January 20, 1931
1;00 o'clock p.m.
Council met in adjourned session pursuant to adjournment with Mayor
Mo00nnel presiding, and Councilmen: Bollman, Pickens, Gordon, Johns, Leighty
and 3sndmeyer present. Absent, None.
Owing to the absence of the City Clerk the Mayor appointed Mr. W. C.
Dyer Rating Olerk, and announced that the Council was in session for the con-
sideration of any businses which might lawfully come before the meeting.
Thereupon the Clerk presented and read a written proposal from Dairy -
menb Co- operative Creamery of Boise valley, which proposal was and is in words
and figures as follows. to -wit;

City of Caldwell,

Gentlemen:
In view of the ma1Y protests which have been made against the
creation of Local Improvement District 3o. 14, and the construction of the
, improvement therein, as defined in ltesolution'No. 57, passed and approved
December 23, 1930, and in view of the apparent reluctance on the part of the'
Mayor and Council to proceed with the construction of said improvements on
account of such protests, Dairymens Oo- operative Creamery of Boise Talley
submit the following proposal= ,
(1) 'In consideration of the creation bf an improvement district and
the construotion of a aewer system therein to oonsiet of a main line con -
structed of eighteen inch sewer piping material from 6 Point 'adjacent to
the property of the Creamery in Block 92 of the original town of Caldwell,
Idaho, thence along FifthAvenue to the alley between Denver and Chicago
St eats thence along said alley tto its intossecti99 with Boise A nug the
Da 0o- operative Creamery oY Boise Talley,wil pay to the oily t e
total cost of said sewer upon demand by the City Treasurer of Caldwell, Idaho.
(2) It is understood that the Chamber of Oommeros of the City of Caldwell
is taking subscriptions for phe purpose of assisting in defraying the cost of Bald
sewer, such funds to be paid to the City of Caldwell, when Collected.
Dairymen® 0o- operative Creamery of Boise Valley shall be reimbursed to the
extent of the collections on such subscriptions and the City of Caldwell
shall pay, as a portion of the cost op said. sewer, the sum of %B.00 on
account of benefits accruing to the city by reason of the construction of such
sewer.
The passage of an ordinance cresting a local improvement d'1Btri4
with boundaries modified to conform to the approximate lines above indicated
and the construction of the improvement therein by the City, shall be deemed
a sufficient acceptance or this proposal, and Dairymens Co- operative
Oreamery of Boise Valley hereby binds itself to make the payments herein
provided for.

Thereupon it was moved by Sandmeyer and seconded by Gordon that the
proposal of Dairymeae Co- operative Creamery of Boise Valley be accepted, and
that the'Counoll proceed to the further consideration of Bill 3o. 23. Motion
carried.
The Council proceeded to a farther consideration of Bill 3o. 23,
whereupon it was moved by Bandmeyer and seconded by Leighty that all rules,
requiring the reading of a bill on three separate days be suspended and that
Bill No. 23 be read the second time by title and the third time in full and
placed on its final passage. The question being on the motion, the Mayor
caused the Clerk to call the roll with the following results: Those voting
in the affirmative: Bollman, Dickens, Gordon, .Johns, 1eighty and Sendmeyer.
Those voting in the negative: none. Absent And not voting: none. So the
Mayor declared the motion had passed by the necessary three - fourths majority
and directed the Clerk to read Hill No. 23 the second time by title and the third
time in full, section by section. 'Tlie Ulark read 'the Bill as directed. The question
being "$hall Bill No. 23 pasal" The Mayor directed the Clerk to call the roll which
resulted as follows: Those voting in' the affirmative; Bollman, Dickens, Gordon,
Johns, Leighty and gandmeyer. Those voting in the aegative: None. Absent and
not voting; none. Thereupon the W(ayor declared Bill No. 23, had passed and the

directed the Clerk to make the proper entry of the same and to cause Ordinance No.
490, to be published in the Caldwell Ne;Se Tribune, the offioial newspaper of the
City of Caldwell.
Thereupon Councilman Leighty introduced the following resolution and ma4ed

the City of Caldwell. Idaho, have heretofore created ,Local Improvement District
No. 14, for the City of Caldwell, Idaho, as a local improvement district, for the
purpose of constructing su-itable ditches, drains, conduits, and channels for
sanitary �d drainage purposes, or either or both thereof, with outlets, cesspools,
manholes, catch basins, flush tanks, septic tanks, and all other sewer -
appurtenance. necessary for the comfort, convenience, health sod well —being of the
munioipality therein, as provided in Ordinance No. 490, passed and approved January
20, 1931; and
wHEHEAb, the City Engineer has prepared and filed with the City Clerk of
said city, plane and specifications for the construction of improvements in said
Local Improvement Dietriot No. 14, which plane and specifications have been presented
to the City Council; therefore
BE IT RESOLVED, and ordered by the Mayor and Council of the pity of Caldwell,
Idaho;
Section 1. The plans and specifications heretofore prepared by the City
Engineer and filed with the City Clerk for the construction of ditches, drain.,
conduits, and channels for sanitary and drainage purposes,_ or Either or both thereof,
with outlets, cesepoole ^, manholes, catch basins, flush tanks, septic tanks, and all
other sewer appurtenances necessary for the comfort, convenienoe, health and well—
being of xhe municipality, in Local Improvement District no. 14, for the_City Of
Caldwell, Idaho, be and the same hereby are approved,
The motion for the adoption of said resolution was duly seconded by
Gordon. The question being "Shall the Resolution pass?" The Mayor direotefl the
Clerk to call the ro,111 which resulted as follows: Those voting in the affirmative:
Bollman, Dickens, Gorgon, Johns, Leighty and sandmeyer. Those voting in the negative;
None. ,absent and not voting: None. Whereupon the Mayor deolared the motion had

Thereupon Councilmen Leighty introduced the following resolution and
moved its adoption.

DISTRICT NO, 14, FOR THE C TPY OF CALDWELL, IDAHO, IN THE MANNER PROVIDD BY
ORDINANCE NO. 490.
BE IT RESOLVED, by the Mayor and Council of the City of Caldwell, Idaho:
Beo. 1. The Clerk of the City of Caldwell, Idaho, ie hereby ordered
and direoted to advertise for bids to be received by the Council k the City of
Caldwell, Idaho, at the City Hall until the 2nd day of February, 1931, at 6 :00
o'clock p.m., for the furnishing of the material and doing the work for the con -
struation of suitable ditches, drains, conduits and channels for sanitary and
drainage purposes or either or both thereof, with outlets, cesspools, manholes,
catch basins, flush tanks, septio tanks and all other sewer appurtenances neo-
eseary for the comfort, convenience health and well- being, of the m=icipslity
in Local Improvement District No. 14, in the'menner set forth in Ordinance No.
490. No proposal to be considered unless accompanied by a certified check in
favor of the City of Caldwell', for five percent of the total amount bid OR evidence
of good faith, to be forfeite$.if the successful bidder faila, negleoti or refuses
to enter into a oontraot and provide suitable bond for the faithful performance
of the work and pratgotion of the labor end materialmen in case the contract is
awarded him. The Amount of the bond to be a aum equal to the total amount of the
euooeseful bid, the right to be reserved to the city to reject any and all bids,
or reject a bid in part and accept it in part :, or to let the work as a whole or

THE MOTION for the adoption of said resolution was duly seconded by
Sandmayer. The question being "Shall the resolution pass ?" The Megor directed

duly signed and approved said resolution and the Clerk duly signed and attested
the same.
It was moved by Laighty and seconded by Gordon, that the Council
- adjourn. Notion carried. Whereupon the Council adjourned.
