BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning Ordinance No. 1451, approved Case No. ANN24-000002 (Emery Sky Annexation) at a public hearing held this 2nd day of December, 2024 Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that said following described property should be annexed into the City of Caldwell as R-2 (Medium Density Residential): A portion of the SE '/4 NE '/4 of Section 11, T3N, R3W, BM, Canyon County, Idaho more particularly described as follows: BEGINNING at the 114 corner common to said Sections 11 and 12, T3N, R3W, BM, from which the North 1116 corner common to said Section 11 and 12 bears N00039'35"E, 1324.27 feet; thence S89°42'21 "W, 629.49 feet on the south boundary line of the SE'/, NE'/. of said Section 11 to the centerline of Lateral No. 25.1; thence on said centerline the following six (6) courses and distances: N00031'07"E, 956.76 feet; thence N07024'25"E, 30.61 feet; thence N16°01'41"E, 144.81 feet; thence 127.32 feet on the arc of a curve to the left having a radius of 190.00 feet, a central angle of 38023'43", and a long chord which bears NO3°1011 "W, 124.95 feet; thence N22022'02"W, 49.02 feet; thence N15052'26"W, 29.04 feet to the north boundary line of said SE'/+ NE'/, of Section 11; thence N89°42'47"E, 417.47 feet on said north boundary line; thence S00056'20"E, 579.51 feet; thence N89°47'12"E, 192.01 feet to the east boundary line of said SE'/, NE'/ of Section 11; thence S00039'35"W, 744.47 feet on said east boundary line to the POINT OF BEGINNING. Containing 16.284 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R-2 (Medium Density Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law. Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman -like manner plainly and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the following officials of the County of Canyon, State of Idaho, to -wit: the Recorder, Auditor, Treasurer and Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of the State of Idaho, all in compliance with Idaho Code 63-215. This ordinance is hereby declared to be severable. If any portion of this ordinance is declared invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect and shall be read to carry out the purposes of the ordinance before the declaration of partial invalidity. Section 3. All ordinances, resolutions, orders and parts thereof in conflict herewith are repealed. Ordinance No. 3583 was passed by the Council and approved by the Mayor on the 2"d day of December, 2024.
