Chair Zamora proceeded to public hearing items on the agenda. OLD BUSINESS: None NEW BUSINESS: ACTION ITEM: Case Number ANN23-000016, CPM23-000011, DEV23-000004, PUD23-000006, SUB23-000042, & ZON23-000009: Brighton Development, Inc., on behalf of: DWT Investments LLC; Midland Farms LLC; Yamamoto Properties LLC; Page | 2 Planning and Zoning Minutes 2/28/2024 Victor and Jean Yamamoto Living Trust; Yamamoto Farms, Inc.; and Winco Foods, LLC, is requesting Annexation and Zoning of approx. 11.47 acres to the R-2 district; five (5) Comprehensive Plan Map Amendments totaling approx. 200.4 acres; eight (8) Rezones totaling approx. 309 acres; a Development Agreement Modification; and a Planned Unit Development and Preliminary Plat for Aviary Subdivision consisting of 472 single-family lots and 3 commercial lots on 148 acres. Total Project area is approx. 406.8 acres of land. The subject parcels are located on the north and south side of Hwy 20/26 with Knott Lane as the east boundary and generally the Idaho Northern Railroad right-of-way as the west boundary except for some lands both east and west of the railroad right-of-way at the southwest project boundary, in Caldwell, Idaho. Staff Presentation: City Associate Planner, Joe Dodson, 621 Cleveland Blvd,. Caldwell, Idaho, presented the staff report, outlining its contents by use of a PowerPoint presentation. • Overall description of area • Agency notification comments • Public comments • History of site • Surrounding area • Development agreement provisions • Density • Zoning • TIS required • PUD deviations – lot size, setbacks • Issues to resolve with applicant prior to City Council • Applicant concerns Applicant Presentation: John Wardle (Representative), 2929 W. Navigator Drive, Ste. 400, Meridian, Idaho, 83642, presented the application requests and discussed: • 406 acres with 6 different interested owners • Previously adopted DAs existed • Comp Plan • Roadways • Future concepts of surrounding development • Aviary Sub • Rezone • Railroad for Sunroc • Land Use • Amenities Questions from Commissioners to applicant: • Comp Plan Amendment • Roadways and Traffic Impact Study • Irrigation Page | 3 Planning and Zoning Minutes 2/28/2024 • Public comment about Brighton’s view of Caldwell • Open space usage and requirements regarding pathways • Railway in relation to Sunroc • Neighborhood Meetings • Storage Unit location in TIS • Traffic signal installation Questions from Commissioners to staff: • COMPASS report: job to homes ratio • Traffic and roadway improvements Robb MacDonald (Public Works Director), 621 Cleveland Blvd,, Caldwell, Idaho. addressed the question regarding the roadways. • City of Caldwell response to Canyon County project that was provided by someone named Chester • Current development agreements • Well Rights Public Testimony: Mike Wardle (Representative), 2929 W. Navigator Dr., Ste. 400, Meridian, Idaho, did not wish to speak but was in favor of the request. Angel A. Guzman, 20254 Midland Blvd., Caldwell, Idaho, spoke in opposition of the request. He noted: • Traffic • Irrigation Kevin Chester, 19757 Midland Blvd., Caldwell, Idaho, spoke in opposition of the request. • Letter in response to Canyon County project and City of Caldwell’s agency letter to Canyon County regarding land use Joe Dodson, responds to Chester’s reference of the letter. • Allowed land use and rezoning Andrea Chester, 19757 Midland Blvd., Caldwell, Idaho, did not wish to speak but was in opposition of the request. Nampa, Idaho spoke in opposition to the request. • Density • Schools • Neighborhood meeting • Traffic Commissioners addressed concerns about schools and their role in the decision making process. Applicant Rebuttal: John Wardle spoke in rebuttal and addressed the following topics: • Traffic and working with IDT • Growth Additional Question for Staff: • Well rights for nearby residents. Robb MacDonald addressed the concerns of the resident’s well rights. MOTION CARRIED Evidence List: • Staff Report and presentation documents • Applicant presentation documents • Sign-up sheets Commission Discussion and Deliberation: • Traffic issues will be addressed eventually • Density – appealing because it’s well planned • Quality of project is good • Comprehensive plan decisions are being made before the comp plan has been finalized • Concerns about this big of a projected plan being decided upon during a time when we’re asking for public input with the comprehensive plan. Morgan Bessaw, spoke of the comprehensive plan and said what is being proposed tonight is in alignment with the comprehensive plan. • Approval process of various phases would make future projects more complex. • Conditions of approval Page | 5 Planning and Zoning Minutes 2/28/2024 Suggestions for new conditions: • The Aviary subdivision will add a crossover • Permanent or temporary functioning signal at Midland and Highway 20/26 • Improvements at Middleton and Lincoln to be completed before building permits can be issued • There shall be staff recommendations for the late exhibit conditions • The applicant shall be required to reappear before P&Z commission when the new comprehensive plan is complete. Joe Dodson addressed the following: • DA language • Condition of approval for Midland and Hwy 20/26 requiring a traffic light by Engineering • No C of O issued until traffic signal has been installed ORDER OF DECISION: Case Number ANN23-16, CPM23-11, DEV23-4, PUD23-6, SUB23-42, & ZON23-9: Based upon the testimony and evidence in record in this matter, and upon the findings of fact and conclusions of law forth herein, do hereby determine: ☒ Boutros ☐ Harman ☐ Larson ☐ Whitbeck ☐ Zamora MADE A MOTION AS FOLLOWS: The request for a comprehensive plan amendment, annexation of 11.47 acres with a zoning designation of R-2, rezoning of approximately 309 acres, a development agreement modification, and preliminary plat approval for the Aviary Subdivision Planned Unit Development., is recommended for approval, subject to the conditions of approval as amended • The Aviary Subdivision will add a crossover to the open section along 20/26 to get credit for meeting the open space requirement. • There shall be staff recommendations for late exhibit conditions as amended • The applicant shall be required to obtain a DA modification approval for any new development.
