ORDINANCE NO. 3685
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (LOW DENSITY
RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning
Ordinance No. 1451, approved Case No. ANN25-000005 (Peregrine West Annexation) at a public hearing
held this 21 st day of July, 2025
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-1 (Low Density
Residential):
A parcel of land being more particularly described in Exhibit A: Legal Description and as shown in Exhibit
B: Map Exhibit.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-1 (Low Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of
the State of Idaho, all in compliance with Idaho Code 63-215.

Annexation Legal Description

A tract of land situate in the southwest quarter of the southwest quarter of Section 13, Township 3 North,
Range 3 West, Boise Meridian, County of Canyon, State of Idaho, and being more particularly described
as follows:
Commencing at the west quarter corner of said Section 13; thence from said Point of Commencement,
coincident with the west line of said Section 13, the following two (2) consecutive courses and distances:
1. South 00°34' l9" West, a distance of 1,322.22 feet to the south
sixteenth corner on the west line of said Section 13, and
2. continuing South 00034'19" West, a distance of 1,322.05 feet to the
southwest comer of said Section 13,
thence leaving said west line, North 89°35'05" East, coincident with the south line of said Section 13, a
distance of 653.59 feet to the Point of Beginning of this description;
thence from said Point of Beginning, continuing North 89°35'05" East, a distance of 253.16 feet to the
most southerly southwesterly corner of the tract of land described in the Warranty Deed recorded as
Instrument No. 2022-027959, Official Records of Canyon County, hereinafter referred to as the Howard
Tract; thence leaving said south line, the following two (2) consecutive courses and distances:
1. North 00°25'32" West, coincident with the westerly line of said
Howard Tract, a distance of 435.60 feet, and
2. leaving said westerly line, North 89°35'0" East, a distance of 28.00
feet to a 1/2-inch rebar marking the northwesterly corner of the tract
of land described in the Quitclaim Deed recorded as Instrument No.
200455964, Official Records of Canyon County, said comer also
being a point on the easterly line of said Howard Tract;
thence North 00°25'32" West, coincident with said easterly line, a distance of 649.19 feet; thence leaving
said easterly line, the following three (3) consecutive courses and distances:
1. South 89°31'35" West, a distance of 200.00 feet,
2. North 00025'32" West, a distance of 108.00 feet to a 1/2-inch rebar
marking the most westerly southwesterly comer of said Howard Tract,
and

also being the northeasterly corner of the tract of land described in the
Warranty Deed recorded as Instrument No. 2020-026104, Official
Records of Canyon County, hereinafter referred to as the Open Door
Tract;
thence leaving said westerly line, South 89°31'35" West, coincident with the northerly line of said Open
Door Tract, a distance of 633.53 feet to the northwesterly comer of said Open Door Tract, said corner
being a point in the Phyllis Canal; thence leaving said northerly line, coincident with said Phyllis Canal,
and the westerly lines of said Open Door Tract three (3) consecutive courses and distances:
1. South 19'16'50" East, a distance of 549.57 feet,
2. South 17°55'50" East, a distance of 397.22 feet, and
3. South 32046' 10" East, a distance of 477.16 feet to the Point of Beginning.
Containing an area of 16.59 acres of land, more or less.
The above -described tract of land is shown on Exhibit "B" attached hereto and made a part hereof.

COMMENCING at the W'/ corner of said Section 13; thence coincident with the west line of said Section
13 as follows: S00°34'19"W, 1322.22 feet to the S 1116 corner on the west line of said Section 13; thence
continuing S00°34'19"W, 1322.06 feet to the SW corner of said Section 13; thence leaving said west line,
N89035'05"E, 653.59 feet coincident with the south line of said Section 13 to the POINT OF BEGINNING;
thence continuing N89035'05"E, 253.16 feet coincident with the south line of said Section 13 to the most
southerly SW corner of the tract of land described in the Warranty Deed recorded as Instrument No. 2022-

Section 1. This ordinance shall be in full force and effect from and after its passage, approval, and
publication, according to law.
Section 2. This ordinance is hereby declared to be severable. If any portion of this ordinance is
declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force
and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial
invalidity.
Section 3. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed.
Ordinance No. 3685 was passed by the Council and approved by the Mayor on the 21 st day of July, 2025.
