l) ACTION ITEM: Case Number AMD-20-02: Paul Navarro and the Canyon County Sheriffs
Office requested and received approval for a special use permit and variance for construction to
operate a temporary holding facility for up to 122 females within the T-N (Traditional Neighborhood)
Zone. Also requested was a variance to allow a fence height ofup to l2 feet. Both were approved by
the Planning and Zoning Commission on August 14, 201 8. The subject property is located at the
southwest comer of Chicago Street and 126 Ave. in Caldwell, Idaho. At this time, the applicant is
requesting the following condition be removed from the Variance (VAR-18-02) conditions of
approval: Condition 12.6The applicant shall use landscaping that conceals and screens to the greatest
extent possible the razor wire fencing.
2) ACTION ITEM: Case Number CMP-20-04l7nN-20-05/SuB 20P 05: A request by Heartland
Townhomes Property Management LLC and Trilogy Development, [nc., for comprehensive plan map
amendments, rezones and approval of a preliminary plat for AeroSky Park Subdivision, a proposed
commerciaVindustrial development ofparcel R35305, (35.4 acres), located on the southeast comer of
H*"y 20126 and Aviation Road, Caldwell, Idaho. The City of Caldwell 2040 Comprehensive Plan
designates the property as "Commercial and Services." A map amendment is proposed to allow for
industrial zoning. The 35.4 acre subject property is currently zoned 'C4' (Interchangeffreeway
Commercial) and the applicant is proposing 12.6 acres of "C-3" (Service Commercial) and,24.82
acres of "M-1" (Light Industrial) zoned property. The proposed plat contains 6 commercial lots and
14 industrial lots. The subject property is located in the APO-I Land Use Limitation Zone.
3) ACTION ITEM: Case Number OA-20-01: A request City of Caldwell Planning and Zoning to
adopt an amended zoning map that supersedes and replaces the zoning map adopted by Caldwell City
Council on March 18,2019 (Ordinance No. 3195). The new map includes all rezones, annexations
and de-annexations that occurred between January l, 2019 and December 31,2019. The zone
boundary changes during this period were approved by City Council at respective public hearings
held pursuant to the requirements of Idaho Code, Title 67 , Chapter 65, Local Planning Act. Also
requested is to adopt an amended City of Caldwell Comprehensive Plan Map that supersedes and
replaces the comprehensive plan map adopted by Caldwell City Council on February 3,2020
(Resolution 38-20). The new map includes all comprehensive plan map changes that occurred
between January I, 2019 and December 31,2019. The comprehensive plan land use map changes
during this period were approved by City Council at respective public hearings held pursuant to the
requirements ofldaho Code, Title 6T,Chapter 65, Local Planning Act.
4) ACTION ITEMz Case Number OA-20-03: A request by the Planning and Zoning Department
amending Chapter 10, Article 12, Section 10-12-08 of the Caldwell City Code, Providing For Staff

review it gives the planning director the discretion to decide if it should go to commission or if
it can just go to the director.
Commissioner Zamora stated he just opened a business in the city center and wanted to know if
this was a conflict of interest.

The Caldwell Planning and Zoning Department issued a notice of Public Hearing on application
OA-20-03 to be held before the Caldwell Planning and Zoning Commission on August7L,2020.
Public notice requirements set forth in ldaho Code, Title 67, Chapter 65, Local Planning Act, were
met. On or before luly 26,2020 notice was published in the Idaho Press Tribune.
Files and exhibits relative to this application are available for review in the Planning and Zoning
Department,62l Cleveland Boulevard, Caldwell and at applicable public hearings.
GENERAL FACTS
APPLICANT: Caldwell Planning and Zoning Department,62l Cleveland Boulevard, Caldwell,
Idaho,83605.
REQUEST: a request by the Planning and Zoning Department to amend Chapter 10, Article 2,
Section 10-12-08 of the Caldwell City Code, pertaining to Design Review.
TEXT CHANGE CONSIDERATION: The purpose of this request is to allow Staff Level Design
Review to be considered for certain design elements.
BACKGROUND:
The Planning Director has the task to prepare and present cases before the Design Review
Commission. The cases that came before the Design Review Commission in 2019 included exterior
renovations and Cleveland Square [a senior housing and clinic). Applications included before the
Covid-19 virus in 2020 were some minor signs and canopies. These applications would only take
no more than an hour to review, but the applicant would have to wait over a month in some cases,
because they needed to be reviewed and approved by the Design Review Commission. Chapter
10, Article 2, Section 10-12-08 of the Caldwell City Code requires that all design review decisions
must be approved by the Design Review Commission in the City Center no matter how small they
may be. In May of 2020, the Caldwell City Council gave authority to the Mayor to direct staff to

conduct staff level design review with restrictions, such as only minor projects, such as signs and
canopies, and minor revocations, store front improvement, such as painting and window placing
of like kind. The action by the Planning and Zoning Commission will allow all applications within
the city center zoning district, including those within the Indian Creek corridor, be reviewed and
allow staff level design review, if the following complies:
1. Building Materials, Colors, Wall Opening and Projecting Elements based upon
Compatibility to the City Center
a. Building Facades
1) Exterior Renovations - Minor building elements
2) Store Fronts
b. Design Elements
1) Pedestrian Amenities, such as, trash cans, bike racks, and others
2) Awnings /Canopy
3) Windows, Trim and Materials
4) Lighting elements
c. Murals
d. Signs [As determined by the planning and zoning director)
All new proiects and other proiects determined by the Planning and Zoning Director will require
Design Review Commission approval.

RECOMMENDATION FOR CASE NO. OA-20-03 (CHAPTER 10, STAFF TEVEL DESIGN REVIEW)to adopt
Staff Level Design Review standards in the Article 12 of the City Center Zoning District of the City of
Caldwell Zoning Ordinance. MOTION: Commissioner Zamora that Case Number OA-20-03 be
approved. SECOND: Commissioner Nelson. The motion passed unanimous.
Case Numbers OA-20-03 was heard by the Caldwell Planning and Zoning Commission at a publlc hearing held
August LL,2020.
The Findings of Fact, Conclusions of Law, and Recommendation for OA-20-03 were administratively approved
and signed by the Planning and Zoning Commission Chairman on the date noted below.
