AN ORDINANCE ENACTED BY THE CALDWELL CITY COUNCIL AMENDING CHAPTER 2,
OF THE CALDWELL CITY CODE, PERTAINING TO GOVERNING BODIES AND ADVISORY
BOARDS; BYADDING A NEW ARTICLE, ARTICLE 38, PERTAINING TO THE CREATION OF
A DOWNTOWN PARKING ADVISORY BOARD; PROVIDING FOR AN EFFECTIVE DATE;
PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDERS AND PARTS THEREOF, IN CONFLICT HEREWITH.
BE IT ORDAINED by the Mayor and Council of the City of Caldwell, County of Canyon, State
of Idaho:
Section 1. That Chapter 2, of the Caldwell City Code is hereby AMENDED by
ADDING a new Article, Article 38 AS FOLLOWS:

02-38-01: COMMISSION CREATED:
(1) Creation: There is hereby created and established a downtown parking advisory
board which shall consist of not less than three (3) and no more than seven (7) voting
board members.
(2) Expiration: The advisory board shall be active and perform the duties as specified in
this article for a period of two (2) years from the effective date of this ordinance. The
board will sunset on February 18, 2027, unless reestablished or extended by formal action
of the City Council.
(3) Voting Members: All voting members shall be appointed by the mayor and
confirmed by a majority vote of the city council. Appointed members of the board shall
meet at least one of the following criteria:
A. A citizen of Caldwell with their main residence located within Caldwell city
limits;
B. Be the owner of real property located within the Caldwell Downtown Business
District; or
C. Be the owner of an active business within the Caldwell Downtown Business
District. An owner of property shall mean the title holder, purchaser under a
contract for deed, lessee.
(4) Non -Voting Members: In addition, the mayor shall assign a city council member to
sit on the Board as a non -voting council liaison. The City of Caldwell's Community
Development Director, or their designee, shall serve in a non -voting capacity as a
Facilitator at board meetings. The facilitator is responsible for assisting the Chairperson in
the process of the meeting(s).
(5) Members: Initial Term: All board members shall be appointed for an initial two (2)
year term. After two (2) years, if the City Council votes for the advisory board to continue
and remain active in its duties, existing board member terms may be extended, or new
board members may be appointed.
(6) Compensation: The members of the board shall serve without compensation.
(7) Vacancies: Vacancies occurring otherwise than through the expiration of terms shall
be filled in the same manner as the original appointment.
02-38-02: DUTIES AND RESPONSIBILITIES OF THE BOARD:
The Downtown Parking Advisory Board will advise and make policy recommendations to
City staff and City Council on all aspects of public parking within the Caldwell Downtown
Districts. The purpose.of the board is to provide citizen and property owner input into the
policy decisions for the City related to all aspects of public parking, including but not
limited to on -street parking, parking lots, and parking fees.

02-38-03: MEETINGS:
(1) Regular Meetings: Regular meetings shall be scheduled no less than once a quarter.
Regular meetings shall at all times be open to the public.
(2) Special Meetings: Special meetings may be called by the Chairperson, city staff, or at
the request of the mayor upon a minimum of five (5) calendar days written notice to all
members of the Board.
(3) Record: The facilitator, in conjunction with the Chairperson, shall keep a record of
its attendance, proceedings and actions, and prepare the agenda for each meeting.
Complete minutes shall be kept by the Facilitator of the board, or their designee.
(4) Quorum Present: In case there shall be no quorum present on the day fixed for a
regular or special meeting, the commission members present may adjourn to a specified
date and time until a quorum is obtained.
(8) Attendance: Board members are expected to attend as many meetings as possible.
Missing multiple meetings throughout the calendar year or missing two (2) or more
consecutive meetings without prior consent from the Chairperson shall be grounds for
being removed from the Board by the City Council.
(9) Removal: Removal of any board member(s) shall take place as stated in Caldwell
City Code Chapter 2 Article 6.
(10) Election of Officers: The Board shall elect its own chair and vice chair. Election of
officers shall take place annually during the first meeting of the calendar year. During the
absence of the chair, the vice chair shall assume the duties of the chair.
(11) Chairperson: The Chairperson shall preside over and direct all meetings of the
board. The chairperson shall be responsible for ensuring that all meetings are conducted in
an orderly and effective manner.
(12) Vice -Chairperson: In the absence of the Chairperson, the Vice -Chairperson shall
assume the duties of the Chairperson.
Section 2. This ordinance shall be in full force and effect from and after its
passage, approval, and publication, according to law.
Section 3. This ordinance is hereby declared to be severable. If any portion of this
ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions
shall continue in full force and effect and shall be ready to carry out the purposes of the
ordinance before the declaration of partial invalidity.
Section 4. All ordinances, resolutions, orders, and parts thereof in conflict
herewith are repealed.

SECTION l: AMENDS CHAPTER 2, OF THE CALDWELL CITY CODE, BY ADDING A NEW
ARTICLE, ARTICLE 38, PERTAINING TO A DOWNTOWN PARKING ADVISORY BOARD;
SECTIONS 2 THROUGH 4: PROVIDES THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL, AND PUBLICATION, ACCORDING TO
LAW; PROVIDES FOR SEVERABILITY; REPEALS CONFLICTING ORDINANCES,
RESOLUTIONS, AND ORDERS.
Ordinance No. 3657 was passed by the Council and approved by the Mayor on the 18' day of February y
2025. The full text of the Ordinance is available at Caldwell City Hall, 205 S. 61 Avenue, Caldwell, Idaho
83605. The Mayor and City Council approved the foregoing summary on the 18' day of February2025, for
publication on the 25' day of February 2025, pursuant to Idaho Code § 50-901 A.
