HomeMy WebLinkAboutORD 3649U r r '9�atOr and Canyon County Recorder's Office Document Cover Sheet 3025-015486 RECORDED 11111111111111111111111111111111111111111111 RICK HOGABOAM CANYON COUNTY RECORDER Pgs=4 MBROWN NC FEE ORDINANCE CITY OF CALDWELL BILL NO. 88 ORDINANCE NO. 3649 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED FROM M-1 (LIGHT INDUSTRIAL) ZONE TO THE A-D (AIRPORT DISTRICT) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission and following the public notice and hearing procedures as required in Section 10-03-12, Caldwell Municipal Code, approved Case No. ZON24-000005 (Airport Rezone) at a public hearing held this 5'h day of May, 2025. Section 2. The parcel(s) are within the City of Caldwell, Idaho and the applicant has requested that said following described property(s) should be rezoned as follows: A parcel of land situated in the NE %of Section 36, T4N, R3W, BM, Canyon County, Idaho, more particularly described as follows: COMMENCING at the NE corner of said Section 36; thence S00028'57"W, 1182.99 feet coincident with the east line of the NE % of said Section 36 and the POINT OF BEGINNING; thence continuing S00°28'57"W, 886.76 feet coincident with said east line; thence N44°16'26"W, 1823.96 feet; thence N44016'13"W, 1047.63 feet to a point on the north line of said NE %; thence N89°36'59"E, 866.30 feet coincident with said north line; thence S44°16'13"E, 447.24 feet; thence S44016'28"E, 1194.07 feet to the POINT OF BEGINNING. Contains 32.34 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above -described property(s) on the official zoning map and other area maps of the City of Caldwell, Idaho as A-D (AIRPORT DISTRICT) Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
