REGULAR MEETING
January 19, 1982
7:30 p.m.
The Meeting was called to order by Mayor McCluskey.
The Mayor requested that everyone stand and give the Pledge of
Allegiance to the Flag. The Mayor asked the two Patrol Leaders
of the Boyd Scout Troop #228 to step forward and lead the group in
the Pledge of Allegiance. The Mayor explained that this Scout
Troop was under the leadership of Noble Dean as the Scoutmaster
and Al Miller as the Assistant Scout Master and he would welcome
them to the Council Meeting.
The Roil of the City Council was called with the following
members present: Raymond, L. Carter, J. Carter, Mallea, Betts,
and Cowles. Absent: none.
(APPROVAL OF MINUTES)
It was MOVED by Cowles, SECONDED by J. Carter to dispense with the
reading of the minutes of the Regular City Council Meeting of
January 5, 1982, the Regular City Council. Meeting of January 12,
1982, and the Executive Session of January 19, 1982, and approve
them as written.
MOTION CARRIED
(AUDIENCE PARTICIPATION)
The Mayor asked if there was anyone in the audience who cared to
bring anything before the City Council at this time that was not
on the prepared Agenda. Since there was no one, the Mayor declared
that the Meeting would continue as outlined.
OLD BUSINESS
(REPORT ON HEARING WITH DIVISION OF ECONOMIC AND COMMUNITY AFFAIRS
AND DISCUSSION)
The Mayor stated that he would report with regard to this hearing
as he was the person in attendance. There was to be a Committee
with regard to this item and after talking with Councilman J. Carter,
it was determined at this time that the City of Caldwell will not
even be qualified to put in an application for a grant. This was
because the City of.Caldwell. has an ongoing Rehab Grant. There was
one section that specified this, but the Mayor did state that he
would like for the Council to plan for the next year or-at least
for the future. Mr. John Bonham, the Head.of the H.U.D. Unit for
Region Ten, assured the Mayor that Caldwell would get the last
leg of the grant and there would be no problems.
(REPORT ON THE PERSONNEL POLICY AND PERSONNEL ADVISORY BOARD)
The Mayor explained to'-the City Council that the Board- would consist
of the following personnel: Mayor, Personnel Of'f_icer,.One Department
Head, Council President, Council Member, Public'Works.Director or
the Police Chief, one non- officer. of Employees +. "Association, and one
employee at large (from Fire or Police Assoc.). The Mayor then
asked Ron Redmond to give a brief report with regard to the Policy.
Mr. Redmond stated that he had distributed revised copies of the
Policy to all the City Council members. It was Mr—Redmond's
recommendation that one more workshop be scheduled to finalize
the Policy. After discussion, it: was determined that the workshoi
would be on Monday, January 25th, at 8:30 a.m.
(DATE ESTABLISHED FOR SAFETY TRAINING WORKSHOP)
The Mayor explained that Ore -Ida Foods has offered.to take Caldwell
as a test City to put on a Safety Training Workshop. They have a
very effective safety training program in th6ir` plant as it has
received national recognition. They were willing to work with the
City of Caldwell as a pilot program to assist the City in getting
a program started. The only request they made was that all of the
City Council and the Administration become involved in the first

