CONSENT TO ERECTION OF. ADDITION TO HAN-GAR.
(Airport Agreement.)
WHEREAS, The City of Caldwell by written agreement dated
July 1, 1940, granted to one Mack S. Johnstone the right to the
use of the municipal airport of the City of Caldwell, for the
purposes and under the conditions and for the time therein ex-
pressed; and,
WHEREAS, thereafter the time for the use of said property
by the said Mack S. Johnstone was, by written agreement duly
executed by the City and the saiC. Mack S. Johnstone, extended to
the 1st day of July, 1945; and,
WHEREAS, the said Mack S. Johnstone, by written agreement
dated the 13th of October, 1941, assigned his interest in said
agreement and his -i,hts therein acquired to Jack W. Medlin and
John Medlin; and,
WHEREAS, the City of Caldwell, by resolution of its City
Council duly passed and approved on January 19, 1942, authorized
its Mayor and City Clerk to consent to the transfer of said
agreement and the rights therein acquired by the said Mack S.
Johnstone, to the said Jack W. Medlin and John Medlin; and,

WHEREAS, the said Mayor and City Clerk, pursuant to said
Resolution, did, on or about theZ,2day of
in writing, execute such consent to the assignment, and transfer
of said agreement; 'and,
VT9EREAS2 the said Jack W. Medlin and John Medlin now
desire to construct an addition to the hangar on said airport,
and which said addition is to be used as a workshop and is to
be approximately forty fee by twenty-five feet, to be made of
lumber with:a concrete floor; and,
WHEREAS, the.said Jack W. Medlin and John Medlin desire
to pay all expenses in connection with said addition, and the
construction thereof, and to retain title thereto, and desire
the right of removal thereof at the termination of said airport
agreement by -and between--said-City-and the said -Mack S. John,
stone; and,
WHEREAS, said City, on its behalf, desires to consent to
the erection of said addition to said hangar, and to authorize
the removal of said addition by the said Jack W. Medlin and John
Medlin at the termination of said lease,
NOW, THEREFORE, The City of Caldwell, Idaho, a municipal
corporation, pursuant to resolutions ofits Mayor and Council,

duly adopted and approved on the day of
�1942, hereby gives -the -consent of the said City to the erection
of an addition to the hangar on the City airport property, said

addition to be erected by the said Jack W. Medlin and John Medlin,
it being understood and agreed that the erection of said addition
shall be wholly at the expense of the said Jack W. Medlin and
John Medlin, and that said addition shall remain their property,
and is subject to removal by them at the termination of said air-
port agreement between the City and the said Iriack S. Johnstone,
dated July 1, 1940, and the extension thereof, heretofore
referred to;
IT BEING FURTHER UNDERSTOOD AND AGREED, however, that at
the termination of said agreement between the said Mack S. John-
stone, and the said Jack W. Medlin and John Medlin, they are to
restore said hangar in the same condition as it now is.
