The planning and zoning department notifies all political subdivisions providing

impacted by any changes that have been proposed from what was originally approved
on the preliminary plat.
Review of the final plat submitted determined there were no modifications proposed
that would necessitate additional public agency notifications.

The preliminary plat approval for Peregrine Estates (SUB-156P-06) was signed by the
City Council on 5/21/2007 The Final Plat for Phase 6 was approved on 10/7/24.
This phase consists of 15.97 acres and includes 29 single-family residential lots

Staff Comment: Construction drawings and the proposed final plat have been reviewed for conformance with city codes and with the approved preliminary plat. The planning and zoning Department, in consultation with the
engineering department, have determined the final plat is compliant with city code, as well as with the approved preliminary plat. 11. CITY COUNCIL DECISION: Regarding the request for a final plat approval for Peregrine Estates 7 subdivision consisting of 29 residential lots and 2 common lots on 15.97 acres in the R-1 (Low Density Residential) zone on Parcels R32818011D2, located in the 13-3N-3W NW TX 05907 IN NWSW LS TX 06501, 06502, 17497, 18457, 22578 & LS RD & R-O-W, the
subject application was placed on the 10/29/2024 City Council consent agenda for consideration. Based upon the information received and the record of evidence presented, the City Council voted to APPROVE
the request for final plat approval, subject to the conditions herein. In approving the requests, the City Council concluded the following:
1. The final plat is compliant with city code; and
2. The final plat is in compliance with the approved preliminary plat.
II. CONCLUSIONS OF LAW
1. The City of Caldwell has provided for the processing of Land Use permits authorized by Chapter 65, Title 67,
Idaho Code, pursuant to Chapter 10 Zoning Regulations and Chapter 11 Subdivision Regulations.
2. The record includes, but is not limited to all files, application documents, public notices, public comments and
testimony, staff reports and memos, presented evidence and exhibits, public hearing written minutes and audio, and
the signed Findings of Facts, Conclusions of Law, and Decision.
3. The City Council is authorized to approve, approve with conditions, approve with modifications, or deny final
plats in accordance with Section 11-02-03 (2) D of Caldwell City Code.
4. The City Council reviewed and considered all records, evidence, testimony, facts presented, applicable code
standards, and approval criteria as specified within Caldwell City Code in making their decision.
III. CONDITIONS OF APPROVAL
NOTE: Any conditions removed by the governing body will be shown in a strikethrough. Any conditions added by the governing body will be shown as underlined.
The approval of the application requests for (SFP24-000009), are subject to the adherence of the following conditions:
A. General Requirements:
1. Development of the subject property shall be in conformance with all municipal codes, policies, standards, and
regulations of the City of Caldwell, unless specifically stated otherwise in a Development Agreement or in the

Order of Decision. NOTE: Failure to identify a code violation during the review of the plans DOES NOT
give the applicant the right or permission to violate any codes, policies, standards and/or regulations.
2. If any term or provision of this decision, to any extent, is held invalid or unenforceable, the remaining terms
and provisions hereof shall not be affected thereby, but each such remaining term and provision shall be valid
and enforced to the fullest extent permitted by law.
3. Any nuisances existing on the property (weeds, trash, debris, etc) shall be resolved and in compliance with city
codes prior to the approval of any construction drawings and/or issuance of building permits.
4. Any changes to the plans and specifications upon which this approval is based, other than those required by the
above conditions, will require submittal of an application for modification and approval of that application prior
to commencing any change.
5. All improvements and operations shall comply with applicable local, state and federal requirements and
procedures whether specifically addressed in the analysis of this application or not.
6. Fencing: Fencing must comply with Caldwell City Code Section 10-02-07.
7. Approval: This approval is for the application(s) specified herein only. Additional permits, licenses and
approvals may be necessary.
8. Solid Waste Disposal: All solid waste receptacles utilized during development and/or construction shall be
provided by the same company with which the City of Caldwell has an exclusive contract.
9. Business Licensing: All businesses operating within the corporate limits of the city shall obtain a business
permit license prior to commencing business operations.
B. Site Design and Development Standards:
1. General: All new construction shall comply with the current height, setback, and area schedule in effect at the
time the building permit is filed, excluding setbacks, height, and/or area schedule requirements approved
through a planned unit development, special use permit and/or development agreement.
2. Stormwater: Strict adherence to the "Caldwell Stormwater Management Manual", as adopted by the city
council as well as any subsequent adopted updates, is required. NOTE: Any modifications necessary to the
original approved stormwater design where additional stormwater retention or detention facilities are required,
or where the approved retention and detention facilities are required to be expanded, still requires adherence to
the requirements for minimum open space, landscape buffers, lot sizes and setbacks.
