COUNCIL CRAMBERB, JAN. 16, .1928.
8:00 P. M.
Council met in regular session persuant to adjournment of Jan. 2, 1928, with
Mayor Dunlap presiding and the following Councilmen present;. DAVIS, DUTTON, HOFFMAN,
JACKSON, MCCONNEL AND MUMFORD.
Bill No. 12 by Mumford, entitled "AN ORDINANCE CONFIRMINE THE CREATION AND
ESTABLISHMENT OF LOCAL STREET IMPROVEMENT DISTRICT NO. 6, IN THE CITY OF CALDWELL:AP-
PROVING THE A,SSESSidENT ROLL FOR SAID DISTRICT AS FILLED IN THE OFFICE OF THE CITY CLERK
ON MARCH 7, 1927; AND ACCEPTED AND CONFIRMED BY THE COUNCIL ON APRIL 4, 1927; PROVIDING
FOR THE PAYlUjIT IN INSTALLMENTS OF THE COSTS AND EXPENSES OF THE IMPROVEMENTS MADE IN
SAID DISTRICT, PROVIDING FOR THE ISSUE OF IMPROVEMENT BONDS OF THE DISTRICT; ASSESSING
THE COST OF THE SAID IMPROVEMENT AGAINST THE LOTS, BLOCKS AND PARCELS OF LAND IN SAID
DISTRICT CONTIGUOUS OR TRIBUTARY TO, FRONTING OR ABUTTING UPON SAID IMPROVEMENTS AND DES-
CRIBING THE MANNER FOR THE COLLECTION AND PAYMENT OF SAID ASSESSMENT ", was read in full
for the first.time,
It was voted on motion of MGdonnal, seconded by Mumford, that a resolution be

drawn authorizing the Mayor to enter into a contract with the Oregon Shortline Railroad
Company on behalf of the City of Caldwell, for the purpose of selling and furnishing
oity water to.said company for the period of two years.
RESOLUTION NO. 6 BY HOFFMAN.
" A.RESOLUTION ADOPTING AGREEMENT BETWEEN THE CITY OF CALDWELL AND OREGON
SHORTLINE RAILROAD COMPANY RELATIVE TO FURNISHING AND SALE OF WATER FROM SAID CITY TO
SAID RAILROAD-COMPANY FOR THE YEARS 1926 and 1929.
" WHEREAS, It appears to be for the mutual benefit of the City of Caldwell and
the Oregon Shortline Railroad Company that the said City of Caldwell shall furnish and
supply to said railroad company sufficient water for use in connection with the operation
of its railroad station, section buildings, trains and locomotives, and for irrigation of
the parks near the railroad station at Caldwell, Canyon County, Idaho, with water to be
delivered through an existing pipe line; and
"WHEREAS, Motion was duly made and seconded, and carried that proper resolution
shell be drawn authorising the Mayor of the City of Caldwell to enter into proper contract
with said railroad company for the sale and purchase of said city water;
"NOW,t.;TBEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL
IDAHO;
"Section 1. That -the Mayor of the dity of Caldwell be, and he hereby is, author
ized and directed to enter into such a contract with the said Oregon Shortline Railroad
Company on behalf of the said City of Caldwell, for the purpose of selling and furnishing
to said railroad company city water in consideration of the sum of Seventy Dollars (70.00
and No 1/100the per month to be paid by the said railroad company to city monthly, for water
used during the preceding month by said company;
"She City of Caldwell to supply and furnish to said railroad company sufficient
water for use in connection with the operation of its railroad station, section buildinge,
trains and locomotives, and for the irrigation of the parks near the railroad station at
Caldwell, Canyon County, Idaho. With water to be delivered tosaid company through an
existing pipe line;
PROVIDED, However, that all water used for irrigation shall be used perauent to the
provisions of Rule 10 of Ordinance No. 91 of the City of Caldwell, Idaho, and
"PROVIDED, FURTBER, That said contract shell applyonly to the tape now in use by

now- fa-We by said railroad company and that it any new tape other than those now in
use are made, the water taken therefrom shall be paid for at the regular meter rates
charged other consumer; said agreement to be for the period beginning January 1, 1928
and extending to December 31, 1929 unless earlier terminated as in said contract to be
provided ".
It was toted on motion duly seconded by Davis, that Resolution No. 6 do pass.
Whereupon the Clerk was directed to record some on the journal of the prooedings of
the Counoil, as a part of the minutes of this meeting; and thereupon the Mayor and
Clerk signed and approved same in open session of the Council.
A letter was read from Frank C. Evens Co., Denver, Colorado, under date of
January 1, 1928, asking for information regarding the payment of Local Sewer District
No. 9 Bonds, and more especially bonds Nos. 2 to 13 inclusive. The matter was discussed
but on action taken.
The Finance Committee reported no having investigated the Securities held by
the Clerk of Canyon Bounty, covering the City Funds on deposit in the First National
Bank and Caldwell State Bank of maldwell. Idaho, and found the following;

L. M. Porter reported that Mrs. Selena E. Flemmons wished to oonneot with the
Sewer on certain lots within Sewer District;No. 9, the same being just out side of dsid
District. It was suggested that if Mrs, Flemmons pay the regular assessment charge
( * per lot it would be agreeable. The matter was referred to the Sewer Committee.
It was voted on motion of Jackson, seconded by.Davis, that Council adjourn to
January 24, 1928.

" A RESOLUTION DECLARING THE INTENTION OF THE COUNCIL OF THE CITY OF CALDWELL,
IDAHO, TO CREATE AND ESTABLISH LOCAL IMPROVEMENT DISTRICT NO. I OF THE CITY OF CALDWELL,
IDAHO, FOR THE PURPOSE OF OILING; PROVIDING THE COSTS AND EXPENSES OF SAID IMPROVEMENT
ARE TO BE LEVIED AND ASSESSED UPON THE PROPERTY BENEFITED, AS HEREIN DESCRIBED; DECLARING
ITS INTENTIO TO MAKE SUCH IMPROVEMENT; STATING THE NAMES OF THE STREETS AND ALLEYS UPON
WHICH SAID IMPROVEMENT IS TO BE MADE AND THE POINTS BETWEEN WHICH SAID IMPROVEMENT IS TO
BE MADE; STATING THE KIND AND CHARACTER OF THE PROPOSED IMPROVEMENT AND THAT THE SAM IS
AN ORIGINAL IMPROVEMENT; GIVING THE ESTIMATE TOTAL COST OF SAID IMPROVEMENT AND THAT THE
COST AND EXPENSES OF THE SAME ARE TO BE ASSESSED AGAINST THE ABUTTING, ADJOINING AND
ADJACENT LOTS AND LANDS ON SAID STREETS; STATING THE METHOD BY WHICH'THE COST AND EX-
PENSES OF SAID IMPROVEMENT WITHIN THE INTERSECTIONS IS TO $E PAID; FIXING THE TIME WITHIN
WHICH PROTESTS AGAINST SAID IMPROVEMENT, 02 THE FORMAATION OF SUCH DISTRICT, MAY BE FILED
AND FIXING TI29E WHEN SUCH PROTESTS MAY HE HEARD." WAS READ THE FIRST TIME IN FULL.
