ORDINANCE NO. 3613
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (LOW DENSITY
RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-215.
BE IT ORDAINED, BY THE MAYOR ANO CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning
Ordinance No. 1451, approved Case No. ANN24-000006 (Verbena Ranch Annexation) at a public hearing
held this 5th day of May, 2025.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-1 (Low Density
Residential):
The NE¼ of Section 9 and a portion of the NW¼ of Section 10, T3N, R3W, BM, Canyon County, Idaho,
more particularly described as follows:
BEGINNING at the N ¼ Corner of said Section 9, which bears S89°47'16"W, 2664.79 feet from the section
corner common to Sections 3, 4, 9, and 10; thence N89°47'16"E, 2664.79 feet along the north line of said
Section 9 to said common section corner; thence N89°52'44"E, 1784.09 feet to the NW corner of Parcel A
of Record of Survey No. 2019038849, records of Canyon County, State of Idaho; thence S00°07'12"E,
1870.61 feet along the west lines of said Parcel A, Arrowleaf Subdivision No. 1, Book 51, Page 14 and
Arrowleaf Subdivision No.2, Book 53, Page 6, both records of Canyon County, State of Idaho; thence
S80°13'40"E, 259.59 feet to a point of non-tangency; thence southeasterly 421.00 feet along a curve to the
right, having a radius of 481.76 feet, a central angle of 50°04'10", and a chord bearing of S55°11'36"E,
407.73 feet; thence S29°34'35"E, 405.78 feet; thence S46°02'01"E, 53.32 feet to the east line of the NW¼
of said Section 10; thence S00°27'12"W, 108.71 feet along said east line to the Center¼ Corner of said
Section 1 O; thence S89°52'29"W, 2649.52 feet along the south line of said NW¼ to the common ¼ Corner
of said Sections 9 & 10; thence S89°42'07"W, 2659.96 feet along the south line of the NE¼ of said Section
9 to the Center¼ Corner of said Section 9; thence N00°36'39"E, 2652.16 feet along the west line of said
NE ¼ to the POINT OF BEGINNING. Contains 282.62 acres, more or less.
Section 3. That the City Engineer and the Community Development Director of the City of Caldwell , Idaho,
are hereby instructed to so designate the same above described property on the official zoning map and
other area maps of the City of Caldwell. Idaho as R-1 (Low Density Residential).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of
the State of Idaho, all in compliance with Idaho Code 63-215.

NOTICE OF ADOPTION AND SUMMARY OF
ORDINANCE NO. 3613
REGARDING ANNEXATION AND ZONE DESIGNATION
OF CERTAIN PROPERTY
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (LOW DENSITY
RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS

Section 1. This ordinance shall be in full force and effect from and after its passage, approval, and

Section 2. This ordinance is hereby declared to be severable. If any portion of this ordinance is
declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force
and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial
invalidity.
Section 3. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed.
Ordinance No. 3613 was passed by the Council and approved by the Mayor on the 51h day of May, 2025.

Mayor and City Council approved the foregoing summary on the 5th day of May 2025 for publication on the
13th day of May 2025, pursuant to Idaho Code § 50-901A.
