HEARING EXAMINER
MEETING MINUTES
Tuesday, May 12th, 2026 @ 1:30 pm
Caldwell City Council Chambers Room, 205 S. 6th Avenue, Caldwell, Idaho
CALL TO ORDER – Hearing Examiner, Ms. Sabrina Durtschi opened the meeting for the public hearing at 1:30
p.m.
REVIEW OF PROCEEDINGS (OPENING STATEMENT) – Ms. Sabrina Durtschi outlined the procedures for
the public hearing.
MEMBERS PRESENT: Angelica Gomez (Administrative Assistant); Katie Wright (Planner III); Hallie Hart (City
Engineer)
CONSENT CALENDAR: Approve the April 14th, 2026, Hearing Examiner Meeting Minutes.
OLD BUSINESS:
1. ACTION ITEM: Public Hearing Quasi-Judicial: Case Number DEV26-000001, SPP26-000001,
ZON26-000001: The applicant, Ardurra, on behalf of Land Ex Soterra LLC, is requesting approval of a
development agreement modification, a rezone, and approval of a preliminary plat modification for Soterra
Subdivision No 2. The applicant proposes to rezone 11.36 acres of the site from C-2 to R-2 to
accommodate 51 single family lots. The remaining 4.41 acres would remain as Community Commercial.
The entire phase 2 site is designated as Community Commercial within the Future Land Use Map, which is
compatible with both R2 and C-2 zoning. The 15.77 acre site (R3258300000 and R3258301100) is located
on the southwest corner of the intersection between E. Ustick Rd. and S. Kimball Ave, in Caldwell, Idaho.
This application was continued from April 14th, 2026, Hearing Examiner Meeting.
JD Lyle (Representative) 332 N Broadmore Ave, Nampa, signed in favor of the application and gave a brief
overview of the project by use of a PowerPoint presentation.
In response to the Hearing Examiner’s question, Mr. Lyle stated:
• The previous application requested 9 acres of commercial with the townhome product.
• They were attached single family to be sold as six plex units
• The developer can answer questions about neighborhood meeting attendance.
Katie Wright (Planner III) 205 S. 6th Avenue, provided the staff report by outlining its contents by use of a
PowerPoint presentation.
In response to the Hearing Examiner’s question, Ms. Wright stated:
• There were comments in the City Council minutes that addressed how important the commercial is.
• There is a condition in the development agreement that states the whole top portion be used for
commercial.
Public Hearing Testimony was opened:
• Ross Holiday (Property Owner) signed in favor, 134 W. 13100 S. Suite 200, Draper UT, stated the
neighborhood meeting was well attended at the YMCA. He also stated that he was not a part of the
original application in 2022.

In response to the Hearing Examiner’s question Ms. Wright stated in the 20/40 Comprehensive Plan this area
was shown as business. In 2024 they requested for it to be medium density residential. The City did not have
the new Comp Plan adopted at the time of the second submittal.
Mr. Holiday stated if they had waited an additional three months when the new comp plan was adopted then
the project would’ve fallen in those perimeters well and most likely would have been approved.
• Paul McLane, signed in opposition, 113 Appalachian St, stated his concerns are of added density
and reduced commercial. He believes it should be more commercial based.
Ross Holiday (Property Owner) 134 W. 13100 S. Suite 200, Draper UT, in the rebuttal stated:
• There is a desire to have commercial but not a desire for intense large parking lot type of
commercial.
• The commercial is for all of Caldwell but more specifically for the area in the 3–5-mile radius.
• Not all commercial is equal, not all locations are equal.
• Have to look at the specifics of the site and make the right decision for a given site.
• This site supports small scale commercial.
• Have community support at a very high level for restaurants, medical supporting needs, and daycare.
• This is a great place for those needs.
JD Lyle (Representative) 332 N Broadmore Ave, Nampa, in the rebuttal stated:
• Trying to put something in there that works for their group as well as the community.
• The commercial that is being proposed is intentional and beneficial for the community.
• They were not required to update the TIS with this application.
• Trying to be intentional with the project
In response to the Hearing Examiner’s questions Mr. Holiday stated that half of the lots of phase 1 have been
built.
In response to the Hearing Examiner’s question Mr. Lyle stated he will let Mr. Holiday’s answer stand on
the commercial.
FINDINGS OF FACT AND CONCLUSSIONS OF LAW FOR CASE NUMBER SPP26-000001, ZON26-
000001: The Caldwell Hearing Examiner accepts the Findings of Fact and Conclusions of Law outlined in
the staff report, public testimony, and the evidence list. All adopted ordinances, standards and codes were
used in evaluating the application. The proposed use was conditionally permitted by the terms of the
ordinance and such conditions of approval.
ORDER OF DECISION FOR CASE NUMBER SPP26-000001, ZON26-000001: Based on the Findings of
Fact and Conclusions of Law, the Caldwell Hearing Examiner hereby orders that Case SPP26-000001,
ZON26-000001, is recommended for approval by City Council, subject to the conditions of approval listed
in the staff report.
Ms. Durtschi closed the public hearing testimony at 2:25 pm.
NEW BUSINESS:
1. Action Item: Public Hearing for Case Number SPP25-000008, ZON25-000004: The applicant, The Land
Architect LLC, on behalf of Patriots Landing LLC, is requesting a rezone of parcels R0266001100,
R0266001000, and R02660010A0 from R-1 to R-2. Additionally, the applicant is requesting approval of a
