DEVELOPMENT AGREEMENT
Arrowrock Farm
This Development Agreement is made and entered into this'Z.fa of April 2023, by and
between the CITY OF CALDWELL, an Idaho municipal corporation of 411 Blaine Street, Caldwell,
Idaho 83605 ("City" or "Caldwell"}, and Endurance Holdings LLC., 1977 East Overland Road, Meridian,
ID 83642 ("Owner" and/or "Developer").
WHEREAS, Owner is the owner ofrecord ofcertain real property (the "Subject Properties")
located in the City ofCaldwell, more particularly described as follows:
See Exhibit "A", legal descriptions, attached hereto and
incorporated herein by this reference.
WHEREAS, the Subject Properties are the subject of an Application for Annexation,
Comprehensive Plan Map Amendment, Special Use Permit, and Subdivision submitted by
Owner/Developer, identified as Application Numbers ANN21-OO00i4/CPM21-OOO002/SUP21-
000015/SUB21-000041: and
WHEREAS, the Subject Properties are currently designated as Highway Corridor on the City
of Caldwell 2040 Comprehensive Plan Map; and
WHEREAS, the Owner/Developer seeks to amend approximately 10.99 acres on the 2040
Comprehensive Plan Map from Highway Corridor to Medium Density Residential.
WHEREAS, the Owner/Developer seeks to zone 10.99 acres ofthe subject properties as R-2
Medium Density Residential) and 26.94 acres as H-C (Highway Corridor); and
WHEREAS, it is the intent of this Development Agreement to protect the rights of
Owner's/Developer's use and enjoyment ofthe Property, while at the same time limiting any adverse
impacts resulting from the zoning ofthis property upon neighboring properties and the community,
and ensuring that any future development of the property is in a manner consistent with Caldwell's
Comprehensive Plan and City Code; and
WHEREAS, Caldwell and Owner/Developer desire to set forth herein limitations and/or
conditions upon the use and future development of the Property; _ ^
