Good morning Matt, I apologize for the recent complications that have hindered the approval of phase eight of the Peregrine Estate project. Please be assured that Planning and Zoning has no intention of complicating your timeline; we are committed to resolving this matter as swiftly as possible. We also do not wish to impose any requirements beyond what was previously agreed upon. In that spirit, we understand your position regarding adherence to code ordinances that took effect after Peregrine's approval. We have reviewed the Peregrine Estates Development Agreement (ANN-132-06 & SUB-156P-06) to determine the applicable landscape ordinance. Under Article II, Section 21 of the Development Agreement, it is stated that the development shall adhere to the City's Landscaping Ordinance No. 2428. For your convenience, I have attached a copy of the Development Agreement, as well as a copy of Landscaping Ordinance No. 2428. As you correctly pointed out, this ordinance differs from the one currently observed. It requires a minimum of 5% of the total project acreage to be dedicated to open space. You will also find a more straightforward definition of open space criteria in Section 10-07-05. I hope this information clarifies the requirements and simplifies the process for you and your team. Hello Matt, Thank you for providing the updated open space exhibit for Phase 8. However, I would like to bring a couple of points to your attention. According to the city's code, any lots or portions of lots used for drainage purposes cannot be counted towards the qualified open space requirement. Consequently, Lot 7 of Block 21, Lot 8 of Block 29, Lot 8 of Block 31, most of Lot 1 of Block 28, and most of Lot 1 of Block 30 will not be considered qualified open space. Section 5, Chapter 7, Article 10 of the city's code outlines the criteria for both non-qualified and qualified open space. Hi Matt, We actually did require open space in 2007, a minimum of 5% was required. The order of decision for Peregrine states that the applicant is proposing more than the minimum required at 9.3%. We are just asking that you prove to us that you are meetings what your application promised, which is that you would provide 9.3% useable open space across the project and we can not do that without more information from you on what open space has already been completed. This project was granted an extension in 2016 per this attached letter. The letter allows for a Time Extension of a preliminary Plat that was approved in 2007. The open space code was not adopted until 2008. With the Open Space requirement being adopted after approval of this subdivisions approved pre-plat, the exhibits we submitted for open space are not helpful, even though we did try to submit.
