ORDINANCE NO. 3561
AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS CONTIGUOUS TO THE CITY LIMITS
OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS
SHOULD BE ANNEXED TO THE CITY OF CALDWELL, IDAHO, AS PART OF THE R-2 (MEDIUM
DENSITY RESIDENTIAL) ZONE AND H-C (HIGHWAY CORRIDOR) ZONE; DECLARING SAID LANDS
BY PROPER LEGAL DESCRIPTION AS DESCRIBED BELOW TO BE A PART OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND
ZONING DIRECTOR TO ADD SAID PROPERTY TO THE OFFICIAL MAPS OF THE CITY OF
CALDWELL, IDAHO; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH; AND DIRECTING THE CLERK OF THE CITY OF CALDWELL TO
FILE A CERTIFIED COPY OF THE ORDINANCE AND MAP OF THE AREA TO BE ANNEXED WITH
CANYON COUNTY, STATE OF IDAHO AND THE IDAHO STATE TAX COMMISSION, PURSUANT TO
IDAHO CODE, SECTION 63-215.
BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF
CANYON, STATE OF IDAHO:
Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning
Commission and following the public notice and hearing procedures set forth in Section 10-01-07, Zoning
Ordinance No. 1451, approved Case No. ANN23-000016 (Midland 20/26 Annexation) at a public hearing
held this 2nd day of April, 2024
Section 2. The parcel is contiguous to the City of Caldwell, Idaho and the applicant has requested that
said following described property should be annexed into the City of Caldwell as R-2 (Medium Density
Residential) and H-C (Highway Corridor):
A parcel of land situated in a portion of the West ½ of the SW ¼ of Section 21, T4N, R2W, BM, Canyon
County, Idaho and being more particularly described as follows:
BEGINNING at the S 1/16 corner of said Section 21, which bears S00°46'19"W, 1313.99 feet from the W
¼ corner of said Section 21; thence N00°46'19"E, 584.58 feet along the westerly line of the NW ¼ of said
SW ¼ of Section 21; thence S32°10'00"E, 38.21 feet; thence S88°21'09"E, 854.49 feet; thence
S05°36'31"W, 403.43 feet; thence S39°36'30"W, 169.68 feet on the southerly line of said NW ¼ SW ¼;
thence N89°38'26"W, 210.64 feet along said southerly line; thence S52°07'02"W, 146.26 feet; thence
N89°33'58"W, 409.89 feet to the westerly line of the SW ¼ of said SW ¼; thence N00°46'19"E, 90.00 feet
along said westerly line to the POINT OF BEGINNING. Said parcel contains 11.465 acres, more or less.
R-2 Parcel:
BEGINNING at a brass cap marking the South 1/16 corner of said Section 21, which bears S00"46'19"W a
distance of 1,313.99 feet from a brass cap marking the West 1/4 corner of said Section 21;
Thence following the westerly line of the Northwest 1/4 of the Southwest 1/4 of said Section 21,
N00°46'19''E a distance of 584.58 feet to a 5/8-inch rebar;
Thence leaving said westerly line, S32°10'00''E a distance of 38.21 feet to a 5/8-inch rebar;
Thence S88°21'09"E a distance of 854.49 feet to a 5/8-'inch rebar;
Thence S05°36'31"W a distance of 403.43 feet to a 5/8-inch rebar;
Thence S39°36'30"W a distance of 169.68 feet to a 5/8-inch rebar on the southerly line of said Northwest
1/4 of the Southwest 1/4;
Thence following said southerly line, N89°38'26"W a distance of 734.76 feet to the POINT OF BEGINNING.
Said parcel contains 10.497 acres, more or less.
H-C Parcel:
BEGINNING at a brass cap marking the South 1/16 comer of said Section 21, which bears S00°46'19"W a
distance of 1,313.99 feet from a brass cap marking the West 1/4 corner of said Section 21;
Thence following the northerly line of the Southwest 1/4 of the Southwest 1/4 of said Section 21,
S89°38'26"E a distance of 524.12 feet;
Thence leaving said northerly line, S52°07’02"W a distnce of 146.26 feet;
Thence N89°33'58"W a distance of 409.89 feet to the westerly line of said Southwest 1/4 of the Southwest
1/4;
Thence following said westerly line, N00°46'19''E a distance of 90.00 feet to the POINT OF BEGINNING.
Said parcel contains 0.968 acres, more or less.
Total annexation contains 11.465 acres, more or less.
Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are
hereby instructed to so designate the same above described property on the official zoning map and other
area maps of the City of Caldwell, Idaho as R-2 (Low Density Residential) and H-C (Highway Corridor).
Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and
publication, according to law.
Section 6. The Clerk of the City of Caldwell, Idaho shall, within 10 days following the effective date of this
ordinance, duly file a certified copy of this ordinance and a map prepared in a draftsman-like manner plainly
and clearly designating the boundaries of the City of Caldwell, including the land herein annexed, with the
following officials of the County of Canyon, State of Idaho, to-wit: the Recorder, Auditor, Treasurer and
Assessor and shall file simultaneously a certified copy of this ordinance with the State Tax Commission of
the State of Idaho, all in compliance with Idaho Code 63-215.
