HomeMy WebLinkAboutSummary 3685 (Peregrine West ANNEXATION) (2)ORDINANCES OF THE CITY OF CALDWELL NOTICE OF ADOPTION AND SUMMARY OF ORDINANCE NO. 3685 REGARDING ANNEXATION AND ZONE DESIGNATION OF CERTAIN PROPERTY AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (LOW DENSITY RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH;
Ordinance No. 3685, provided for the annexation of:
A tract of land situated in the SW ¼ SW ¼ of Section 13, T3N, R3W, BM, County of Canyon, State of Idaho,
and being more particularly described as follows:
COMMENCING at the W ¼ corner of said Section 13; thence coincident with the west line of said Section 13 as follows: S00°34'19"W, 1322.22 feet to the S 1/16 corner on the west line of said Section 13; thence
continuing S00°34'19"W, 1322.05 feet to the SW corner of said Section 13; thence leaving said west line, N89°35'05"E, 653.59 feet coincident with the south line of said Section 13 to the POINT OF BEGINNING;
thence continuing N89°35'05"E, 253.16 feet coincident with the south line of said Section 13 to the most southerly SW corner of the tract of land described in the Warranty Deed recorded as Instrument No. 2022-027959, Official Records of Canyon County, hereinafter referred to as the Howard Tract; thence N00°25'32"W, 435.60 feet coincident with the west line of said Howard Tract; thence N89°35'05"E, 28.00
feet to the NW corner of the tract of land described in the Quitclaim Deed recorded as Instrument No. 200455964, Official Records of Canyon County, said corner also being a point on the east line of said
Howard Tract; thence N00°25'32"W, 649.19 feet coincident with said east line; thence S89°31'35"W, 200.00 feet; thence N00°25'32"W, 108.00 feet to the most westerly SW corner of said Howard Tract; thence continuing N0025'32"W, 110.00 feet coincident with the west line of said Howard Tract to the NW corner of said Howard Tract, said corner also being the NE corner of the tract of land described in the Warranty Deed
recorded as Instrument No. 2020-026104 Official Records of Canyon County, hereinafter referred to as the Open Door Tract; thence S89°31’35”W, 633.53 feet coincident with the north line of said Open Door Tract to the NW corner of said Open Door Tract, said corner being a point in the Phyllis Canal; thence coincident with said Phyllis Canal and the westerly line of said Open Door Tract as follows: S19°16’50”E, 549.57 feet; thence S17°55’50”E, 397.22 feet; thence S32°46’10”E, 477.16 feet to the POINT OF BEGINNING. Contains 16.59 acres, more or less.
Section 1. This ordinance shall be in full force and effect from and after its passage, approval, and publication, according to law. Section 2. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force
and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 3. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed.
