Property Owner: KM Engineering ) ) ) ) ) ) ) ) ) ) ) FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION Case No. SUB21-000039 I.FINDINGS OF FACTS 1.APPLICANT:KM Engineering 2.PROPERTY OWNER: KM Engineering 3.APPLICATION REQUEST: Application for final plat approval of Adam’s Ridge Subdivision No. 7 subdivision consisting of 73 single-family residential lots and 10 common lots on approximately 18.51 acres. 4.SITE ADDRESSAND LOCATION:The subject site is located on the north side of Laster Ln., approximately 1,000 feet west of the intersection with Midland Blvd, with a property address of 0 Midland Blvd., described as a portion of 05-3N-2W NE TX 22395 IN NE. 5.ASSESSORPARCELNUMBER(S): R3086800000 and R3086701400 6.PROPERTY SIZE: Approximately 18.52 acres, more or less 2 7. PUBLIC NOTICING: The following noticing was completed in accordance with Caldwell City Code Section 10-03-12: Public Agency Notification Sent 4/4/2024 8. AGENCY COMMENTS: Public agency comments were received from the following agencies and are included in their entirety as part of the official record and the exhibits attached hereto. a. Nampa Highway District – General information only – no opposition stated b. Nampa Planning and Zoning – General information only – no opposition stated c. City of Caldwell Engineering Department – Provided general conditions for approval d. City of Caldwell Fire Department – Provided general conditions for approval 9. PRELIMINARY PLAT AND DEVELOPMENT BACKGROUND AND HISTORY: The preliminary plat for Adam’s Ridge Subdivision was approved by the City Council on 8/20/2018 as SUB-18P-04. The Phase 6 Final Plat was recorded on January 27, 2023. A time extension, TE23-000016, was approved by City Council on January 16, 2024, providing until January 27, 2025 for the Phase 7 final plat to be recorded. This phase consists of 18.51 acres and includes 73 single-family residential lots. 10. APPLICABLE REGULATIONS AND GUIDING DOCUMENTS: a. City of Caldwell Zoning Ordinance No. 1451, as amended b. City of Caldwell Subdivision Ordinance, as amended c. Idaho Code, Title 67, Chapter 65, Local Planning Act 11. REQUIRED FINDINGS & APPROVAL STANDARDS – Final Plat: Caldwell City Code Section 11-02-03 (2) D outlines the Conclusions of Law for approving a final plat. Before the council approves a final plat, the council must find and conclude the following: 1. Final plat is compliant with city codes. 2. Final plat is compliant with the approved preliminary plat. 12. STAFF REVIEW AND ANALYSIS: Staff has reviewed the final plat for compliance with city code and the approved preliminary plat. The final plat received a time extension (TE23-000016) which was approved by City Council on January 16, 2024, providing until January 27, 2025 for the Phase 7 final plat to be recorded. The plat is not expired and is in substantial compliance with the preliminary plat. The club house and pool were required to have the certificate of occupancies before signature of phase 7, these have been obtained and the condition has been met. 13. CITY COUNCIL DECISION: The subject application was placed on the May 7, 2024, City Council consent agenda for consideration in accordance with Caldwell City Code. Regarding the request for a final plat approval for Adam’s Ridge Subdivision No. 7, a residential subdivision with 73 single-family lots and 10 common lots in an R-2 (Medium Density Residential) zone on approximately 18.52 acres on Parcels R3086800000 and R3086701400, located in the 05-3N-2W NE TX 22395 IN NE, the City Council received and reviewed the record and finds and concludes the following: 3 Based upon the information received and the record of evidence presented, the City Council voted to APPROVE the request for final plat approval, subject to the conditions herein. In approving the requests, the City Council concluded the following: The application approval process has complied with the public notice and hearing requirements of Idaho Code and Caldwell City Code; and 1. The final plat is compliant with city codes; and 2. The final plat is compliant with the approved preliminary plat; and II. CONCLUSIONS OF LAW 1. The City of Caldwell has provided for the processing of Land Use permits authorized by Chapter 65, Title 67, Idaho Code, pursuant to Chapter 10 Zoning Regulations and Chapter 11 Subdivision Regulations. 2. The record includes, but is not limited to all files, application documents, public notices, public comments and testimony, staff reports and memos, presented evidence and exhibits, public hearing written minutes and audio, and the signed Findings of Facts, Conclusions of Law, and Decision. 