HomeMy WebLinkAboutSummary (Farmway Village ANNEXATION)_DM_FinalORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 3696 REGARDING ANNEXATION AND ZONE DESIGNATION OF CERTAIN PROPERTY AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-2 (MEDIUM DENSITY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH;
Ordinance No. 3696, provided for the annexation of:
Part of the Northwest ¼ of Section 9, Township 4 North, Range 3 West of the Boise Meridian, Canyon County, Idaho described as follows:
Commencing at the Southwest corner of the Northwest¼ of Section 9, Township 4 North, Range 3 West of
the Boise Meridian, Canyon County, Idaho and running thence N89°46'19"E 1444.38 feet along the South line of the Northwest ¼ of said Section to the Point of Beginning; thence N61 °37'07"W 196. 76 feet; thence
N68°03' 41"W 136.80 feet; thence N78°31'41"W 393.60 feet; thence N69°23'41"W 425.50 feet; thence N60°43'41"W 378.92 feet to a point on the East right-of-way line of Farmway Road; thence N00°29'23"E
753.00 feet along said East right-of-way line; thence N00°29'25"E 1316.95 feet along said East right-of-way line to a point on the North line of the Northwest¼ of said Section; thence N89°36'39"E 1299.96 feet along said North line; thence S00°18'25"W 1318.58 feet; thence N89°41'27"E 349.70 feet; thence S00°17'29"W 1319.04 feet to a point on the South line of the Northwest¼ of said Section; thence
S89°46'19"W 239.01 feet along said South line to the Point of Beginning.
Annexation area contains 3,526,165 square feet or 80.95 acres. Section 1. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law.
Section 2. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 3. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. Ordinance No. 3696 was passed by the Council and approved by the Mayor on the 7th day of July, 2025.
