AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING
CHAPTER 3, ARTICLE 3, SECTIONS 03-03-01 AND 03-03-03, OF THE CALDWELL
CITY CODE, TO REMOVE THE TERM OF OFFICE FOR APPOINTED OFFICERS;
PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND
REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF,
IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon,
State of Idaho:
Section 1. That Chapter 3, Article 3, Sections 03-03-01 and 03-03-03, of the Caldwell
City Code, to remove the term of office for appointed officers, be amended as follows:
03-03-01: APPOINTMENTS, CITY OFFICERS:
The mayor shall appoint, subjeet to with the approval of the a majority of the full
city council: a city clerk, city attorney, public works director, police chief, fire
chief, director of finance, city treasurer, director of aviation, human resources
director, community development director, and parks and recreation director. The
mayor may appoint, with the approval of the a majority of the full city council, such
other officers as are deemed necessary for the efficient operation of the business of
the municipality. If the mayor's nomination for an appointed office is rejected, the
city shall follow the process in Idaho Code § 50-205.

their resignation or removal. Removal of an appointed officer may be initiated by
the ma or and confirmed by ma'ori vote of the full ci council or by unanimous
vote of the full city council as provided in Idaho Code § 50-206.
Section 2. This ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law. The term of appointment for currently serving
appointed officers shall be amended hereby to comply with the provisions of this ordinance.
Section 3. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall

continue in full force and effect and shall be read to carry out the purposes of the ordinance before
the declaration of partial invalidity.
Section 4. All ordinances, resolutions, orders and parts thereof in conflict herewith are
repealed.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3701
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING CHAPTER
3, ARTICLE 3, SECTIONS 03-03-01 AND 03-03-03, OF THE CALDWELL CITY CODE, TO
REMOVE THE TERM OF OFFICE FOR APPOINTED OFFICERS; PROVIDING AN
EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS AND PARTS THEREOF, IN CONFLICT
HEREWITH.
Section 1: Amends Chapter 3, Article 3, Sections 03-03-01 and 03-03-03, of the Caldwell City Code, to
remove the term of office for appointed officers.
Sections 2 through 4: Provides that this ordinance shall be in full force and effect from and after its passage,
approval, and publication, according to law; provides for severability; repeals conflicting ordinances,
resolutions, and orders. The ordinance also provides the term of appointment for currently serving
appointed officers will be amended as provided by the ordinance.
Ordinance No. 3701 provides an effective date, which shall be on the 4th day of August, 2025. Ordinance
No. 3701 was passed by the Council and approved by the Mayor on the 4th day of August, 2025. The full
text of the Ordinance is available at Caldwell City Hall, 205 South 6" Avenue, Caldwell, Idaho 83605. The
Mayor and City Council approved the foregoing summary on the 4th day of August, 2025, for publication
on the 12th day of August, 2025, pursuant to Idaho Code § 50-901 A.
