Chair Zamora proceeded to public hearing items on the agenda. OLD BUSINESS: None NEW BUSINESS: ACTION ITEM: PUBLIC HEARING (QUASI-JUDICIAL): CASE NUMBER ANN24- 000001: ALEKSEY MAZHUKHIN IS REQUESTING ANNEXATION OF HIS 0.27 ACRE PARCEL, R2262200000, AND HIS 0.03 ACRE PARCEL, R2262301000 WITH A ZONING DESIGNATION OF R-1 (LOW DENSITY RESIDENTIAL). THE PARCELS ARE DESIGNATED WITHIN THE COMPREHENSIVE PLAN FUTURE LAND USE MAP AS LOW DENSITY RESIDENTIAL, NO CHANGES TO THE FUTURE LAND USE MAP DESIGNATION NOR FURTHER DEVELOPMENT OF THE SITE ARE PROPOSED. THE SUBJECT PARCELS ARE LOCATED ON THE SOUTH SIDE OF MARVIN ST., APPROXIMATELY 400 FEET EAST OF S. KIMBALL AVE., IN CALDWELL, IDAHO. Staff Presentation: City Associate Planner, April Cabello, 621 Cleveland Blvd,. Caldwell, Idaho presented the staff report, outlining its contents by use of a PowerPoint presentation. • 2015 - 8 parcels annexed in to connect to city services • Current owner purchased property in 2023 • 0.30 acres • 2 parcels, one to be annexed in as nonconforming, which is allowed • Conditions of approval to include a lot combination into two parcels so the city isn’t annexing in a non-conforming parcel. Applicant Presentation: Name, Aleksey Mazhukin, 210 Marvin, Caldwell, Idaho 83605, presented the applications requests and discussed: • Purchased home in 2023 • Discovered the shared well resulted in conflict with the another homeowner • To avoid further conflict, applicant wants to annex in so he can have access to utilities Commission Questions for Applicant: • No objections to lot combination. THE APPLICANT IS ALSO REQUESTING SUBDIVISION PRELIMINARY PLAT AND PLANNED UNIT DEVELOPMENT APPROVAL FOR GREENMONT SOUTH SUBDIVISION, A RESIDENTIAL SUBDIVISION WITH 344 SINGLE FAMILY RESIDENTIAL LOTS ON 80.4 ACRES, FOR A TOTAL DENSITY OF 4.27 UNITS PER ACRE. THE SUBJECT PARCEL IS LOCATED ON THE WEST SIDE OF INDIANA AVE., APPROXIMATELY 1240 FEET SOUTH OF THE INTERSECTION WITH USTICK RD., IN CALDWELL, ID. Allen St, presented the applications requests and discussed: • Infill • Surrounding land use • Landscaping • Amenities • Four phases Commission Questions for Applicant: • Timeframe for each phase: Year to year and a half • Fire pits: no comment from Fire Department • Diversity of topography Commission Questions for Staff: • Needs clarification understanding a statute expressing opposition of annexation Director Collins, 621 Caldwell Blvd. Caldwell, ID 83605 states that statute applies to landowners regarding a forced annexation by a city. Error in staff report will be corrected before going to City Council. Public Testimony: Ann Melger, 2203 Copious Ct., Caldwell, Idaho, spoke in favor of the request. • Traffic City Engineer, Hallie Hart, stated city has dedication requirements specifically to Indiana Road, specifically to Right of Way and turn lanes. Laurie Deitrich, 1815 Cambridge St., Caldwell, ID spoke in opposition of the request • Loss of view • Did not receive neighborhood meeting notification • Land use • Provided late exhibits of letters (given to Director Collins) Director Collins read late exhibits P1 and P2 into the record. Steve Schmidt, 4805 Great Falls Ave., Caldwell, Idaho, spoke in opposition of the request • Traffic • Road conditions • Feels building more homes invites more people Question for Mr. Schmidt: • Would like to see a lower density zone in that area.
