I have no issues with this and we can take on maintenance as I do not see this adding much. This language looks good to me as well. I will review this and get back to you today or tomorrow. Will this pathway include landscaping? From: Morgan Bessaw <mbessaw@cityofcaldwell.org> Sent: Friday, May 10, 2024 4:57 PM To: Juli McCoy <jmccoy@cityofcaldwell.org> Subject: Public pathway easement Hi Juli, We have been working with Caldwell High School to get an easement from a proposed development through the school site into Brothers Park. They have agreed and we are working on the easement language and what the City is willing to agree to. They want us to maintain it. I know we would not normally, but since it is attached to Brothers park and will be like an extension of the existing pathway network, we thought that we might be willing to agree to that in order to get this great connection. I drafted an easement but it was based on a utilities easement template so I am not sure if you have a better one to use. I have attached the draft as is so you can review and make any necessary changes as well as to start the discussion about the maintenance. The pathway would be 3 approximately 500 feet long and placed between two fences that were 10 feet apart. The pathway would be constructed of asphalt and would be 5 feet in width.
