2 MIDLAND 20-26 / AVIARY SUBDIVISION – RESPONSE TO CALDWELL CITY ENGINEERING COMMENTS GENERAL. On page 1, above, FP denotes right-of-way, turn lane, intersection design and canal relocation issues to be addressed during the final plat / engineering design process—in conjunction with City staff and the Highway District. We believe those issues should be appropriately noted as “conditions of approval” in the staff report. COMMENT ITEMS 1 – 6 ARE SPECIFICALLY NOTED. Item 1: The cul-de-sac islands will be removed in the final plat, as requested. Item 2: The Engineering note is correct—the lots do not have public street frontage. However, page 19 of the application narrative notes that “proposed deviation” from City Code, as allowed through the PUD process. Item 3: Two TIS issues—(1) calculation of traffic mitigation costs, and (2) storage units. The first is being addressed separately by the traffic consultant; the second reflects an error of graphic interpretation. While the orientation of the lots changed from the TIS to the preliminary plat, the use has not—they have always been dwellings, not storage units. Storage, a use noted in the TIS, remains in the commercial area at the northeast corner of Midland and Skyway. Item 4: As in our prior Arbor project, the alleys are for private access and will not be dedicated to the public. Item 5: The 20-foot alley width is consistent with the City-approved 20’ concrete alleys in Arbor, the standard proposed through the PUD process. The distinction is a total concrete alley with drainage versus a 20-foot asphalt section flanked by 2-foot concrete strips for drainage conveyance. Item 6: Canyon Highway District No. 4 secured the future road right-of-way west of Midland in alignment with Skyway as denoted in the preliminary plat (Instrument No. 200461218, recorded November 4, 2004). Obviously, we will reach out to the District prior to final plat design. However, if the District has not changed its plans, the alignment will remain as proposed. A PDF titled “Midland 20-26 Skyway Alignment” is provided to substantiate the point.
