Chair Zamora called the meeting to order at: 6:04pm.

REVIEW OF PROCEEDINGS (OPENING STATEMENT)
Chair Zamora opened the public hearing and outlined the public hearing procedures.
Chair Zamora proceeded to public hearing items on the agenda.

NEW BUSINESS
ACTION ITEM: Public Hearing (Quasi-Judicial) Case Number ANN24-000002, PUD24-
000001, SUB24-000006: Trilogy Development, on behalf of Endurance Holdings LLC, is
requesting annexation of parcel R3273101000 with a zoning of R-2, Medium Density
Residential, a Development Agreement Modification to terminate DA-05-10 for Ponderosa
Subdivision, and preliminary plat and planned unit development approvals for Parcels
R3273101000 and R3273101100 for Emery Sky Subdivision Planned Unit Development, a
mixed-use project with both single family detached and attached units, seven duplex lots, two
multi-family lots, and one commercial lot. Parcel R3273101100 will remain with the R-1 (Low
Density Residential) zone. The approximately 38-acre site is located on the northwest corner
of Lake Ave. and Moss St. approximately 0.4 miles south of Homedale Rd., in Caldwell, Idaho.

City Associate Planner, Katie Wright, Planner, 205 S. 6th Ave., Caldwell, Idaho, requested this
project be continued to the November 13, 2024, hearing.

Boutros felt this project was worth hearing and discussing.

Zamora asked for a roll call vote to continue to November 13, 2024. The vote was split.
MOTION DENIED
Staff Presentation:
City Associate Planner, Katie Wright, Planner, 205 S. 6th Ave., Caldwell, Idaho presented the staff
report, outlining its contents by use of a PowerPoint presentation.
• Project heard again after a split vote at the September 25, 2024, hearing.
• Reduction of four lots.
• Daycare can not be used for residential
Applicant Presentation:
Applicant, Bonnie Layton, NV5, 690 S. Industry Way, Meridian ID 83642, presented the applications
requests and discussed:
• The Charles is nearby with 33 acres of commercial.
• Modifications made included
• Cottage lots required a 3-foot setback instead of five.
• Lots were widened instead.
• Loss of four lots
• Open space stayed same.
• Density went down.
• 2 ½ acres of open, recreational space
• Pathways
• Elevations
Commission Questions for Staff and Applicant:
• Comprehensive plan: agricultural is not included.
• Traffic
• Required amenities
• Zoning for daycare and permitted uses
• Lot sizes
• Daycare or other use of that space
Public Testimony:
Craig Allison, spoke in opposition of this proposal. He spoke of the following concerns:

Commissioner Response:
Request from commissioners to have Public Works Director speak on these matters.
Robb MacDonald, Public Works Director, 205 2nd St. S. Caldwell, Idaho addressed Mr. Allison’s
concerns.
• Lake and the Blvd. has a traffic light planned
• Intersections on Homedale are deficient and have had a consultant review that street to make
it safer.
• Improvements are paid for by development.
• New roads will have bike lanes.
• City is planning to adopt traffic impact fees to be paid for by new development.
Applicant Rebuttal:
Bonnie Layton spoke in rebuttal thanking Commissioners for their time.

development approvals for parcels R3273101000 and R3273101100 for the Emery Sky PUD