3. The Caldwell City Council.is authorized to approve, approve with conditions, approve with modifications, or deny final plat applications in accordance with Caldwell City Code. III. CONDITIONS OF APPROVAL NOTE: Any conditions removed by the governing body will be shown in a strikethrough. Any conditions added by the governing body will be shown as underlined. The approval of the application requests for (SUB21-000039), are subject to the adherence of the following conditions: A. General Requirements: 1. Applicant shall meet the platting requirements as set forth by City Code and in the preliminary plat approval for this final plat, and for any letters of credit required. 2. Applicant shall meet the Engineering Department Conditions of Approval as shown in Attachment B. and the Fire Department Conditions of Approval as shown in Attachment C. 3. Recorded mylars of the final plat shall be submitted to the Caldwell Engineering Department. 4. One paper copy of the recorded mylar shall be submitted to the Caldwell Planning and Zoning Department. 5. Development of the subject property shall be consistent with all requirements, codes, policies, standards, and regulations of the City of Caldwell, unless specifically stated otherwise in a Development Agreement or in the Order of Decision. 6. If any term or provision of this decision, to any extent, is held invalid or unenforceable, the remaining terms and provisions hereof shall not be affected thereby, but each such remaining term and provision shall be valid and enforced to the fullest extent permitted by law. 7. Any nuisances existing on the property (weeds, trash, debris, etc.) shall be resolved and in compliance with city codes prior to the approval of any construction drawings and/or issuance of building permits. 4 8. Any changes to the plans and specifications upon which this approval is based, other than those required by the above conditions, will require submittal of an application for modification and approval of that application prior to commencing any change. 9. All improvements and operations shall comply with applicable local, state and federal requirements and procedures whether specifically addressed in the analysis of this application or not. 10. All requirements from the Fire Department for access, turnarounds, emergency access, water supply, fire hydrants, etc. shall be met in the development and/or platting of the subject property. Final approval of the location and number of fire hydrants within the development shall be determined by the Fire Marshal and take place by phase at the time of submittal of applicable construction drawings for each phase. In addition, all other conditions as listed in Exhibit 2 must be met. 11. Comply with all requirements of the City Engineering Department as specified in their memo dated 4/8/2024 and shown in Exhibit 2. 12. All new construction shall comply with the current height, setback, and area schedule in effect at the time the building permit is filed, excluding setbacks, height, and/or area schedule requirements approved through a planned unit development, special use permit and/or development agreement. 13. Fencing: Fencing must comply with Caldwell City Code Section 10-02-07. 14. This approval is for the application(s) specified herein only. Additional permits, licenses and approvals may be necessary. 15. Cluster Mailboxes: The development shall utilize cluster mailboxes for delivery of mail. Individual mailboxes shall not be allowed. A cluster mailbox placement plan shall be submitted to the Planning and Zoning department showing coordination with the United States Postal Services prior to submitting the construction drawings. 16. Subdivision Construction Signage: At the time of development, a "rules and regulations" sign shall be posted and maintained at the entryways to the project until it is fully developed and buildout is complete. The signs would be intended for subcontractors performing work and should include: a) no dogs; b) no loud music; c) no alcohol or drugs; d) no abusive language; e) disposal of personal trash and site debris; f) daily cleanup of any mud and/or dirt that is deposited from the construction parcel onto streets; g) installation of a temporary construction fence that would keep debris from being blown off site by the wind; h) no burning of construction or other debris on the property. 17. Approved Subdivision Name: No changes to an approved subdivision name on a preliminary plat shall occur unless a request is initiated through the filing of a Subdivision Name Change Request Application for administrative staff level review and approval. If approved, preliminary plat drawings will need to be amended and submitted to the Planning and Zoning Department with the reflected subdivision name change prior to the acceptance and/or approval of construction drawings. All construction drawings and final plats shall reflect the new approved subdivision name. Upon recordation of the final plat, all recorded subdivisions shall be known and referred to by the city approved subdivision name, in all permanent or temporary signage physically