ORDINANCE NO. 3702
AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL, AMENDING
CHAPTER 05, ARTICLE 09, SECTION 05-09-01, OF CALDWELL CITY CODE,
PERTAINING TO STREET LIGHTS; PROVIDING AN EFFECTIVE DATE; PROVIDING
FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon,
State of Idaho:
Section 1. That Chapter 5, Article 9, Section 05-09-01 of the Caldwell City Code is
hereby amended to the following:
05-09-01: LEGISLATIVE INTENT:
Article 12, section 2, of the Idaho constitution and section 50-302 of the Idaho Code authorize
cities to make and enforce regulations needed for the welfare of the city not in conflict with the
general laws.
Sections 50-312 and 50-313 of the Idaho Code authorize the city to provide for street lighting
within the city and sections 62-2201 63-1311 and 63-1311A of the Idaho Code authorizes the
city to impose and collect fees for such services.
The city council does hereby find that public lighting promotes the safety and welfare of
property owners and residents of the city and the beneficial use and enjoyment of improved
real property within the city.
The city council further finds that residents and property owners benefit from public lighting
through the increased safety that a well lighted neighborhood provides and through increased
safety when driving or walking in the city and that these benefits accrue even when such
lighting is not adjacent to their property.
The city council further finds that it is equitable and fair that the owners and occupants of
improved real property pay for public lighting by charges commensurate with the relative
proportionate benefit, as determined by the council, received for such service.
The city council further finds that the most practical, fair and equitable method of collecting
such charges is to include the billing of such charges as a separate item under the general utility
billings of the city. (Ord. 1945, 5-4-1992)

moved to a different location in state code.
