HomeMy WebLinkAbout2025-05-27 MinutesHEARING EXAMINER-�� MEETING MINUTES Tuesday, May 27th, 2025 ( 1:30 pm Caldwell City Council Chambers Room, 205 S. 6th Avenue, Caldwell, Idaho CALL TO ORDER — Hearing Examiner, Ms. Sabrina Durtschi opened the meeting for the public hearing at 1:30 p.m. REVIEW OF PROCEEDINGS (OPENING STATEMENT)— Ms. Sabrina Durtschi outlined the procedures for the public hearing. MEMBERS PRESENT: Angelica Gomez (Administrative Assistant); Garline Davis (Planner I); Morgan Bessaw (Deputy Director); Hallie Hart (City Engineer) CONSENT CALENDAR: The Hearing Examiner approved the May 13th, 2025, Hearing Examiner Meeting Minutes as drafted. OLD BUSINESS: ACTION ITEM: Public Hearing Quasi -Judicial: Case Number: SUP24-000019: This case has been continued from February 25th, March l I th. April 8th, and May 13th 2025 meetings. The applicant, on behalf of Eric Salinas, is requesting approval of a special use permit for an event center in the Traditional Neighborhood zone. The site includes two parcels, one parcel with a building that has previously been used as a restaurant and a second parcel that is undeveloped. The intent is to use the site for indoor and outdoor events, including a location for the placement of mobile food units (food trucks). The site is approximately %2 acre and is addressed as 424 E. Elgin St., with one parcel (801902000) located on the west corner of E. Elgin St. and N 5th Ave. and the second parcel (R0 190000000) on the north corner of E. Denver St. and N. 5th Ave. separated by an alley. Garline Davis (Planner 1) 205 S. 6th Avenue, provided the staff report by outlining its contents by use of a PowerPoint presentation. Hallie Hart (City Engineer) 205 S. 6th Avenue, in response to the Hearing Examiner's question stated Planning and Zoning are the ones who usually dictates the parking requirements. In response to the Hearing Examiner's questions, Ms. Davis agreed the parking spaces on E. Elgin do not meet code, but are an existing use. Additionally, the access and parking on E. Elgin is being modified to becoming slightly more conforming than it is currently and Engineering did not express any concerns about this access or parking. Brent Orton (Representative) 17388 Sunnydale Pl., signed in favor of the application and provided a description of the application. In response to the Hearing Examiner's questions, Mr. Orton stated: • When the neighborhood meeting was held the applicant was very committed to the neighbors. • This development will be different from its previous use because the event center will not be a nightclub. It will be more of a family event center. • One-third of the building is the restaurant, and the rest two-thirds is the event center. In response to the Hearing Examiner's question, Ms. Davis agreed that there are 37 parking spaces that will accommodate the event center and the restaurant. In response to the Hearing Examiner's question, Mr. Orton stated: • The Mobile Food Units will occupy the parking near the electrical pedestals. That leaves the rest of the parking available to use for the public. • There is also on street parking that is available. • There is a drainage system that already exists. • Construction could be done within six months. • There will be ADA compliant parking spaces. Morgan Bessaw (Deputy Director) 205 S. 6ht Avenue, in response to the Hearing Examiner's question stated condition #4 could be modified to say, "these improvements must be done within six months however a temporary certificate of occupancy could be issued if .....or could add to it " if applicant is willing to bond for the infrastructure." In response to the Hearing Examiner's question Ms. Hart stated Engineering would not require any financial guarantee for this project because most of it would be private infrastructure. Ms. Bessaw stated the Planning and Zoning Department has created their own ability to bond for projects that are private that are not public infrastructures. In response to the Hearing Examiner's question Mr. Orton stated: • He is not sure if his client would be comfortable with placing a bond. • If the Hearing Examiner feels that condition is necessary to allow the project to move forward, then please add it. • Neighbors' concerns were fights and loud music. Neighbors were happy with the use changing to a more family event -oriented space. Ms. Durtschi closed the public hearing testimony at 2:09 pm. FINDINGS OF FACT AND CONCLUSSIONS OF LAW FOR Case Numbers SUP24-000019: The Caldwell Hearing Examiner accepts the Findings of Fact and Conclusions of Law outlined in the staff report, public testimony, and the evidence list. All adopted ordinances, standards and codes were used in evaluating the application. The proposed use was conditionally permitted by the terms of the ordinance and such conditions of approval. ORDER OF DECISION FOR CASE NUMBERS SUP24-000019: Based on the Findings of Fact and Conclusions of Law, the Caldwell Hearing Examiner hereby orders that Case Numbers SUP24-000019 for Diamante Event Center is recommended for approval, subject to the conditions of approval listed in the staff report.
