Good afternoon Katie,
I hope I should be addressing this concern/comment to you regarding the subject item. If not, would
you please forward this to the planner who is handling this case.
I spoke at the February 24 hearing regarding this item. My wife and I and another couple from the
Cumberland Estates subdivision also spoke with the developers following the hearing.
I am generally in favor of this proposal with certain restrictions. We live at 4521 Pine Mountain,
approximately 1,000 feet southerly of this development/property.
I realize the potential for this remaining C-2 zoning. I had a relative in a different city whose house
was similarly situated to those houses on Appalachian. When the vacant property behind him
developed, they ended up with a Winco type business immediately behind their house. With the 24-
hour operation and associated noise, their house was just about unhabitable. They eventually sold
and moved. While our house is 1,000 feet from the subject property, a potential 24-hour operation
would bring disruption to our property. So, this proposed rezoning could mitigate that potential. My
concern is how to accomplish the rezoning while protecting privacy for the existing Cumberland
residents along Appalachian that back up to this proposed development and providing the developer
with an economically viable project.
I understand the developer has increased the width of the lots backing to Appalachian to reduce the
number of houses. All the houses in Cumberland are single story. There are a few with 'bonus
rooms' over garage areas. These have a window that open to the street side of the house. So no
one is looking into anyone's back yard from a second story. One of the concerns I heard from the
developer in February is being able to build a single-story house of sufficient square footage to make
it marketable.
One of my requests at the February 24 hearing was that a restriction be included on the rezoning,
D/A, and preliminary plat limiting the houses on the lots that back to Appalachian to single story. The
concern being if two story was allowed, there would be second story windows overlooking into the
Appalachian properties.
So, what if there is a restriction on the D/A and preliminary plat that would limit structures to: 1) a
maximum of two-story single-family residences; and 2) any windows on the second story must face
north. This would provide the developer with marketability and provide property owners on
Appalachian with continues privacy.

I intend to speak on this item at the April 20 Council meeting and propose these restrictions. Is this
something I should contact ALC about? Or will this e-mail to you be forwarded to them? Not a big deal if I
should contact ALC.
