Before you we have a request for consideration of annexation and concurrently to consider a preliminary plat if the annexation is approved. On August 24, 2021 the Hearing Examiner forwarded the Annexation and Preliminary Plat with a recommendation of approval with a recommended condition that the entire block of properties (approximately 60 acres) inclusive of all of the out-parcels adjacent to the proposed Sterling Ridge development be annexed as they will be enclaved by the City of Caldwell. Staff requested shortly after the application was made that all of the properties be annexed and at the time of that request the northwest corner parcel was still under ownership of Richard and Debbie Roedel. Richard and Debbie are currently the owners of 18.25 acres of the proposed development acreage under contract to Sterling Land Development. 17.25 acres of the proposed development property is under ownership of the Terry and Sharon Roedel Family Trust. They are proposing to not annex a 1.31 acre the portion of this 17.27 acres where the current residence is located along Marble Front Road. The 1.34 acre parcel owned by Dane and Krista Kingston had previously been divided from the acreages and that property owner does not want to annex. Mr. Steve Roedel owns the northeast corner parcel (3.19 acres) and the 18.19 acre parcel that is proposed to be split --keeping the two parcels with homes on them inclusive of a property boundary adjustment and lot split of 4.25 and 3.31 acres for a total of 7.56 acres. Mr. Steve Roedel has indicated to staff that he is willing to annex his agricultural property that he retains -7.56 acres at the time of further residential development on his property and/or the property to the north of his property. The concern is being able to continue the current agricultural and other “county” uses that he currently enjoys on the property. Canyon County Development Services has approved lot line adjustments of the properties resulting in the land parcel of approximately 48 acres that the developer is proposing to annex and purchase from the Roedel family. The deeds have not been transacted for those boundary line adjustments pending City Council decision on annexation and development of the property. It is my understanding that the new property owner of the northwest corner parcel and that the owner of the proposed 1.31 acre Trust parcel have agreed to annex if council requires annexation in order to develop the property. Mr. Steve Roedel would like to annex in the future as a proposed condition. As a planner I have to recommend that these enclaved parcels be annexed to ensure continuity of services and development of City properties. Council can support the recommendation of the Hearing Examiner that all of the parcels be annexed at time of development. Alternatively, require that the two properties that have acknowledged consent to annex be annexed with the development property and that Mr. Steve Roedel enter into the development agreement with a consent to annex when his properties develop with additional residential units and/or the property to north develops. Or the council can deny the application for annexation at this time. The requested annexation and zone as R2 Medium Density Residential is consistent with the comprehensive plan and many of the goals and policies as outlined in the staff report. The proposed preliminary plat of 187 lots on 48 acres with an average lot size of 6924 sq ft and 8% percent open space to be developed in 4 proposed phases is in substantial compliance with City ordinance requirements. The developer has complied with required modifications to the plan and staff supports the approval of the Sterling Ridge Preliminary Plat.