C. Engineering Department Conditions:
The following items shall be completed prior to the City Engineer signing the final plat. Said items cannot be
deferred by posting a financial security: 1. Water System: The final plat cannot be signed until the water system has been constructed, pressure tested and clean water samples received. 2. Sewer System: The final plat cannot be signed until the sewer system has been constructed, pressure tested,
CCTV video has been submitted and approved and interim as-builts have been approved by the Engineering Department. 3. Pressurized Irrigation System: The final plat cannot be signed until the pressure irrigation system within the public right-of-way has been constructed and pressure tested.

4. Storm Drain System: The final plat cannot be signed until the storm drain system located within the public right-of-way has been constructed, passed visual inspection, and interim as-builts have been approved by the
Engineering Department. 5. All-Weather Surfaces: The final plat cannot be signed until all-weather surfaces are in place, compaction test results have been submitted and approved for roadways and emergency accesses and, if paved, core sample results have been submitted and approved. 6. Street Signs: The final plat cannot be signed until all street signs have been installed to City standards and approved. 7. Construction Security: Construction security (compliant with current City Code requirements) must be provided for all items which are not among the items listed above, and which are not yet completed before the
City Engineer can sign the final plat. The City must be in agreement on a construction security amount for those improvements.
8. Final Plat Review: The final plat drawing shall be submitted to the Engineering Department for review prior requesting signatures on the final plat. Adequate review time (no less than 30 days) shall be provided by the Applicant. Final plats submitted for review must meet all State statutes and City codes, policies, and
ordinances. 9. Addressing: In an effort to expedite the addressing process of the final plat, applicants shall submit electronic copies of the final plat, in both PDF and AutoCAD format, to the Engineering and Mapping departments as soon as possible. D. Fire Department Conditions: 1. All requirements from the Fire Department for access, turnarounds, emergency access, water supply, fire
hydrants, etc. shall be met in the development and/or platting of the subject property.
2. Final approval of the location and number of fire hydrants within the development shall be determined by the
Fire Marshal and take place by phase at the time of submittal of applicable construction drawings for each
phase.
F. Mapping Department Conditions:
1. Approved Subdivision Name. No changes to an approved subdivision name shall occur unless a request is
initiated through the filing of an application for a “Subdivision Name Change Request”, and subsequently
reviewed and approved the Mapping and Planning and Zoning Department, at an administrative staff level. In
making application, the application shall file a completed application with the Planning and Zoning
Department on forms prescribed by the department accompanied by such data and information necessary to
assure the fullest presentation of facts, as determined by the Planning Director.
a. Subdivision Name Change Requests; Prior to Final Plat Submission: If approved, an amended preliminary
plat will need to be submitted to the Planning and Zoning Department with the reflected subdivision name
change prior to the approval of construction drawings. All construction drawings and final subdivision plats
shall reflect the new approved subdivision name.
b. Name Change Requests; Prior to Final Plat Recording: If approved, an amended final plat drawings and
mylars will need to be submitted to the Planning and Zoning Department with the reflected subdivision name
change prior to signature of the final plat.
c. Name Change Requests; After Final Plat Recording: If approved, an amended final plat drawing indicating
the new subdivision name OR an Affidavit of Correction indicating that the plat is otherwise known as “insert
the new approved subdivision name”, shall be recorded at the county recorder’s office. Once the plat or

affidavit is recorded, a copy of the recorded plat or affidavit shall be provided to the Planning and Zoning
Department.
2. Approved Street Names, Street Layout, Lot and Block Numbering, and Subdivision Phasing Plan. No
changes to the original approved street names, street layout and configuration, lot and block numbering, or
subdivision phasing plan shall occur without prior approval from the City of Caldwell Mapping Division.
Any substantial changes from what was originally approved may require additional public hearings.
G. Landscaping Specific Requirements:
1. Compliance: The applicant shall comply with all landscaping requirements based on Caldwell City Code.
2. Landscape Plan: The Landscape Plan (Exhibit 1) represents the approved landscape plan. Any changes to
the landscape plan must be submitted to the City for review and approval prior to installation.
3. If the City determines that any such changes require additional public comment due to potential impacts on
surrounding property or the community, or that such change is a substantial enough change from the
landscape plan presented to the public, a public hearing shall be held on the proposed changes and notice
shall be provided as required by the City.
