HomeMy WebLinkAbout2024-10-22 MinutesAPPROVED Date 2L, - HEARING EXAMINER REGULAR MEETING MINUTES Tuesday, October 22, 2024 @ 1:30 pm Caldwell City Council Chambers Room, 205 S. 61h Avenue, Caldwell, Idaho CALL TO ORDER Hearing Examiner, Ms. Sabrina Durtschi opened the meeting for the public hearing at 1:30 p.m. REVIEW OF PROCEEDINGS (OPENING STATEMENT) — Ms. Sabrina Durtschi outlined the procedures for the public hearing. MEMBERS PRESENT: Sarah Davis (Planning Tech.); Joe Dodson (Planner Ill) CONSENT CALENDAR: The Hearing Examiner approved the September 24, 2024, Hearing Examiner Meeting Minutes as drafted. OLD BUSINESS: None NEW BUSINESS: 1. ACTION ITEM. Public Hearing Quasi -Judicial: Case Number: SUP24-000018: The applicant, Angela Hansen of Cushing Terrell, on behalf of Caldwell Housing Authority, is requesting a special use permit for multi -family land use within the T-N (Traditional Neighborhood) zone. The project is an adaptive reuse of a historic single-family dwelling into a mixed -use project consisting of retail/restaurant commercial space on the 1st floor with one (1) apartment unit on the 1st floor, two (2) apartment units on the 2nd floor, and two (2) apartment units on the basement level. Apartments are one and two -bedroom units ranging between 500-900 square feet. The proposed site is addressed as 321 N Kimball Avenue (110482200000) and is located on the corner of N Kimball Avenue and E Chicago Street, in Caldwell, Idaho. Joe Dodson (Planner Ill) 205 S. 6th Avenue, provided the staff report by outlining its contents by use of a PowerPoint presentation. In response to the Hearing Examiner's questions, Mr. Dodson agreed that typically alleyway improvements must be done. He stated that he believes that there is going to be a general shift of policy because they are seeing more individual sites being improved in this neighborhood. Engineering is just trying to work with applicants to get improvements as well as reuse the appropriate sites. He also agreed that the applicants will be improving the alley that abuts the property. In response to the Hearing Examiner's questions, Mr. Dodson stated that the applicants would need to apply for an administrative determination for parking for the commercial part of the project. Angela Hansen (Applicant) 702 W Main St., signed in favor of the application and provided a description of the application. In response to the Hearing Examiner's questions, Ms. Hansen stated: • A neighborhood meeting was held at Cushing Terrel's office in downtown Caldwell. • A few community members attended and there was no real concern about the project. • They were more curious about the timeline and schedule of moving the house to the property. • There will be signage dedicating parking for the tenants only. • For the commercial, the intent is for neighborhood scale commercial that will primarily attract pedestrian traffic. They are hoping to have leniency on street parking for the project when they are ready to apply for commercial uses. In response to the Hearing Examiner's questions, Mr. Dodson stated: Depending on the use that would go into the commercial part, if it's permitted, they would not need a public hearing. They would need to submit for a business license which goes through planning and zoning. The Public Hearing was opened: • Mike Dittenber, 2273 Farmway Rd., in favor, stated he can answer a question regarding the alley. Engineering thought it would be best to not touch anything past the site's property line due to there being a lot of utilities in the area. They are having conversations about drainage. Angela Hansen (Applicant), in the rebuttal went into more detail about the drainage on site. Ms. Durtschi closed the public hearing testimony at 1:52 pm. FINDINGS OF FACT AND CONCLUSSIONS OF LAW FOR Case Numbers SUP24-000018: The Caldwell Hearing Examiner accepts the Findings of Fact and Conclusions of Law outlined in the staff report, public testimony, and the evidence list. All adopted ordinances, standards and codes were used in evaluating the application. The proposed use was conditionally permitted by the terms of the ordinance and such conditions of approval. ORDER OF DECISION FOR CASE NUMBERS SUP24-000018: Based on the Findings of Fact and Conclusions of Law, the Caldwell Hearing Examiner hereby orders that Case Numbers SUP24-000018 for The Rice House Is approved, subject to the conditions of approval listed in the staff report with the following addition: Modifications to the draft Conditions of Approval: 1. Add Condition: Prior to receiving a certificate of occupancy on any non-residential use in the proposed commercial space of the structure, the Applicant shall submit an Administrative Dctermination application to the Planning Division to determine the required off' street parking requirements for said nonresidential use.
