CALL TO ORDER – Hearing Examiner, Ms. Sabrina Durtschi opened the meeting for the public hearing at 1:30
p.m.
REVIEW OF PROCEEDINGS (OPENING STATEMENT) – Ms. Sabrina Durtschi outlined the procedures for
the public hearing.
MEMBERS PRESENT: Angelica Gomez (Administrative Assistant); Katie Wright (Planner II); Morgan Bessaw
(Deputy Director); Hallie Hart (City Engineer)
CONSENT CALENDAR: The Hearing Examiner approved the April 8th, 2025, Hearing Examiner Meeting
Minutes as drafted.
OLD BUSINESS:
None
NEW BUSINESS:
1. ACTION ITEM: Public Hearing Quasi-Judicial: Case Number: SPP25-000002: The applicant, Gregg Davis
of Breckon Land Design, on behalf of K2CR LEGACY LLC., is requesting preliminary plat approval for Vassar
Heights Subdivision, a residential subdivision with 156 residential lots. The parcel, R3413601100, is zoned R-1,
low density residential, and is located at 20666 Middleton Rd., on the east side of Middleton Rd., approximately
650 feet south of the intersection with Lincoln Rd. in Cadwell, ID.
Katie Wright (Planner II) 205 S. 6th Avenue, provided the staff report by outlining its contents by use of a
PowerPoint presentation.
In response to the Hearing Examiner’s questions, Ms. Wright stated:
• This application is compliant with both new and old comprehensive plans.
• The concern with lot size reduction is if a problem does arise regarding storm drainage during
construction drawings, the lots are already reduced and cannot be reduced any more. They would
have to eliminate lots if they needed more storage space.
• The pathway landscaping will be reduced by 8 feet because of the easement along the drain. There
will be a total of 12 feet of landscaping with the required plantings.
• The development agreement does not need to be modified, it was just a standard template and this
project will comply with those conditions.
Jon Breckon (representative) 6661 N Glenwood St., signed in favor of the application and provided a
description of the application.
In response to the Hearing Examiner’s questions:
• Mr. Breckon stated they would like to tie into the adjacent landscape and pathway system and
remove the landscape buffer along south and east property boundaries if adjacent development
comes in prior to construction.
• Ms. Wright responded that they can do that as long as they relocate the open space somewhere else
on the site to maintain the overall acreage.