4. Landscape Maintenance: All landscaping and screening devices shall be maintained in an attractive, live, safe
and healthy manner.
5. Subdivisions: The home owner’s association is responsible for maintaining all common area landscaping
and screening devices within a subdivision, development, and/or the subject property.
6. Parking Lot Landscaping: Linear grouping of parking spaces shall not exceed twelve (12) in a row, without
the installation of an interior landscape planter island. Landscape planter islands shall contain a minimum of
sixty (60) square feet of area when serving a single row of parking. Landscape planter islands shall contain a
minimum of one hundred twenty (120) square feet of area when accommodating a double row of parking
spaces. Islands shall contain a minimum of one Class 1 or 2 tree and shall be covered with a combination of
low shrubs, lawn or other vegetative or nonvegetative ground cover if wet landscaping is utilized. If dry
landscaping is utilized, the island shall be covered with rock ground cover and a minimum of one boulder
and there shall be no requirement for vegetation. Class 3 trees are prohibited in the interior planter islands.
7. Street Landscape Buffers: The street landscape buffers shall contain a mixture of sod, trees (deciduous and
evergreen), shrubs, lawn, vegetative and non-vegetative ground cover so that the entire buffer area is covered.
Plantings shall meet or exceed the minimum plant sizes as follows:
TYPE MINIMUM (at planting)
Sod Grass 70% of the buffer area
Evergreen trees 6-to-7-foot in height
Ornamental trees 2-inch caliper
Shade trees 2-inch caliper
Shrubs 2-gallon
Perennials 2-gallon
Ground Cover 1-gallon

H. Subdivision Specific Requirements:
1. Cluster Mailboxes: The development shall utilize cluster mailboxes for delivery of mail. Individual mailboxes
shall not be allowed. A cluster mailbox placement plan shall be submitted to the Planning and Zoning
department showing coordination with the United States Postal Services prior to submitting the construction
drawings.
2. Subdivision Construction Signage: At the time of development a "rules and regulations" sign shall be posted
and maintained at the entryways to the project until it is fully developed and build out is complete. The signs
would be intended for subcontractors performing work and should include: a) no dogs; b) no loud music; c)
no alcohol or drugs; d) no abusive language; e) disposal of personal trash and site debris; f) daily cleanup of
any mud and/or dirt that is deposited from the construction parcel onto streets; g) installation of a temporary
construction fence that would keep debris from being blown off site by the wind; h) no burning of
construction or other debris on the property.
3. Plat Expirations:
Final plats must be recorded for a single-phase development or for the first phase of a multi-phase
development within twenty-four (24) months of the date of signature on the approving order of decision for
the final plat. For phased subdivisions, see 11-02-02 (1).
4. Phased Subdivisions: The subdivider may file and obtain acceptance of successive final plats for continuous
segments of the approved preliminary plat without reapplication for preliminary plat approval, provided that
final plats are recorded in successive intervals of not more than two (2) years each, as measured from the date
of recordation of the prior phase final plat, and provided that "city code", as herein defined, and any
subsequent amendments as adopted by the city before, during or after preliminary plat approval, is followed
in all design, engineering plans, construction and final plats for all phases, with the exception of lot sizes, lot
dimensions, setbacks, number of lots and any exceptions approved at the time of preliminary platting, which
shall remain as indicated in the preliminary plat order of decision and/or development agreement.
5. Approved Subdivision Name. No changes to an approved subdivision name shall occur unless a request is

reviewed and approved the Mapping and Planning and Zoning Department, at an administrative staff level. In

The Council, based upon the testimony and evidence in record in this matter and upon findings of fact and
conclusions of law set forth herein DOES HEREBY DETERMINE AND DECIDE AS FOLLOWS: the request
for a final plat approval for Peregrine Estates 7 subdivision consisting of 29 residential lots and 2 common lots on
15.97 acres in the R-1 (Low Density Residential) zone on Parcels R32818011D2, located in the 13-3N-3W NW
TX 05907 IN NWSW LS TX 06501, 06502, 17497, 18457, 22578 & LS RD & R-O-W, is APPROVED
SUBJECT TO THE CONDITIONS OF APPROVAL LISTED HEREIN.
