ALTERNATIVE METHODS OF
COMPLIANCE CHECKLIST
In accordance with Section 10-03-16 of the Caldwell Zoning Ordinances, the Community Development
Department, Planning and Zoning Division, may allow for an alternative method of compliance of the articles
and/or sections listed below when explicit compliance is not feasible and the alternative complies with the spirit
and intent of the applicable code and furthers the purposes of said applicable code to the same extent, or more,
than the baseline requirement.
•Off-Street Parking Standards
•Fencing
•Landscaping, Buffering and Screening
•Design Review Requirements
•Site Design and Development Standards
•Mixed Use Districts (Urban Core Districts)
•Overlay Districts
•Specific Use Provisions
•Multi-Family Developments
•Other articles as determined by the Community Development Director
All alternative methods of compliance requests must be fully justified by the petitioner. Incomplete or inadequate
justification may result in rejection of the application and/or request. Justification must be specific to the subject
property and shall include all factors that rationalize or substantiate the request.
SECTION 1: Filing Requirements
☐ All applications, checklists, plans and supporting documents must be submitted through our Online Permit
Center.
☐ Filing fees (see Section 2 below)
☐PDF Documents shall be formatted in accordance with Section 5 below.
☐All documents shall follow the naming conventions as shown here.
SECTION 2: Filing Fees
Refer to the Department fee list for most current fees.
☐Application / Permit fees. Fees will be required to be paid once the application has been submitted and
received by the department.

SECTION 3: Submittal Documents
The items listed below are considered a minimum. Additional information may be necessary for clarification during the review
process.
☐ Master Land Use Application. Copy of a completed and signed master land use application.
☐ Application Checklist. Copy of a completed and signed application checklist
☐ Copy of Deeds or Proof of Ownership. If the owner is a corporation or LLC, proof of the representative or
agent for the LLC or corporation will be required.
☐ Property Owner Acknowledgement. Signed Property Owner Acknowledgement form (if applicable)
☐ Location / Vicinity Map. Showing the boundaries of the subject property with relation to nearby roadways
and landmarks.
☐ Request Narrative. A detailed narrative of the request addressing the following:
☐ Description of overall proposed development plan.
☐ Code sections for which alternative compliance is being requested
☐ Explanation of why compliance is not feasible (This cannot be due to financial reasons)
☐ Description of the alternative method being proposed
☐ Explanation of how the alternative method complies with the spirit and intent of the applicable code.
☐ Site Plan. Fully Dimensioned and scaled site plan showing all existing and proposed conditions, buildings
and structures, setbacks and utilities, and specifically calling out any alternatives.
☐ Landscape Plan (if proposing alternatives to landscaping requirements). Fully dimensioned and scaled
landscape plan depicting all alternatives. indicating all street buffers, common areas, and other required
landscape areas. Include tree and planting schedules.
☐ Building Elevations (if applicable). Colored architectural building elevations depicting the alternative, to
include all colors and materials.

Explain How the Alternative Furthers the Purpose as Selected Above:
The alternative provided achieves a streetscape aesthetic with use of a dry landscape
approach and limited use of carefully selected species that are compatible with the building
use. Significant landscaping has been provided across the intersection as a means of
mediating the unavailable space for trees on the primary improvement parcel.

The existing building position does not allow space for significant landscape development
unless the sidewalk could be eliminated completely.
Full landscape development is not compatible with the primary building activities for food
processing. Please see Narrative letter and supporting documentation.

Please explain how the alternative is consistent with the purpose of the applicable code or article and
conforms with the vision of the comprehensive plan?
Please explain how the alternative will not adversely affect neighboring properties or residents and will
not be materially detrimental to the public welfare or impair the intended uses and character of
surrounding properties?
The alternative landscape plan supports the continued safe operation of Darigold in the
company's critical role in regional agricultural processing. The current direction of the city's
code for responsible and sustainable code is supported through use of plant materials with
minimal water requirements suitable to the areas limited annual precipitation. Darigold
desires to present a positive streetscape and is committed to this to the degree possible
without compromising safety on the limited footprint of the facility.
The landscape plan as shown provides streetscape consideration and improvements on an
industrially zoned site where no streetscape aesthetic currently exists. The improvements as
shown are expected to stand out in an area of industrial parcels where very few parcels exhibit
this type of improvement.
The existing building placement close to the property line, does not allow significant space for
landscape development but the brick building presents a well-maintained and attractive, classic
urban building facade that is arguably the best looking in the area and in alignment with the
downtown character.

Please explain how the alternative reflects an innovative or unique design that conforms to the
requirements of the applicable article to the greatest extent possible but offers alternatives for
addressing the intent of the standards by maintaining or exceeding the standards?
Does the alternative maintain consistency and compatibility within an existing development? If yes,
also explain how?
The design utilized extremely drought hardy materials that have been selected to provide as
little habitat and food source to animals and insects as possible.
Seasonal flowering has been carefully considered to limit plant species to selections
expected to draw only the least objectional species with regards to associated debris and
pathogens.
The Ivory Silk Tree Lilac was selected for its narrow canopy to work with the narrow planting
area available.
Mineral mulch and boulders used adjacent to the building facade support safe aesthetic
development adjacent to the building without contributing to leaf litter and associated
pathogens.
It is an improvement over the general area existing standard.
Most area parcels have no plantings; many have no walks. Those that are planted consist
primarily of lawn with occasional Class 1 trees.
The adjacent parcel across 5th Street with landscape space provides mostly maintained
lawn, a few Class 1 trees, and several shrubs on a corner lot with no overhead powerlines or
sidewalk provided and with significant space available between the property line and
building.
Some existing planting strips in the area do not appear to be planted or maintained.

SECTION 5: PDF Formatting Requirements
Portable Document Format (PDF) is the industry standard for electronic plans. The City of Caldwell only accepts
PDF files for plan review. PDF files must be properly formatted as described below. Please read the instructions
carefully. Improperly formatted plans can delay the plan review process for your project.
Layers: No multiple layers. Layers must be merged or flattened.
Format: Vector-based files are preferred given the ability to scale these files.
Resolution: Min. of 300 pixels per inch (PPI)
Grouping: Multiple sheet PDF (single file with multiple sheets)
Labeling: Each sheet of the plans must be labeled with the project name, contractor, and address of the
subject site.

SECTION 6: Applicant Acknowledgement
