ORDINANCE NO. 3620
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-2 (COMMUNITY
RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL' DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning
Ordinance No. 1451, approved Case No. ANN24-000008 (Copper Pointe Annexation) at a public hearing
held this 4th day of August, 2025
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-2 (Community
Residential):
A parcel of land being more particularly described in Exhibit A: Legal Description and as shown in Exhibit
B: Map Exhibit.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-2 (Community Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of
the State of Idaho, all in compliance with Idaho Code 63-215.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3620
REGARDING ANNEXATION AND ZONE DESIGNATION
OF CERTAIN PROPERTY
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-2 (COMMUNITY
RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH;
Ordinance No. 3620, provided for the annexation of:
A portion of Lots 5 & 6, Block 4 of Upland Park Addition, filed in Book 2 of Plats at Page 28, Canyon County,
Idaho. Situated in Government Lot 2 of Section 2, T3N, R3W, BM, Canyon County, Idaho, more particularly
described as follows:
COMMENCING at the NE corner of Section 2; thence S89038'38"W, 1992.94 feet along the north line of
said Section 2 to the POINT OF BEGINNING; thence S00°31'19"W, 25.00 feet to the NE corner of Lot 6;
thence S00031'19"W, 666.50 feet along the easterly boundary of Lots 6 & 5 to the SE corner of said Lot 5;
thence S89'39'45"W, 479.35 feet along the southerly boundary of said Lot 5; thence N00°31'30"E, 150.00
feet; thence S89039'45"W, 185.00 feet to the centerline of S. Florida Avenue and the westerly boundary of
Government Lot 2; thence N00°31'30"E, 195.64 feet along the westerly boundary of said Government Lot
2 to the easterly boundary of the existing City Limits for Caldwell as described in Ordinance No. 2919
recorded as Instrument No. 2013-001179; thence continuing N00*31'30"E, 345.64 feet along said westerly
boundary and existing City Limits to the centerline of E. Ustick Road and the N '/. Corner of Section 2;
thence N00°23'35"E, 25.00 feet along said centerline of S. Florida Avenue and easterly boundary of the
existing City Limits for Caldwell as described in Ordinance No. 2736 Recorded as Instrument No.
2008020111 to the southerly boundary of the existing City Limits for Caldwell as described in Ordinance
No. 2276, passed and approved April 5th, 1999; thence N89°38'38"E, 664.37 feet along said southerly
boundary; thence S00031'19"W, 25.00 feet to the POINT OF BEGINNING. Containing 10.287 acres, more
or less.
Section 1. This ordinance shall be in full force and effect from and after its passage, approval, and
publication, according to law.
Section 2. This ordinance is hereby declared to be severable. If any portion of this ordinance is
declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force
and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial
invalidity.
Section 3. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed.
Ordinance No. 3620 was passed by the Council and approved by the Mayor on the 4th day of August, 2025.

Mayor and City Council approved this summary on the 4th day of August, 2025, for publication on the 12th