These Findings of Fact, Conclusions of Law and Decision are for Peregrine Estates 7 Subdivision approved
and adopted by the Caldwell City Council on this date, 10/21/24

Thetopsoil shall contain neither noxious weeds nor their seeds. It shall not be used for planting operations while in afrozen or muddy condition. An appropriate fertilizer may be used to provide needed nutrients for healthy andvigorous plant growth. Follow recommendation of topsoil report.7.The following procedure shall be followed in placing all topsoil:A.All areas to receive topsoil which have a slope of less than ten (10) percent shall be cross-ripped to a depth offour (4) to six (6) inches.B.The surface of the subgrade shall be scarified to a depth of two (2) inches to provide a transition zone betweenthe subgrade and the topsoil. Place the topsoil on the subgrade and fine grade to the final finished grade andtopsoil depths as indicated on the drawings and in these notes.C.Any required soil amendments (i.e. organic matter, fertilizer, gypsum, etc.) shall be placed directly on the topsoilat the required rates and spread evenly over the planting area. The amendments shall then be thoroughlyblended into the topsoil to a depth of four (4) inches. Where only a dry, granular fertilizer is to be added, it maybe applied to the surface and raked in during the fine grading process.8.The Contractor shall obtain a soil analysis from any authorized soil testing agency of any existing stockpiled orimported topsoil to be used on the project to verify that it conforms to the topsoil specifications. Test results shallinclude horticultural nutrient recommendations. The soil samples shall be obtained per the testing agency directions.Allow ten (10) working days to obtain test results. The costs for such testing shall be the responsibility of theContractor. Prior to delivery of the imported topsoil to the site, the Contractor shall provide to the LandscapeArchitect the name and location of the topsoil source, along with the certified soil analysis of the topsoil to be used.The analysis shall verify that the proposed topsoil meets the topsoil specifications, and is capable of supportinghealthy plant growth.9.After imported top soil has been delivered to the site, a second soils test may be required to verify that it is indeedthe same soil as previously tested and designated for use in this project. No substitution of top soil shall be allowedwithout prior written authorization from the Landscape Architect.10.All plants used for this project shall conform to the following:A.Any inspection certificates required by law shall accompany each delivery of plants and such certificate shall befiled with the Landscape Architect. All plants shall be subject to inspection and approval at the place of growth orupon delivery to the site for their quality, size, species, and variety. Such approval shall not impair the right ofinspection and rejection at the site or during progress of work for size and condition of the plants, latent defects,or injuries. Any and all rejected plants shall be removed immediately from the premises by the Contractor. TheContractor shall make all replacements at his expense should he fail to comply in full with any of thespecifications. Necessary replacements will be made as soon as weather conditions permit and all such plantsreplaced shall conform to all specifications herein.B.Plants shall be fresh and vigorous, of normal habit and growth, and free of disease, insects and insect eggs andinsect larvae, weeds and weed seed. No heeled-in plants from cold storage shall be accepted except onapproval by the Landscape Architect prior to installation.11.All plants shall be installed using the following procedures:A.Plants shall be generally located as indicated by the drawing. The Contractor shall stake out the location of allplants and planting areas, and no excavation or installation shall commence until such locations have beenapproved by the Landscape Architect.B.All trees and shrubs shall be planted in pits as detailed in the planting details contained herein or as noted on thedrawings. Tree and shrub pits shall be circular in outline, with a diameter at least two (2) times the diameter ofthe rootball of each plant to be installed. They shall be one to two and one half (1 - 2 ½) inches shallower thanthe rootball depth. When the plant is properly placed in the plant pit, the root collar shall be at or approximatelyone (1) inch above finished grade. The sides of the plant pit shall be roughened, and not smooth or sculpted.C.Plant backfill mix shall be one hundred (100) percent native site soil.D.For container grown plants, remove the container and place the plant vertically in the plant pit, directly onundisturbed soil. The root crown or collar shall be at or approximately one (1) inch above the finished grade.Perennial plants and ornamental grasses shall be planted with root collar at finished grade.E.For balled and burlapped plants, place the plant vertically in the center of the pit, with the rootball resting onundisturbed soil. Cut and remove the wire basket and burlap or other wrapping material from the rootball. Thismay be done with the rootball in the pit. Any burlap or wire pieces underneath the rootball may be left in place ifthey cannot be removed. Do not fold the burlap over, but cut away as much as possible without disturbing therootball. No burlap shall be pulled from under the rootball. Backfill the bottom one third (1/3) of the pit as the wireand burlap are removed. In all cases, maintain the integrity of the rootball.F.Specified backfill material