MEMORANDUM TO CITY COUNCIL
RE: VAC25-000001 – 13th Avenue ROW Vacation
Mayor and City Council,
This memorandum is meant to inform Council on any updates to the subject project
since it was last heard by City Council.
As a reminder of the nature of this request, the subject vacation request is to vacate a
portion of 13th Avenue adjacent to the railroad right-of-way near the County’s new
Sheriff’s building currently under construction. A condition of approval by the City of
Caldwell of this new County Sheriff's building is to construct additional parking to
mitigate the loss of the parking lot said new building is being placed upon. Therefore,
the County is requesting to vacate this portion of 13th to help meet this condition of
approval for the new Sheriff’s building. In addition, the County has noted their
willingness to allow this new parking lot be available and open for public parking for
special events and on weekends to help with any downtown parking issues.
The City Council continued VAC25-01 on May 5th, 2025. The continuation by Council lead
to legal counsel researching whether compensation for the requested right-of-way area
is a viable request between the City and County. It is Staff’s understanding this is a
legally viable request but specific questions regarding this should be asked to the City
Attorney. However, it is important to note the City has not previously required
compensation for right-of-way vacations and does not currently have any policies and
procedures in place for this type of transaction.
At the public hearing on October 6th, Staff will reiterate this memo and provide a brief
synopsis of the vacation request to remind City Council of the bounds of the request.
