HomeMy WebLinkAboutORD 3715ORDINANCE NO.3715 BILL NO.63 AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 10, ARTICLE 3, SECTION 10-03-14-5 (2) AND (3), OF THE CALDWELL CITY CODE, PERTAINING TO THE ESTABLISHMENT OF IMPACT FES AND SERVICE AREAS FOR FIRE IMPACT FEES AND POLICE IMPACT FEES; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH. BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State of Idaho: Section 1. That Chapter 10, Article 3, 10-03-14-5 of the Caldwell City Code is hereby AMENDED AS FOLLOWS: 10-03-14: DEVELOPMENT IMPACT FEES: 10-03-14-5: ESTABLISHMENT OF IMPACT FEES AND SERVICE AREAS: (1) Park Impact Fees: A. There is hereby established a park impact fee service area, to include all land within the city limits. B. Parks impact fees and system improvements will be in accordance with the Impact Fee Study and CIP prepared by Galena Consulting, dated July 2, 2019, and amended January 2020. C. Parks impact fees shall be required as a condition of approval of all residential development in the service area for which a building permit is required and shall be payable prior to the issuance of any building permit (or installation permit in the case of a manufactured home) for a dwelling unit. (2) Fire Impact Fees: A. There is hereby established a fire impact fee service area, to include all land within the city limits. B. Fire impact fees and system improvements will be in accordance with the Impact Fee Study and CIP prepared by Galena C-A-A-roUlt-iRi-, Elated july 2, 2019, and amended --- January 19, 2020 TischlerBise, dated September 12 2025. o �-D 3-1 15 C. (3) Police Impact Fees: A. There is hereby established a police impact fee service area, to include all land within the city limits. B. C. (4) Traffic Impact Fees: A. There is hereby established a traffic impact fee service area, to include all land within the city limits. B. Traffic impact fees and system improvements will be in accordance with the Caldwell Area CIP and Traffic Impact Fee Program prepared by Kittieson & Associates, Inc, dated September 9, 2024. C. Traffic impact fees shall be required as a condition of approval of all residential and non-residential development in the service area for which a building permit is required and shall be payable prior to the issuance of any building permit (or installation permit in the case of a manufactured home) for a dwelling unit or a non-residential building. (Ord. 3642, 1-21-2025) Section 2. This ordinance shall be in full force and effect thirty (30) days from and after its passage, approval, and publication, according to law. Section 3. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be ready to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 4. All ordinances, resolutions, orders, and parts thereof in conflict herewith are repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, IDAHO, this 15t' day of December 2025. SECTION l: AMENDS CHAPTER 10, ARTICLE 3, SECTION 10-03-14-5 (2) AND (3), OF THE CALDWELL CITY CODE, PERTAINING TO ESTABLISHMENT OF IMPACT FEES AND SERVICE AREAS FOR FIRE IMPACT FEES AND POLICE IMPACT FEES. SECTIONS 2 THROUGH 4: PROVIDES THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL, AND PUBLICATION, ACCORDING TO LAW; PROVIDES FOR SEVERABILITY; REPEALS CONFLICTING ORDINANCES, RESOLUTIONS, AND ORDERS. Ordinance No. 3715 was passed by the Council and approved by the Mayor on the l 5`h day of December 2025. The Mayor and City Council approved the foregoing summary on the 15" day of December 2025, for publication on the 23' day of December 2025, pursuant to Idaho Code § 50-901 A. RESOLUTION AUTHORIZING THE EXECUTION OF A CONTRACT WITH TYLER TECHNOLOGIES INC., FOR THE PURCHASE OF PERMITTING, LICENSING AND LAND MANAGEMENT SOFTWARE FOR BUILDING, ENGINEERING, FIRE, PLANNING AND CODE ENFORCEMENT, IN THE AMOUNT NOT TO EXCEED $ 580,000. BE IT HEREBY RESOLVED by the Mayor and Council of the City of Caldwell, Idaho, that the Caldwell City Council authorizes the execution of a contract with Tyler Technologies Inc, for the purchase of permitting, licensing, and land management software for Building, Planning, Fire, Code Enforcement, and Engineering in the amount not to exceed $580,000.
