HomeMy WebLinkAboutRES 394-23 (Midland 20-26 CPM)RESOLUTION NO. 394-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALDWELL, IDAHO, AMENDING THE COMPREHENSIVE PLAN [AND LAND USE MAP]; AFFIRMING THAT PRESCRIBED NOTICE AND HEARING REQUIREMENTS WERE MET IN ACCORDANCE WITH TITLE 67, CHAPTER 65, IDAHO CODE AND THE CALDWELL CITY CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to Idaho Code 67-6509, the City of Caldwell has adopted and maintained a Comprehensive Plan to manage future growth and development of the City and the City’s area of impact; and, WHEREAS, The City of Caldwell first adopted a Comprehensive Plan Map on February 15, 1977; and, WHEREAS, the City’s Comprehensive Plan Map was most recently amended on February 21, 2023; and WHEREAS, Idaho Code 67-6509(b) provides that the City Council may adopt, amend or repeal a Comprehensive Plan; and WHEREAS, The Mayor and City Council have deemed it appropriate to amend and update the City of Caldwell Comprehensive Plan Map as follows: Case No. & Name Parcel # Current Designation Approved Amendment Acres CPM23-000011 (Midland 20/26) R3412701, R3412301, R34126, R34157011, R34159, R34158, R34156, and portions of R34127, R34122, R34125, & R3412501 Low Density Residential and Residential Estates Medium Density Residential (MDR) 48.12 acres, more or less *same Portion of R34127 Low Density Residential Highway Corridor (HC) 36.82 acres, more or less *same R34287, and portions of R34288 & R34286 Highway Corridor Medium Density Residential (MDR) 63.95 acres, more or less *same R3429501 and portions of R34286 & R34285 Highway Corridor and Low Density Residential Commercial and Service (CS) 33.15 acres, more or less *same R3429501 & R34298 Low Density Residential High Density Residential 18.36 acres, more or less and; WHEREAS, the Mayor and City Council have provided all the requisite notices, held the necessary hearings, and received the required information necessary to make a final decision as required by the Idaho Local Land Use Planning Act to amend the adopted Comprehensive Plan Map; and WHEREAS, The City Council hereby finds that the foregoing-described amendments to the Comprehensive Plan comply with the Idaho Code 67-6508. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, IDAHO, AS FOLLOWS: SECTION 1: Pursuant to Section 67-6509 of Idaho Code, the Mayor and City Council hereby amends the City of Caldwell Comprehensive Plan [and Land Use Map]. SECTION 2: EFFECTIVE DATE. This resolution shall be in full force and effect immediately upon its adoption. PASSED BY THE COUNCIL of the City of Caldwell this 2nd day of April, 2024.
