Box 8028 • Boise, ID 83707-2028 (208) 334-8300 • itd.idaho.gov March 9, 2022 Debbie Root Senior Planner 621 Cleveland Blvd Caldwell, Idaho 83605 VIA EMAIL Development Application ANN21-000001, PUD-21-000001 Project Name ENCLAVE SUBDIVISION Project Location Approximately 1,500 feet west of the intersection of SH-55 and Midway Road, south of SH-55 milepost 14.22 Project Description Mixed use (single family, multi family, and commercial) development of 59 lots with a zoning designation of H-C (Highway Corridor) zone on parcel’s R32795 and R32795010. Applicant Don’t Have A Clue, LLC The Idaho Transportation Department (ITD) reviewed the referenced planned unit development and annexation applications and has the following comments: 1. This project abuts the State Highway system. 2. The proposed plat accommodates ITD’s SH-55 future widening and buildout. Dedication of future right-of-way must be done with a legal description and ITD form for Property Dedication. Please contact Roger Edwards, D3 Property Manager, to acquire the appropriate forms. 3. Sidewalk is proposed in future ITD right-of-way. Although the location may match location of future sidewalk after the widening, there are grade adjustments being made within the future R/W during construction. The proposed sidewalk will very likely be removed and need to be replaced in ITD’s construction project to locate it at the proper elevation. ITD requests the City’s assistance in keeping structures out of the future right-of-way to help reduce the taxpayer expense of improving the highway. The sidewalk could be built after ITD’s widening project with later phases to avoid extra expense to the widening project and waste of IDAHO TRANSPORTATION DEPARTMENT P.O. The developer may also relocate the sidewalk to their property or wait until after the SH-55 widening project has been done. 4. Per ITD’s Development Condition Memo letter dated September 23, 2021, mitigation shall be required for each proposed approach on SH-55 (see attached). The intersection of SH-55/Celeste Way shall require the following mitigation:  Approach shall be limited to right out only with concrete curbing at trhe approach so that it does not affect any movements for southbound Celeste Way  Developer shall provide $202,325 for future construction of an eastbound right turn lane to be included in ITD Project KN 22716.  Developer shall dedicate 12 feet of right-of-way from Celeste Way to parcel’s western boundary.  ITD shall reconstruct this intersection as a right in, right out, left in during construction of KN 22716. During construction, ITD shall also build the eastern right turn lane for Celeste Way. The intersection of SH-55 MP 14.27right shall require the following mitigation:  Approach shall be limited to right in, right out, left in with the installation of bolt down shur-curb approximately 150 feet in both directions from the center of the approach to limit turning movements.  Developer shall construct a 520ft eastbound 12ft-wide right turn lane to ITD's design standards.  Developer shall dedicate to ITD 12ft of right-of-way the entire length of the turn lane.  Developer shall construct a 1,185ft westbound 14ft-wide left turn lane to ITD's design standards. o Left turn lane shall be centered on SH-55. o Developer shall dedicate the necessary right-of-way along the left turn lane to accommodate the pavement widening and drainage.  Shoulders shall be 8ft wide along any widened portions of SH-55.  ITD shall reconstruct this intersection as a right-in, right-out during construction of KN 22716. The eastbound right turn lane shall be reinstalled during ITD's construction project. 5. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State Highway. The Idaho Administrative Procedure Act (IDAPA) 39.03.60 governs advertising along the State Highway system. Provided the applicant permit and construct mitigation required in the corresponding Development Condition Memo and the sidewalk is relocated or delayed to after SH-55 widening, ITD does not object to the proposed development.
