HomeMy WebLinkAbout2025-02-11 MinutesDate 2 t -L-S HEARING EXAMINER MEETING MINUTES Tuesday, February 11, 2025 (a;, 1:31 pm Caldwell City Council Chambers Room, 205 S. 61h Avenue, Caldwell, Idaho CALL TO ORDER— Hearing Examiner, Ms. Sabrina Durtschi opened the meeting for the public hearing at 1:31 p.m. REVIEW OF PROCEEDINGS (OPENING STATEMENT) — Ms. Sabrina Durtschi outlined the procedures for the public hearing. MEMBERS PRESENT: Angelica Gomez (Administrative Assistant); Katie Wright (Planner II); Hallie Hart (City Engineer) CONSENT CALENDAR: The Hearing Examiner approved the January 28, 2025, Hearing Examiner Meeting Minutes as drafted. OLD BUSINESS: ACTION ITEM: Public Hearing Quasi -Judicial: Case Number: PUD24-000006, SPP24-000003, DEV24-000004: The applicant, Becky Yzaguirre, on behalf of Chad and Melinda McDaniel, is requesting a development agreement modification to the original Aspen Falls Development agreement, whose entitlements have since expired, to facilitate the development of Mirandesa Planned Unit Development, a mixed use subdivision with single family residential and commercial uses, with an overall density of 3.42 units per acre. The proposed site is addressed as 1109 W. Ustick Rd. (R3259401000) and 0 Ustick Rd. (R3259400000) and is located on the southeast corner of Farmway Rd and Ustick Rd in Caldwell, Idaho. This item was continued from January 28th, 2025. Katie Wright (Planner II) 205 S. 6th Avenue, provided the staff report by outlining its contents by use of a PowerPoint presentation. In response to the Hearing Examiner's questions, Ms. Wright stated: • A time extension for Aspen Falls was denied in 2009 was because the Council no longer felt it fit the area any longer and the entitlements expired. • The draft Comprehensive Plan shows this area as community center and neighborhood 2. • Staff does not know when the roundabout at Ustick and Farmway will be improved. John Carpenter (representative) 332 N Broadmore, Nampa, signed in favor of the application and quickly stated that the timeline for the roundabout is 2026. He then provided a description of the application. Justin Pitcher (representative) 332 N Broadmore, Nampa, signed in favor of the application, and stated: • The site will have 11 new interior roadways. • Ustick will be widened per Caldwell's requirements. • There will be a 10 ft. detached sidewalk along Ustick. • Potable water connections will come from Ustick and Farmway. In response to the Hearing Examiner's questions, Mr. Carpenter stated: Neighborhood meeting held at brothers park in the winter. Commercial components will be sold separately. The 35 ft. height exception will be the new max heights in the new code. The pioneer irrigation easement is all piped. Fencing is being put right up against the easement because they cannot put fence within the easement. Hallie Hart (City Engineer) 205 S. 6th Avenue, in response to the Hearing Examiner's questions stated: • Ustick roundabout will be coming in 2026. • Farmway is currently under construction for improvements. • Portions of Ustick Rd. are included in the CIP so impact fees will be able to go towards Ustick as you get closer into the downtown area. • Impact fees will be charged at building permit. No one from the public signed up to speak. There was no rebuttal. Ms. Durtschi closed the public hearing testimony at 2:08 pm. FINDINGS OF FACT AND CONCLUSSIONS OF LAW FOR Case Numbers PUD24-000006, SPP24- 000003, DEV24-000004: The Caldwell Hearing Examiner accepts the Findings of Fact and Conclusions of Law outlined in the staff report, public testimony, and the evidence list. All adopted ordinances, standards and codes were used in evaluating the application. The proposed use was conditionally permitted by the terms of the ordinance and such conditions of approval. ORDER OF DECISION FOR CASE NUMBERS PUD24-000006, SPP24-000003, DEV24-000004: Based on the Findings of Fact and Conclusions of Law, the Caldwell Hearing Examiner hereby orders that Case Numbers PUD24-000006 & SPP24-000003 for Mirandesa Subdivision is recommended for approval, subject to the conditions of approval listed in the staff report.