located on or near the location of the subdivision, and on all deeds and legal documents. This requirement shall continue through the development of each phase of the subdivision and shall survive completion of the subdivision unless a request is initiated through the filing of a Subdivision Name Change Request Application for administrative staff level review and approval. If approved, an amended final plat drawing in compliance with 11-02-02 (2) will be required. A variation in the subdivision name required by this chapter may be permitted for parcels within the subdivision that are being developed solely for commercial or multi-family commercial apartments, as approved by the city, and may be designed and constructed as their own separate phases which do not have to follow the subdivision phasing sequencing required by 11-02-03 (1) (G). Please accept this letter as the required written narrative regarding the project. The Adams Ridge project is located at the southwest corner of Ustick Road and Midland Boulevard in Caldwell, Idaho. As a part of Case No. ANN-18-04 / SUB-18P-04, the +/- 159-acre project was annexed into the City of Caldwell with a split zoning of R-2 and C-2. In addition, a preliminary plat was approved for the project, which included 448 buildable single-family lots, 1 buildable multi-family lot and 13 buildable commercial lots. Since then, 50 buildable lots have been platted with Phase 1; 37 buildable lots have been platted with Phase 2; 52 buildable lots have been platted with Phase 3; 42 buildable lots with Phase 4, 47 buildable lots are currently being platted with Phase 5, and 92 buildable lots are currently being platting with Phase 6. The seventh phase of this project proposes 73 buildable single-family residential lots and 10 common lots on approximately 18.51 acres. Access for this phase is proposed via connections to stub streets provided with previous phases. To our knowledge, this final plat is in substantial conformance with the approved preliminary plat and the applicable City ordinances. Any deviation from this plan is subject to Fire Department approval. Please note that unless stated otherwise, this memo represents the requirements of the 2018 International Fire Code (IFC) as adopted by the Idaho State Fire Marshal’s Office. Conditions: 1. Fire hydrants, capable of producing the required fire flow, shall be located along approved fire lanes. Fire hydrant spacing shall meet the requirements of IFC table C105.1.1 (IFC 507.3, IFC B105.2, IFC C105). 2. Roadway serving a fire hydrant shall be a minimum of 26-feet in width. (IFC D103.1) 3. Dead-end fire apparatus access roads exceeding 150 feet (45 720 mm) in length shall be provided with an approved area for turning around fire apparatus. (IFC 503.2.5) 4. Fire apparatus access roads shall extend to within 150 feet of all portions of the exterior walls of the first story of a building measured by an approved route around the exterior of the building or facility. (IFC 503.1.1) 5. Fire apparatus access roads shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. (IFC 503.2.1) 6. The minimum outside turning radius of a fire apparatus access road shall be 48 feet. The minimum inside turning radius shall be 28 feet. (IFC 503.2.4) 7. Fire apparatus access roads shall have an approved driving surface of asphalt, concrete or other approved driving surface and can support the 403 Blaine Street  Caldwell, ID 83605  Phone 208-649-1266  Fax 208-455-3014 imposed load of fire apparatus weighing at least 80,000 pounds. Please provide documentation the road surface meets this standard. (IFC D102.1) 8. Fire apparatus access roads shall not exceed 10 percent in grade. (IFC D103.2) 9. For streets having a width less than 33 feet back of curb to back of curb parking shall be restricted on one side; for streets having a width less than 27 feet back of curb to back of curb parking shall be restricted on both sides. A note on the face of the final plat is required noting the parking restriction prior to signing of the final plat. In addition, No Parking signs shall be installed in accordance with the requirements of the IFC. (IFC 503.8) 10. Approved secondary access roads shall be provided per section D106 of the 2018 IFC. 11. Where fire apparatus access roads or a water supply for fire protection are required to be installed, such protection shall be installed and made serviceable prior to and during the time of construction except where approved alternative methods of protection are provided. Temporary street signs shall be installed at each street intersection where construction of new roadways allows passage by vehicles in accordance with (IFC Section 505.2. 12. Developments of one- or two-family dwellings where the number of dwelling units exceeds 30 shall be provided with two separate and approved fire apparatus access roads. Exceptions: 1.
