HomeMy WebLinkAboutDANarrative_EmerySky_V1 Page 1 | 1 August 7, 2024 Ms. Katie Wright Caldwell Planning & Zoning Dept. 621 Cleveland Blvd Caldwell, ID 83605 sent via email RE: Emery Sky Planned Unit Development – DA Modification (Termination of Outdated DA) for Chestnut Heights Subdivision (fka Ponderosa Subdivision) Dear Ms. Wright, On behalf of our client, please accept our application for a Development Agreement Modification/Termination for the Ponderosa Subdivision (SUB-105P-04 and ANN-90-04) for which a portion of the property (Parcel No. R3273101100) of our Emery Sky Planned Unit Development is a part of. Additionally, since the time that the Ponderosa Subdivision was approved in 2005 by the Caldwell City Council, portions of the property have been subsequently included in the Chestnut Heights Subdivision, thus leaving the existing development agreement outdated and obsolete. This letter and accompanying application are being submitted at this time per your notification that a development agreement was in place for a portion of our new project (Emery Sky) and that for procedure’s sake it makes the most sense to formally terminate the old agreement. We agree that this is the best way clarify the record and eliminate any confusion as to what will be required for the portion of our Emery Sky project site that is already annexed into the City of Caldwell. We would also like to note that since the time of annexation, the parcel involved in the Emery Sky PUD application has remained as farm ground and that upon review of the existing Development Agreement, we don’t see any conditions in the agreement that are not already standard conditions contemplated by Caldwell City Code or anything extra-ordinary that we would not expect to see as conditions as part of our new project.
