AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF GANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R.2 (MEDIUM
DENSITY RESIDENTIAL) ZONE; DEGLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, GANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERW TO THE OFFICIAL IlllAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
oRDINANCES, RESoLUTIoNS, oRDERS OR PARTS THEREOF lN GONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED wlTH CANYON COUNTY, STATE OF IDAHO
AND THE TDAHO STATE TAX COMM|SS|ON, PURSUANT TO IDAHO CODE, SECTION 63-215.
BE IT ORDAINED, BY THE ]UIAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section '1. That the Caldwell City Council, upon recommendation of the Caldwell Hearing Examiner and
following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordlnance No.
1451, approved Case No. ANN20-05 (The Collections Subdivision Annexation) at a public hearing held this
6th day of October, 2022.
Section 2. The parcel is contiguous to the City of Caldwell, ldaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-2 (Medium Density
Residential):
A parcel lying within NE % of Section 2, Township 3 North, Range 3 West, Boise Meridian, Canyon County,
ldaho, being more particularly described as follows:
BEGINNING at the SW corner of said NE % (C % Cometl of said Section 2; thence N00"31'51"E, 660.74
feet along the west boundary line of said NE %; thence N89'41'48"E, 1328.97 feet along the north boundary
line of the S % SW % NE %i Thence N00'30'1 1"E, 661 .18 feet along the west boundary line of the SE %
NE % to the NW corner of said SE % NE %; thenc€ N89'39'28"E, 200.00 feet along the north boundary line
of said SE % NE %: thence S29'39'10"E, 150.00 feet; thence S25'10'10"E, 555.00 feet; thence
S19'06'10"E, 377.48 feet; thence S89'40'50"W, M2.50 feet to the east boundary line of said S % SW %
NE %; thence 500'30'11'W, 330.59 feet along said east boundary line to the SE corner of said S % SW %
NE %; thence S89'42'58'W, 1329.28 feet along the south boundary line of said NE % to the POINT OF
BEGINNING, Contains 30.20 acres, more or less.
Section 3. That the City Engineer and the Planning and zoning Director of the City of Caldwell, ldaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, ldaho as R-2 (Medium Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in etfect from and after its passage, approval and
publicatlon, according to law.
Section 6. The Clerk of the City of Caldwell, ldaho shall, within 10 days following the etfective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a drafrsman-like manner plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of ldaho, to-wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of
the Strate of ldaho, all in compliance with ldaho Code 63-215.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3442
REGARDING ANNEXATION AND ZONE DESIGNATION
OF CERTAIN PROPERTY
This ordinance provides for annexation of a parcel of land to be annexed into the City of Caldwell
as R-2 (Medium Density Residential) zoning.
A parcel lying within NE % of Section 2, Township 3 North, Range 3 West, Boise Meridian, Canyon
County, ldaho, being more partlcularly described as follows:
BEGINNING at the SW corner of said NE % (C % Co.ner]) of said Section 2; thence N00'31'51"E,
660.74 feet along the west boundary line of said NE %; thence N89'41'48"E, 1328.97 feet along
the north boundary line of the S %SW % NE %: Thence N00'30'11"E, 661.18 feet along the west
boundary line of the SE % NE % to the NW comer of said SE % NE %i thence N89'39'28"E, 200.00
feet along the north boundary line of said SE % NE %; thence S29"39'10'E, 150.00 feet; thence
S25'10'10"E, 555.00 feet; thence S19'06'10"E, 377.48 feet; thence 589'40'50"W, O42.50 feet to
the east boundary line of said S %SW % NE %i thence 500'30'11'W, 330.59 feet along said east
boundary line to the SE corner of sard S % SW % NE %i thence 589'42'58"W, '1329.28 feet along
the south boundary line of said NE % to the POINT OF BEGINNING. Contains 30.20 acres, more
or less.
The Ordinance includes a provision to amend the official maps ofthe City by designating the above-
described property as R-2 and providing an effective date, which shall be when published in the
ldaho Press Tribune on the 1 'l'h day of October, 2022. Otd,/l,ance No. 3442 was passed by the
Council and approved by the Mayor on the 6th day of Month, 2022. The full text of the Ordinance
is available at Caldwell City Hall, 411 Blaine Street, Caldwell, ldaho. The Mayor and City Council
approved the foregoing summary for publication pursuant to ldaho Code 50-901A on the 6th day
of October, 2022.
