RE: Administrative Determination AD24-000001 – 5118 Cleveland Blvd.
Dear Mr. Nasland,
We have reviewed your request for administrative approval of a reduction to the landscape
buffer requirements for a new Fuel Station at 5118 Cleveland Blvd. Caldwell City Code 10-
07-08 (3) requires a 25 foot wide landscape buffer on the development frontage abutting
all major arterial roadway, and Cleveland Blvd. is designated a major arterial roadway.
The applicant has requested a reduction of the landscape buffer from 25 feet to 20 feet
along their parcel frontage. Caldwell City Code 10-07-08 (4) does permit a reduction to the
buffer width at the discretion of the City based upon existing conditions, lot size, right-of-
way requirements, topography and geography of the site. Buffer width reductions shall not
be granted based upon financial or economic reasons.
The applicant has stated that based on the location of the sewer lines, a 25 ft. buffer would
push the fuel tanks within 1 foot of the sewer easement and greater spacing between the
fuel tanks and sewer lines is desired. Additionally, the reduced landscape buffer width will
improve vehicular turning movements on the site.
Staff has reviewed the buffer reduction request and finds it complies with City Code. Staff
has also reviewed the site; the reduction of the landscape buffer width will not negatively
impact the landscaping contiguity along Cleveland because the developed parcels on either
side of the subject parcel have substantially less landscaping than the applicant is
proposing for the site. Therefore, the reduction request is approved.
Please note that this does not constitute landscape plan approval. The landscape plan will
be reviewed and approved during the building permit process. All building, fire, and
engineering requirements will still need to be met.
