The parcels are located on the north side of Franklin Road, immediately south and west of the intersection with the
southbound exit from 1-84, in Caldwell, ID.
The Black Canyon Irrigation District (District) has the following initial comments regarding this proposed
modification of the existing special use permit.
1) The applicant has filled out and submitted the District’s Development Intake Sheet and corresponding
intake fee. In addition, a development meeting was held with the applicant to identify preliminary project
requirements on January 8, 2024.
2) It was discussed during the meeting that runoff and drainage from the proposed modifications should be
addressed to ensure downstream users are not adversely affected by the proposed land use changes. The
applicant was directed to keep all runoff and drainage on site and out of the Notus Canal per District policy.
3) The District does not serve the affected parcel with irrigation water, however the Notus Canal which runs
along the property’s western boundary and through the northwestern corner, is maintained and operated by
the District. Therefore, any and all maintenance road right-of ways, lateral right-of ways and drainage
right-of ways will need to be protected (including the restriction of all encroachments).
4) Being that the District’s right of way is adjacent to and is within the applicant’s property, the applicant will
be required to prepare and provide an exhibit with a legal description defining the District’s right of way
within the project’s property boundary. The legal exhibit and legal descriptions must be signed by a
professional licensed surveyor in the State of Idaho. The District’s attorney will attach the legal exhibit and
legal description to a District provided easement for recording. A warranty deed proving ownership of the
property will be required.
5) It is highly recommended to the applicant that non-combustible fencing be installed along the District’s
easement boundary (50’ from centerline of canal). Please refer to the District’s standard drawing GIRR15.
6) The applicant was provided a Development Intake Quotation (DIQ) on January 10, 2024. The DIQ
provides the applicant with an estimate for the cost to review the proposed development plans. The District
has not received payment and as a result further review has been paused.

7) Multiple easements, including City utility easements are located on this property and cross under the Notus
Canal. We request that any site plans submitted properly identify these easements, with instrument
number, on the developer’s plans.
8) We request that the City condition final building permit approval, with a letter of concurrence from the
District, that all Black Canyon Irrigation District requirements have been resolved prior to approval of
construction drawings.