session. The Mayor then read the following letter from Dennis
Davis, the Safety Director for the City of Caldwell:
The date of March 9, 1982, at 1:30 p.m. has been set for a
workshop with Ore -Ida Foods Safety personnel. The program
is going to address training procedures for City owned and
operated equipment. This includes both on and off road
vehicles. Your attendance is essential to the success of the
program. If you have any conflict with the set date or time,
please contact me immediately.
Note; Would all supervisors make a list of the equipment
you presently have or are planning to buy.
(TOWN HALL MEETING - WATER RATES)
The Mayor announced that on Wednesday night, the 20th of January,
at 7:00 p.m. there would be a Town Hall Meeting at the City Hall
in relation to water rates. The City of Caldwell, the Mayor felt
sure, would have to raise the water_rates.as the City of Caldwell
was unbelievably below any other City in the State of Idaho. The
Mayor and Council wanted to go to the public.with the proper
information as to why this raise was necessary. There was a group
selected of fourteen people throughout the City from all walks of
life who use various amounts of water and were in various financial
situations. This group will act as a sounding board for the City
Council. Mr. Phil Leahy will explain the program to them and they
in turn will ask questions. Anyone else in the audience will have
the right to write a question on a piece of paper and hand to one of
the fourteen people for their determination as to whether it was
logical and if so, will transmit it on to Mr. Leahy.
(DATE OF SYSTEMS ACTION PUBLIC HEARING)
The Mayor explained that this was a Public Hearing scheduled for
January 27th, at 7:30 p.m. in the City Hall. This was with regard
to the State's desire to turn Tenth Avenue from Cleveland to the
Interstate over to the City of Caldwell and take it off the State
Highway System. In attendance besides the Mayor and Council, will
be members of the Road and Streets Committee of the Chamber of
Commerce. A Committee was appointed from the City Council to do
some study on this proposal and a report of that meeting was in the
Council's basket. There was also a statement made up by the City
Engineer and a recommendation from him. The Mayor stated that he
would appreciate it if the Council members would read all of the
information with regard to -this proposal from the State as he would
like a firm stand on it.
NEW BUSINESS
(OATH OF OFFICE TO JOHN SHIRTS - POLIC:E OFFICER)
The Mayor stated that this was the time set for the Oath of Office
to be given to John Shirts, a new Pblice Officer. Before asking the
City Clerk to administer this Oat1.z, the Mayor requested that the
Chief of Police give a brief summary of what was required to become
a Police Officer in the City of Caldwell. The Chief then did explain
to the audience, and particularly the Boy Scouts in attendance, just
what was done in the way of testing, background investigation, and
etc., to become a Police Officer.
After this discussion, the City Clerk administered the Oath of
Office to John Shirts, the new Police Officer,and he received the
congratulations from the Council, Mayor, and audience.
(QUESTIONS FROM THE BOY SCOUT TROOP)
The Mayor then requested that the City Council allow Item Number six
on the A -enda to be moved to this time on the Agenda as the Scout
Troop had requested that they be allowed to ask some questions and
were unable to stay after 8:00 p.m.
It was then MOVED by Mallea, SECONDED by Betts that Item Number Six
under New Business be addressed at this time as Number Two on the
Agenda under New Business.

The Mayor then opened the.Meeting to the Boy Scouts for their
questions to the City Council.
(CATERING PERMIT)
The City Clerk presented one catering permit for approval by the
City Council. This was requested by the Corral to cater at the
O'Connor Fieldhouse for the Basque Dance which was to be held on
January 23rd. The Permit was approved by the Chief of Police and
the fee was paid to the Office of the City Clerk.
MOVED by Mallea, SECONDED by L. Carter that,approval be given for
the Catering Permit as presented by the City Clerk.
MOTION CARRIED
(REQUEST FOR NEW BEER LICENSE - PENNYWISE)
The Mayor read a letter received from the Chief of Police giving
his report on the background investigation for this request stating
that there was no reason for not allowing this beer license for
packaged beer at Pennywise Drug. The Mayor also informed the Council
that all the application forms were in order and the fee paid to
the Office of the City Clerk.
MOVED by L. Carter, SECONDED by Mallea that this request for a new
beer license at Pennywise Drug be granted.
MOTION CARRIED
(DAMAGE CLAIM FROM KENNETH WARNER)
The Mayor informed the City Council that he had .talked with Mr.
Warner on the telephone with regard to this claim and Mr. Warner
did bring to City Hall a note.with some costs-on it. The Mayor
talked to the City's Roads and Streets Department.and it was felt
that Mr. Warner had a valid claim. He.did,_however, state that
he would like to turn this claim over to the Claim Committee to
get the details on this claim and bring back to the Council with
their recommendation. The Mayor then gave.to Councilman Cowles - -'
the name and what little.informa=ion . he had at this time and ask that
the Committee look into the claim further.
(CHANGE ORDER NO. 25 - TREATMENT PLAN`.P PROJECT)
The next item was the Change Order No. 25 for the Treatment Plant.
The Mayor called on the City Engineer, Ron Redmond, to report with
regard to this item.
Mr. Redmond stated that hopefully this would be one of the final
change orders for this project. He had received the final estimate
on this change and was one of the items recommended by Parametrix
to pay. It was in the amount of $260.00 for a culvert extension
on the access road.
Mr. Redmond further commented that to bring the Council up to date
on the Plant; there was to be a final inspection on the plant on
Thursday. The Department of Health and Welfare representative from
the State would be here as well as a representative from Parametrix.
There was a final estimate prepared by Parametrix and signed off
by Vipco. Vipco was reserving a claim, but Change Order No. 25
was the last change order that was being recognized by.Parametrix
as valid. Vipco had four different items that total up to about
$2,000 that they are reserving claims on. Mr. Redmond further
said that he had not had a chance to talk to either Parametrix or
Vipco as yet so there may be one more to consider. This present
change order was a valid claim.
MOVED by Raymond, SECONDED by Betts that the City of Caldwell
honor Change Order No. 25 and it be processed for payment.
MOTION CARRIED
Mr. Redmond further informed the City Council that he would prepare
them a summary sheet of the project.

