HomeMy WebLinkAboutOrd 3586_Soterra2 (2)BILL NO. 24 ORDINANCE NO. 3586 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED FROM C-2 (COMMUNITY COMMERCIAL) TO THE R-2 (MEDIUM DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Planning and Zoning Commission
and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON24-000002 (Soterra #2) at a public hearing held this 2nd day of December,
2024. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned as follows:
Parcel R3258300000 from C-2 (Community Commercial) to R-2 (Medium Density Residential); and
Parcel(s) are more particularly shown on Exhibit A, and described as follows:
COMMENCING at the NW corner of said Government Lot 2 (N ¼ Corner) of said Section 4; thence
S89°40'48"E, 1332.30 feet along the north boundary of said Government Lot 2 to the NE corner of said Government Lot 2; thence S00°15'20"W, 358.00 feet along the east boundary of said Government Lot 2 to
the POINT OF BEGINNING; thence continuing S00°15'20"W, 301.83 feet; thence N89°44'42"W, 1162.79 feet; thence S88°34'11"W, 53.17 feet to the centerline of the Phyllis Canal; thence along said centerline the
following courses: N15°53'49"W, 45.22 feet; thence N16°13'54"W, 20.18 feet; thence N02°44'53"E, 47.51 feet to the beginning of a tangent curve; thence Northerly along said curve to the right having a radius of
211.26 feet, an arc length of 186.77 feet, a central angle of 50°39'17", and a long chord bearing N28°04'32"E, 180.75 feet; thence tangent from said curve, N53°24'04"E, 158.58 feet; thence leaving said
centerline, S36°31'08"E, 13.32 feet; thence S89°43'52"E, 455.22 feet to the beginning of a tangent curve; thence Easterly along said curve to the right having a radius of 120.00 feet, an arc length of 65.94 feet, a
central angle of 31°28'55", and a long chord bearing S73°59'25"E, 65.11 feet to a reverse curve; thence Easterly along said curve to the left having a radius of 80.00 feet, an arc length of 43.76 feet, a central
angle of 31°20'21", and a long chord bearing S73°55'08"E, 43.21 feet; thence tangent from said curve, S89°35'18"E, 63.86 feet; thence S59°59'19"E, 42.39 feet; thence S89°41'05"E, 352.83 feet to the POINT OF BEGINNING. Contains 9.09 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-2 (Medium Density Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
