HomeMy WebLinkAboutOrd 3481 (Midland Meadows REZONE) - DMBILL NO. 83 ORDINANCE NO. 3481 AN ORDINANCE DETERMINING THAT CERTAIN LAND LAYS WITHIN THE CITY LIMITS OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, AND THAT SAID LANDS SHOULD BE REZONED TO THE R-2 (MEDIUM DENSITY RESIDENTIAL) ZONE; DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; DIRECTING THE CITY ENGINEER AND PLANNING AND ZONING DIRECTOR TO AMEND SAID PROPERTY ON THE OFFICIAL MAPS OF THE CITY OF CALDWELL, IDAHO; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED, BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That the Caldwell City Council, upon recommendation of the Caldwell Planning and Zoning Commission and following the public notice and hearing procedures as required in Section 10-03-03, Caldwell Municipal Code, approved Case No. ZON22-000013 (Midland Meadows) at a public hearing held this 1st day of August, 2023. Section 2. The parcel is within the City of Caldwell, Idaho and the applicant has requested that said following described property should be rezoned to R-2 (Medium Density Residential zone: A portion of the NE ¼ of Section 20, Township 4 North, Range 2 West, Boise Meridian, Canyon County, Idaho, being more particularly described as follows: BEGINNING at the NE corner of the SE ¼ of said NE ¼, from which the SE corner of said SE ¼ NE ¼ bears S00°46'27"W, 1313.87 feet; thence S00°46'27"W, 706.32 feet along the easterly boundary of said SE ¼ NE ¼; thence N89°18'33"W, 301.84 feet; thence S50°19'27"W, 15.25 feet; thence S09°58'27"W, 118.40 feet; thence N80°18'47"W, 454.26 feet; thence N84°42'47"W, 1220.88 feet to a point of curvature; thence 194.85 feet along the arc of a 543.70 foot radius curve right, said curve having a central angle of 20°32'00" and a long chord bearing N74°26'57"W, 193.81 feet to a point of tangency; thence N64°10'47"W, 332.84 feet to a point on the easterly right-of-way of the Oregon Short Line Railroad; thence N18°47'16"W, 483.30 feet along said right-of-way to a point on the westerly boundary of the SW ¼ of said NE ¼; thence N00°40'59"E, 14.42 feet to the NW corner of said SW¼ NE ¼; thence S89°21'42"E, 1324.19 feet along the northerly boundary of said SW¼ NE ¼ to the NE corner of said SW ¼ NE ¼; thence S89°23'23"E, 1324.85 feet along the northerly boundary of said SE ¼ NE ¼ to the POINT OF BEGINNING. Contains 40.91 acres, more or less. Section 3. That the City Engineer and the Planning and Zoning Director of the City of Caldwell, Idaho, are hereby instructed to so designate the same above described property on the official zoning map and other area maps of the City of Caldwell, Idaho as R-2 (Medium Density Residential). Section 4. All ordinances, resolutions, orders or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and in effect from and after its passage, approval and publication, according to law.
