HomeMy WebLinkAboutChecklist_TopazRanchWest2_V1City of Caldwell Community Development Department Planning & Zoning Division Phone: (208) 455-3021 | Web: www.cityofcaldwell.org Caldwell Community Development Department – Planning Division – Performance Bonding PERFORMANCE BONDING INSTRUCTIONS, APPLICATION AND CHECKLIST In the event that an applicant and/or owner cannot complete the non-life, non-safety and non-health improvements, such as landscaping and common areas, public amenities, pathways and pathway signage, lighting, and any required fencing, prior to City Engineer signature on the final plat for a subdivision, and/or prior to occupancy for developments that did not require platting, a surety agreement may be approved in accord with the procedures set forth in this section 10-03-17 of Caldwell City Code. The estimated cost for sureties (bids for the work to be completed) shall be provided by the applicant and reviewed and approved by the Director. The amount of surety called for shall be one hundred and fifty percent (150%) of the bid amount. In structures with multiple tenants, arrangements can be made to provide occupancy up to a certain amount with a bond in place. FAQs 1. When is performance bonding through Planning and Zoning necessary versus Engineering? Engineering handles all bonding for subdivisions where improvements include, but are not limited to, curb, gutter, sidewalk, street paving, water, sewer, reclaimed water, stormwater facilities or improvements, and/or power facilities are required. As part of this bond, it will also include improvements required by planning and zoning, such as parking lot paving and striping, landscaping, public amenities, common areas, and fencing. For projects and developments that are not part of a subdivision plat, or for subdivisions where no public improvements are required by the City Engineering Department, or for subdivisions where all engineering improvements have been completed but there are improvements required by planning and zoning that have not been completed, a performance bond through planning and zoning is required. 2. What is the process for requesting performance bonding? The first step is to fill out an application for performance bonding and upload it through our online portal. The portal will also require you to upload all documents as listed in SECTION 3. Once the application has been submitted, our Planner managing project bonding will review the documents submitted and contact you with the appropriate amount to submit for the bond or to request additional information. What are the fees for performance bonding? There are two separate fees, the application fee and the surety bond itself. a. Application Fee: A fee of $335.00 will be charged at time of application to get approval to utilize performance bonding. This fee is separate from the actual surety and will be paid online through our online portal. b. Performance Bond: The amount of surety shall be equal to one hundred and fifty percent (150%) of the bid amounts. Sureties shall be in the form of a surety bond, a cashier’s check, or a cash deposit. 4. What is the process for releasing the surety bond? The owner shall submit a written request to the City to release the surety. The request shall include the following documents: a. A statement from the owner that the required improvements are complete. b. A set of plans depicting the improvements that are now complete. Planning and Zoning will verify and certify that the required improvements, as detailed in the surety agreement, have been installed and/or accepted by the City at the end of the noted period. Upon certification, the City shall release the sureties heretofore deposited in the manner and to the extent provided for in the surety agreement in accord with the regulations of this article. A fee of $335.00 will be required to be paid once the application has been submitted. SECTION 3: Submittal Documents The items listed below are considered a minimum. Additional information may be necessary for clarification during the review process. ☐ Master Land Use Application. Copy of the Master Land Use application. ☐ Bonding Agreement. Copy of a completed Bonding Agreement. See attached template. ☐ Bids. Copy of the individual bids for each improvement being included in the bond request. ☐ Application Checklist. Copy of this completed and signed application checklist ☐ Written Explanation. A written explanation of the improvements that cannot be constructed prior to occupancy or plat signature and why they cannot be completed. ☐ Plans. A scaled site plan, landscape plan, and/or plat (whichever are applicable) depicting the proposed improvements to be bonded for. SECTION 4: PDF Formatting Requirements Portable Document Format (PDF) is the industry standard for electronic plans. The City of Caldwell only accepts PDF files for plan review. PDF files must be properly formatted as described below. Please read the instructions carefully. Improperly formatted plans can delay the plan review process for your project. Layers: No multiple layers. Layers must be merged or flattened. Format: Vector-based files are preferred given the ability to scale these files.
