ORDINANCE NO. 3629
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-1 (LOW DENSITY
RESIDENTIAL) ZONE; DECLARING SAID LANDS BY PROPER LEGAL DESCRIPTION AS
DESCRIBED BELOW TO BE A PART OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO;
DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO ADD SAID
PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL
ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH; AND
DIRECTING THE CLERK OF THE CITY OF CALDWELL TO FILE A CERTIFIED COPY OF THE
ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH CANYON COUNTY, STATE OF IDAHO
AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO IDAHO CODE, SECTION 63-215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO.-
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning
Ordinance No. 1451, approved Case No. ANN24-000013 (Element Ridge Annexation) at a public hearing
held this 18th day of February, 2025.
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-1 (Low Density
Residential):
A parcel of land located in the N '/ SE % of Section 9, T3N, R3W, BM, City of Caldwell, Canyon County,
Idaho, more particularly described as follows:
COMMENCING at the E % corner of said Section 9; thence S00°42'58"W, 337.51 feet along the east
boundary of said N'/ SE % to POINT OF BEGINNING; thence continuing S00042'58"W, 986.59 feet to the
SE comer of said N'/2 SE % (S 1/16 corner); thence S89°39'22"W, 382.32 feet along the south boundary
of said N '/2 SE %; thence N68°06'25"W, 244.52 feet; thence N51`08'28"W, 266.27 feet; thence
N64037'28"W, 201.80 feet; thence S89'39'22"W, 57.00 feet; thence S00°20'38"E, 348.41 feet to said south
boundary; thence S89°39'22"W, 428.47 feet along said boundary; thence N00021'38"W, 140.00 feet;
thence S89°39'22"W, 180.00 feet; thence S00°21'38"E, 140.00 feet to said south boundary; thence
S89039'22"W, 992.51 feet along said boundary to the SW corner of said N'/2 SE'/. (CS 1116 corner); thence
N00°29'23"E, 1326.12 feet along the west boundary of said N'/ SE % to the NW corner of said N'/2 SE %
(C % corner); thence N89°42'06"E, 2167.72 feet along the north boundary of said N % SE %to the centerline
of the Forrest Lateral; thence along said centerline the following courses: S37'02'03"E, 207.88 feet; thence
S11 020'45"E, 97.95 feet to the eastern bank of said Forrest Lateral; thence S19°20'02"W, 80.06 feet along
said eastern bank; thence N89°35'46"E, 370.07 feet to the POINT OF BEGINNING. Contains 74.41 acres,
more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-1 (Low Density Residential),
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section S. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of
the State of Idaho, all in compliance with Idaho Code 63-215.

Section 1. This ordinance shall be in full force and effect from and after its passage, approval, and
publication, according to law.
Section 2. This ordinance is hereby declared to be severable. If any portion of this ordinance is
declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force
and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial
invalidity.
Section 3. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed.
