Dear Mr. Leighton and Mr. Byrd,
Regarding the annexation, planned unit development and subdivision approvals identified above
(the “Approvals”) and the related Development Agreement for The Charles recorded in real
property records of Canyon County, Idaho as Instrument 2022-048429 (the “Development
Agreement”):
We have reviewed the final plat submittal for the single family portion of The Charles at Karcher
Subdivision, a copy of which is attached to this letter. We find the final plat to be consistent in all
material respects with the original preliminary plat that was approved by the Caldwell City
Council pursuant to the Approvals. Because the final plat is substantially similar to the original
preliminary plat in all material respects, the final plat does not require approval of a plat
amendment application by the Caldwell City Council, and the revised site layout is recognized as
the approved preliminary plat for all purposes related with respect to the Approvals, the
Development Agreement and Caldwell Zoning Ordinance.
This letter notifies you of the City of Caldwell’s recognition of the revised layout as the approved
preliminary plat for all such purposes, however, the revisions shall be incorporated into a revised
preliminary plat for the entire development to be submitted prior to approval of the final plat.
We have also reviewed the revised layout for compliance with the requirements of the
Approvals, Development Agreement and Caldwell Zoning Ordinance, and find that what has been
submitted complies with the same in all material respects. A landscape review will still be
required during final plat review.
The final plat application for The Charles at Karcher Subdivision No. 1, which is comprised of the single family
portion of the development, may proceed directly to the final plat application review stage with the submittal of
the revised preliminary plat of the entire Charles Development. Issuance of building permits and certificates of
occupancy for Phase 1 may be issued upon recordation of the final plat and does not depend on any other phase
being submitted or completed.