shall be carefully and firmly worked and tamped under and around the rootball to fill allvoids. When backfilled and compacted to two thirds (2/3) the depth of the pit, thoroughly water with a hose tocompletely soak the roots and remove any air pockets.G.The plant pit shall then be completely backfilled with the specified backfill mix and tamped well. A shallowwatering basin or rain cup shall be formed around each plant. This basin will be equal in diameter to that of theoriginal planting pit.H.After planting, the following operations shall be performed:I. Stake and mulch all trees per installation details.II. Remove all nursery stakes ties, and tags from all plants. Prune and remove any dead,damaged, or broken branches. Maintain side growth on all trees.12.Staking shall be performed as follows:A.Two (2) 2"x 2" square or 2” diameter round wood stakes, minimum ten (10) feet in length, shall be used tosupport each tree planted under this contract unless otherwise indicated. Metal t-posts shall not be used.B.Tree ties shall conform to the staking detail shown on the planting detail sheet. Wire and vinyl hose shall not beused.C.Each stake shall be located adjacent to the rootball, on opposing sides, to provide maximum support to the trunk.Do not penetrate the rootball with the stake.D.The stakes shall be driven into the pit bottom after the tree has been placed in the pit, but before backfillingbegins so as to avoid damage to the roots.E.Stakes and ties shall be removed after one (1) full growing season from the time the tree was installed.13.All plants shall be thoroughly watered immediately after planting. This shall mean full and thorough saturation of allbackfill in the pits and beds during the same day of planting. Water shall be applied only by open end hose at verylow pressure to avoid air pockets, injury to the plant, or washing away of backfill. When installed, watered, and fullysettled, the plants shall be vertical. Subsequent watering shall be provided by the site's irrigation system. TheContractor shall insure that all plants, especially trees, receive sufficient water to maintain healthy growth and vigor.Over-watering shall be avoided, and prolonged saturation of the soil around the trees shall be eliminated byappropriately controlling the irrigation circuit which provides water to that area.14.Mulch (see plant materials schedule and specifications for size requirements) shall be placed to a depth of three (3)inches on top of the topsoil in all planting beds and over tree planting pits. The finished grade of the mulch shall beas follows:A.Two (2) inches below the surface or finished grade of any paving, mowstrips, or walks adjacent to the plantingarea.B.One (1) inch below top of metal edging.C.At adjacent finished grade of the turf surrounding tree planting pits.D.In tree pits, the mulch shall be kept six (6) inches away from the base of the tree.E.Just prior to placement of the mulch, the Contractor shall treat the mulched areas with a pre-emergent herbicideaccording to the manufacturer's recommendations.15.For projects with turf grass sod, all sod used for this project shall be free of grassy and broad-leaf weeds, contain nobare or burned spots, and be clean and strongly rooted. It shall be of the varieties noted in the plans and PlantMaterial Schedule. The sod shall be cut using approved methods and equipment. It shall be cut in pieces notexceeding one (1) square yard, with a uniform thickness on all pieces. Sod thickness may vary between a minimumof one (1) inch and maximum one and one half (1 ½) inches, but must be consistent throughout this project. TheContractor shall notify the Landscape Architect of the source of the sod prior to placement. The sod shall bestripped and delivered to the site not more than twenty four (24) hours prior to laying. It shall be maintained in amoist and healthy condition to encourage immediate growth.16.The following procedure shall be followed when installing the sod:A.Lay the sod on smooth, moist topsoil, working off planks if required.B.Rake the topsoil to loosen and level prior to placing each course of sod.C.Lay strips perpendicular to the direction of the slope. Strips shall be parallel to each other, with their end seamsstaggered. The sod shall be neither stretched nor overlapped, and all joints shall be butted tightly together.D.Roll the sod immediately after placing and thoroughly water with a fine spray to a depth sufficient that theunderside of the new sod and the soil immediately below the sod are thoroughly wet.E.On slopes two (2) horizontal to one (1) vertical or steeper, lay the sod perpendicular to the slope and secureevery row with wooden pegs at two (2) feet maximum on center. Drive the pegs flush with the soil portion of thesod.F.Sod pieces shall be laid tightly together. Sod areas with gaps caused by pieces not being laid tightly enoughtogether or areas with ridges from overlapping pieces shall not be accepted and the Contractor will be required tore-lay the sod.17.Throughout the course of planting, excess and waste materials as well as excavated subsoil shall be continuouslyand promptly removed. All areas shall be kept clear and all reasonable precautions taken to avoid damage toexisting structures, plants, and grass. When planting has been completed in an area, it shall be thoroughly cleanedof all debris, rubbish, subsoil, and waste materials. These shall be removed from the property and disposed oflegally. All planting tools shall also be put away.18.Substantial Completion shall be defined as the complete installation of all plant materials, staking, mulching, andother