The Council met in regular session, pursuant to adjournment with � Daley, $residing,
Councilmen Conley, Kimbrough, Mumford, McConnell and ` fheeler, present, and Dutton, absent.
Bill No. 25,by Wheeler, entitled " All ORDINANCE VACATING A POITIO1 OF THE ALLEY IN'BL CE
72, OF TIM REVISED DUP OF CALDWELL, IDAHO " was read for the 'first time. A motion °was °made by
Kimbrough, and seconded by "heeler, that the rules requiring the reading of a bill on three
separate days be suspended; and the Bill No. 25 be read the second time by title and the th rd
time in full and placed on its final passage. The Mayor directed the Clerk ,to call t'ae roll on
the aforesaid motion with the following result:
AYES: CONLEY, KIi,[BROUG , 1=—CID, MCCON -I -, AIM WHEELER.
NAYES: NONE.
ABSENT: DUTTON.
The Mayor declared•the motion had carried by the neces ^ary 3/ 4 majority, and directed
Clerk to read Bill No. 25, the second time by title, and the third time in full, section b:

ABSENT: DUTTON. Thereupon the I:ayor decalred Bill No. 25 had'passed, and now became Ordini

same upon the journal of proceedings.

Your Memorialists, the Mayor and Council of the City of Caldwell,State of Idaho, rasps
represent, that,
MHERiAS, there a; to be no provision in the laws of the State of Idaho authorizing
of the second class to deealre what are deemed to be nuisances; or to prevent, remove and
abate nuisances, without an expensive and cimberseme court proceeding, and,
WHEREAS, situations frequently arise whereby the public health and peace require action
nuisances existing ip such cities of the second class, but by reason of lack of power to
legislate on such subjects, and the expensive and odmbersome method provided for court
proceedings, such ar are frequently postponed and oftentimes neglected, to the menace
public health and safety; now, therefore be it
RESOLVED; That we, your memorialists, the IAayor and Council of the City of Caldwell, Sta
Idaho,do most earnestly, recommend that the Legislature of the State of Idaho, by appropria
legislation extend the provisions of Section 3820, Idaho Compiled Statutes, to apply to t
cities of the second class in the State of Idaho; and be it further
RESOLVED, that a copy of this memorial be furnished to the Senate and to the Rouse of
'spresentatives of the,Degislature of the State of Idaho.
The aforesaid motion was seconded by Conley, and the Clerk was directed by the Mayor to
the roll on the same with the following result:

NAYES: _PIONE.
ABSENT: DUTTON. The Mayor decalred the motion had passed by the necessary 3/4 majority and

The Council met in regular session,pursuant to adjournc3ent, January 31st, 1927,
at 8 P.M. , with May or Yaley, presiding, Councilmen, Conley, Dutton, Mamford, 11cuonnel,
and present, and Eimbrough, absent.
Walter Hriffithe appeared before the Council and outlined the plans of the people
he represents, eebe -FRaag concerning the occupying by Frank Compton of the building
located on Lots 1 -7 , both inclusive in Block 75, Original rownsite, for car storage.
He informed the Mayor and Council that he would p ace concrete under the gprights,
repair the floor, the rear and front, the roof where needed, and and two gut =ere,
which would e:.tend to the alley.Er. Compton stated his plan regarding the -se of
I the same for a storgge place of business. It wa,a then voted on motion of Wheeler,
seconded,by Conley, that a permit be granted to Frank Compton for fifteen(1N months
for the use of the building situated on Lots 1 -7, bbth inclusive, Block 75, Original
Totmsite'for storing cars, provided provided that the aforesiad repairs are made, and
provided further that the transfer of the business, in case there was suc?}, sgould have
the sanction of the Mayor and Council.