(RECOGNITION OF SCOUT TROOP #205)

The Mayor recognized the presence of Scout Troop #205. Mr. Buzzell,
the Scoutmaster, explained that they were an Explorer Scout Troop
present at the meeting with regard to a Merit Badge on Communisations.
They were to listen to the City Council and the Mayor communicate at
this meeting and after leaving they would discuss what they had
learned from the communication in this meeting. One of the Scouts
was also interested in discussing_ with the Mayor a possible Eagle
Scout Project.
Councilman Betts asked if it would be possible to have a report
from the Scouts as to what they learned at this particular meeting
by the communication between the City Council members and the Mayor.
(LETTER FROM A.I.C.)
The Mayor read a letter received from John 0. Cotant, Jr., President
of the Association of Idaho Cities asking the Mayor if he he would
accept an appointment to serve out the remaining five months of
Ernie Starr's term on the Board of Directors. This appointment
was to be through June 19, 1982, at which time the delegates to
the Association's Annual Conference will elect someone to a full
two year term for that Board position. The Mayor informed the
Council that he did write a letter of acceptance and also let it
be known that he would campaign I -or the permanent position.
(FINANCIAL REPORT)
The Mayor called on Councilman Betts to give the Financial Report.
Councilman Betts reported that the Finance Committee did go over
the Requests for Payment for this month. There was checks in the
amount of $330,848.96; a Payroll of $177,835.54 of which $36,633.25
was Fringe Benefits.
MOVED by Betts, SECONDED by J. Carter that the checks be issued
and the Requests for Payment be filed in the City Clerk's Office.

(COMMITTEE REPORTS)
Councilwoman Mallea said that she would report first on Alta
William's reception which was very nice and she would thank all for
attending. Mrs. Williams called her and ask ;,that she remind the
Council that the Stadium Board Meeting was the next day at noon
and the Friend's of the Library Semiannual Meeting will be at Noon
on January 25th at the Elks. Councilwoman Mallea also said she
would remind the Council again of the Basque Dance which will be
January 23rd at the Fieldhouse.
Councilman L. Carter reported that he did attend the Golf Board
of Control Meeting and they went over different projects they have
in mind. He also attended the Senior Citizens Board Meeting which
was a nice meeting and the Center was looking good. He again said
that he would like for the City Council members to be his guests at
their Wednesday noon luncheon as soon as it can be arranged.
Councilman Raymond informed the City Council that he would not
be in town for the next Tuesday noon meeting. He also said that he
would like to comment on a letter about the Canyon County Fire Chief's
Association dinner on Thursday night at the Golden Pheasant. He felt
that the City Council members would find it very informative. The
Mayor.further said that he would like to have at least two of the
Council members attend this dinner. Dave LeRoy was to be the speaker.
Councilman Raymond and Councilman Cowles both informed the Mayor that
they would attend.
Councilman Raymond also informed the Council that Representative
Larry Craig was going to be in the area on Saturday afternoon at the
Elks Lodge and would be available: for any questions.
Councilman Cowles also reported that he attended the Senior Citizen's
Meeting and felt that they were a very positive group and he was
looking forward to working with them.

Councilman Betts was recognized and stated that at this time he
would like to resign from the City - County Jail Committee and would
ask that the Mayor appoint somebody else who might be more effective
Councilman Raymond stated that his intention in contacting Commission
Jensen was to talk about communications between the City and the
County and not to just talk about the jail situation. Councilman
Betts further said that he did not feel that he was effective on the
Committee and if Councilman Raymond felt that he'might have a chance
he should do so. The Mayor stated that this would be fine.
(MAYOR'S COMMENTS)
1. Removal of street barriers at Michigan.on College,property. The
Mayor stated that he had told the Roads and Streets Department,
and it was done, to remove the street barriers at Michigan. This
was right in front of the old Boone house which was from
Cleveland over to Ash. There was a lot of complaints with regard
to this barrier; one in the paper and one from an attorney. The
Mayor further said that he had talked with Dr. DeRosier and he felt
that the barrier was of no importance at this time and it was agreed
between them that it would be appropriate to remove it at this time.
Councilman Raymond discussed this with the Mayor and questioned as tc
whether the removal should be done as the intent was to facilitate
a closed campus which the College was working towards. The Mayor
further said that Dr. DeRosier was quite adamant in that he did not
wan to ui et the community in the area. This was the reason the
Mayor asked that the Barrier be moved right away. The barriers were
temporary and put there originally to get the feelings of the public.
2. The Mayor reported that there would be a Crime Prevention
Committee Meeting on the 27th of January in the City Hall at noon.
3. The Mayor further informed the Council that he had a call from tr
President of.the Student Body at the College of Idaho and they were
attempting to get together and have some kind of community project.
He was to meet with the Mayor the next day and if anyone had azay
ideas for a project, he would appreciate them sharing it with him
There being no further business, the Meeting was adjourned at
8:30 p.m.