work on the project in its entirety. Substantial completion shall not be given on designated portions of aproject.A.At substantial completion of all planting work outlined in these plans, the Contractor shall contact the LandscapeArchitect to arrange for a walk through to verify that all aspects of the work have been completed. Work must befully completed (except for final clean-up) according to all plans, notes, and specifications and exhibit professionalworkmanship.B.Notice by the Contractor shall be given, in writing, at least three (3) days in advance to the Owner'sRepresentative and Landscape Architect so that proper scheduling can be made for those who are to attend.C.At the appointed time, an inspection of all plant materials, including staking and mulching, shall be made.D.A list of uncompleted items (punch list) shall be generated by the Landscape Architect and distributed to theContractor and other involved parties within three (3) days of the substantial completion inspection. Each item onthe punch list shall be corrected before the project will be approved and accepted by the Owner's representative.The Contractor will be back charged for time spent by the Owner and any consultants who have been brought tothe site for a final inspection when the project is not ready for said inspection.19.The maintenance/establishment period shall begin one (1) day after the substantial completion inspection. TheContractor shall complete all punch list items during this period, as well as maintain and operate the entire irrigationsystem. The Contractor shall maintain all plantings until the turf is fully established. The turf shall be consideredfully established when turf grass stands come in uniform and thick, with no bare or thin spots, and roots have begunto spread and knit together. No weeds shall be allowed in the grass areas. This shall be a minimum period of sixty(60) days. If winter weather interrupts the maintenance period, the maintenance period shall be suspended and thebalance of the time shall be carried over to the next growing season and completed then. The Owner andContractor shall mutually determine when the maintenance period is suspended and when it starts up again. Themaintenance work required shall include but not be limited to the following:A.Appropriate watering of all plant materials.B.Weeding and removal of all weeds from groundcover and planting areas.C.Replacement of any dead, dying, or damaged trees, shrubs, perennials, or groundcover.D.Filling and replanting of any low areas which may cause standing water.E.Adjusting of sprinkler head heights and watering patterns.F.Filling and re-compaction of eroded areas, along with any required re-seeding and/or replanting.G.The turf grass shall be mowed when the blades reach three (3) inches tall and maintained to a minimum height oftwo (2) inches. No more than one third (1/3) of the blade shall be removed per cutting. The cutting frequencyshall be once every five (5) to seven (7) days depending upon turf grass height and growth rate.H.Weekly removal of all trash, litter, clippings, and all foreign debris.I.At thirty (30) days after planting, a balanced fertilizer (16-16-16) shall be applied to the turf grass areas at a rateof one half (½) pound of nitrogen per one thousand (1,000) square feet.J.At intervals of thirty (30) days after the first application of fertilizer to the turf grass, apply a balanced fertilizer(16-16-16) at a rate of one half (½) pound of nitrogen per one thousand (1,000) square feet until the turf grass isestablished.20.A final inspection shall be held prior to the end of the maintenance period to insure that all punch list items havebeen completed and the entire project is ready for acceptance by the Owner. Upon satisfaction that the Contractorhas completed all punch list items, the irrigation system is fully and completely functional, and the required As-Builtdrawings, mylars and maintenance manuals have been submitted, the Owner shall accept the project. An officialletter of final acceptance shall be prepared and issued to the Contractor, Landscape Architect, and the Owner'srepresentative. Upon final acceptance of the project by the Owner's representative, the Owner shall assume fullresponsibility for the project, and the guarantee period shall begin.21.Upon final acceptance of the project as being properly installed, the Contractor shall guarantee the plant materials asfollows:A.All shrubs and groundcovers shall be guaranteed by the Contractor as to growth and health for a period of sixty(60) days after completion of the maintenance period and final acceptance.B.All trees shall be guaranteed by the Contractor to live and grow in an acceptable upright position for a period ofone (1) year after completion of the maintenance period and final acceptance.22.The Contractor shall, within fifteen (15) days after receiving written notification by Owner's representative, removeand replace all guaranteed plant materials which die or become unhealthy or appear to be in a badly impairedcondition at any time during the guarantee period. Any plants that settle below or rise above the desired finishedgrade shall also be reset to the proper grade.A.All replacements shall be plants of the same kind, size, and quality as originally specified in the “plant list” andthey shall be furnished, planted, staked, and maintained as specified herein at no additional cost.B.The Contractor will not be responsible for plants destroyed or lost due to occupancy of the project, vandalismon the part of others, or improper maintenance or lack thereof.
