldwell, met in Special Meeting on Call of the
Mayor, with the Mayor, E. L. Vassar presiding.
On Roll Call the following Councilmen answered present: W.S. Boynton, F. D.
Mumford, G. M. Fenrieh and W.R. Hollingsworth. Absent: Edgar L. Oaken, and G. W. Mont-
gomery.
The Mayor stated that the object of the meeting was the letting of the contract
for the water pipe.
Moved by Hollingsworth , seconded by Fenrich that the Mayor and City
Clerk be authorized to make and execute the following contract with the Caldwell Plumbing
and Heating Company to -wit:
CONTRACT
THIS AGREEMENT,Made and entered into this 21st., day of January,
1935, between the CITY OF CALDWELL, IDAHO, hereinafter called the "City,
and Caldwell Plumbing & Heating Company, hereinafter called the Contract-
or,
WITNESSETH: That the said Contractor agrees to furnish all materials
for enlargement, extension, repair and improvement of the Municipal Water
Works; I
The Contractor agrees that all the above materials shall be strict-
ly in accordance with the plans and specifications attached hereto, and
hereby made a part of this contract.
The prices named in the ebove proposal still be paid by the said
City and received by the.said Contractor as full compensation for the
completed work of every item in this contract, involving the furnishing
of all materials.
The payments shall be made in cash. The final payment to be made
within thirty days after the completion and acceptance of the work.
IT IS FURTHER AGREED By both parties that the following documents
are essential portions end made a part of the complete contract: The
proposal; the general and (detail specifications; all drawings, maps and
plans, and the Contractor °s bond, all of which are attached hereto.
The contractor agrees to repair at his own expense any defects
in the materials arising within twelve months after the completion and
acceptance of the work.
IT IS UNDERSTOOD That this contract applies to the furnishing of
material only and does not apply to the installation and construction
of the works, but applies to Schedule A only;
IN WITNESS WHEREOF, Vie have hereunto set our hands and seals the
day and place first above mentioned.

The Mayor directed the City Clerk to fall the roll which resulted as follows:
Yeys: Hollingsworth, Boynton, Numford and xenrich. Nays: . None. Absent, and not voting
Montgomery and Oakes. Therupon the Mayor declared the said motion duly passed.
There being no further business to come b efore the Council, it was on motion
duly seconded and carried, declared adjourned.
