R E C I T A L S: A. This Declaration of Huntington Ridge East Subdivision No. 2 is hereby submitted, as provided for generally within the Declaration and specifically within Declaration Section 7.3 and Article XIV, for the purpose of annexing certain portions of real property located in Canyon County, Idaho, as more particularly described on the Plat of Huntington Ridge East Subdivision No. 2 attached hereto (“Property”). B. The Huntington Ridge Subdivision remains in the Declarant Control Period pursuant to Declaration Article VII. C. In accordance with Section 7.3 and Article XIV, it remains Declarant’s discretion, with the Consent of HHIFVI, to annex additional property without seeking approval from the Owners or the Association. D. Declarant desires to bind the Property within the Huntington Ridge East Subdivision No. 2 Plat to the covenants, conditions, restrictions, easements, charges, and liens created by that certain Declaration. Declarant declares that the Property shall be held, sold, conveyed, encumbered, hypothecated, leased, used, occupied, and improved subject to the terms, covenants, conditions, easements, and restrictions of the Declaration, all of which are declared and agreed to be in furtherance of a general plan for the protection, maintenance, SUPPLEMENTAL DECLARATION OF HUNTINGTON RIDGE SUBDIVISION NO. 2 AND NOTICE OF ANNEXATION HUNTINGTON RIDGE SUBDIVISION 2 subdivision, improvement, and sale of the Property, and to enhance the value, desirability, and attractiveness of the Property. NOW, THEREFORE, BE IT DECLARED: SUPPLEMENAL COVENANTS, CONDITIONS AND RESTRICTIONS 1. Recitals. The above Recitals are specifically incorporated herein by reference and made a part hereof. 2. Definitions. All terms used but not defined herein shall have the meanings given them under the Declaration of Covenants, Conditions & Restrictions for Huntington Ridge Subdivision, as amended (“Declaration”). 3. Effective Date. This Declaration of Huntington Ridge East Subdivision No. 2 will take effect on the date recorded at the office of the Canyon County Recorder’s Office, Idaho (the “Effective Date”). 4. Title. This Declaration of Huntington Ridge East Subdivision No. 2 & Notice of Annexation to the Declaration of Covenants, Conditions and Restrictions for Huntington Ridge Subdivision (“Declaration of Huntington Ridge”). 5. Identification of Annexed Lots. The Lots to be annexed, as confirmed by the recordation of this Declaration of Huntington Ridge East Subdivision No. 2, are those Lots identified in Huntington Ridge East Subdivision No. 2 Plat and provided on Exhibit A. 6. Annexation. The Property is hereby annexed to the Subdivision and shall hereafter be held, sold, conveyed, encumbered, leased, occupied and improved as part of the Subdivision subject to the covenants, conditions, restrictions, easements, charges and liens set forth in the Declaration, the full text of which is incorporated herein by reference and made a part hereof, as the same may be supplemented hereby. 7. General Restrictions and Requirements. All general restrictions and requirements of the Declaration shall apply to the Lots, without exception. 8. Land Classification & Designation of Lots, Common Areas and Easements. The Property annexed herewith, as set forth in the Huntington Ridge East Subdivision No. 2 Plat, does create separate Lots, Common Areas and Easements, if any, as depicted in the Plat, which shall all be governed by and made subject to the covenants, conditions, restrictions, and easements provided for in the Declaration. a. Lots 2 and 14 Block 4; Lots 1, 15, and 26 Block 5; Lots 1, and 12 Block 6 are designated as common lots to be owned and maintained by the Huntington Ridge Homeowner’s Association or its assigns. Said Lot is covered by blanket easements SUPPLEMENTAL DECLARATION OF HUNTINGTON RIDGE SUBDIVISION NO. 2 AND NOTICE OF ANNEXATION HUNTINGTON RIDGE SUBDIVISION 3 for public utilities and Huntington Ridge Subdivision Homeowner’s Association pressure irrigation. 9. Conflict. If any provisions of this Declaration of Huntington Ridge Subdivision No. 2 conflict with any terms set forth in the Declaration, the terms of this Supplemental Declaration of Huntington Ridge Subdivision No. 2 shall govern.
